He vs She
> A friend and neighbor of Blasey Ford told the Mercury News on Monday that she had told her of the alleged assault by Kavanaugh, without naming him, as the /#MeToo movement gained additional momentum.
> “I can’t really think of anyone better” to answer questions from the committee, Rebecca White told the Mercury News. “She’s one of those people who teems with honesty and truth.”
It matters not that Kavanaugh’s friends, and more of them are willing to stand up for him.
Fuzzy Details
People are willing to assume “He Did It”, despite the fact there are virtually No Details by Ford.
> Ford’s memory is so fuzzy that there is very little in her story that can be corroborated or debunked. She doesn’t know what year it happened, although she thinks 1982. She doesn’t know who owned the house where the party took place, or how she got there or how she got home.

The WSJ discuses the #MeToo Kavanaugh Ambush

Experts know that human beings can come to believe firmly over the years that something happened when it never did or is based on partial truth. Mistaken identity is also possible.
> The Post reports that the therapist’s notes from 2012 say there were four male assailants, but Ms. Ford says that was a mistake. Ms. Ford also can’t recall in whose home the alleged assault took place, how she got there, or how she got home that evening.

What are the Facts?
What are the facts at present?
All we really know is what both sides said.
The statements from both sides are allegations of course, but it it is a discernible fact that some things have been stated and denied.
Facts
- 36 years after the fact, Ford alleges she was sexually assaulted by Kavanaugh at a party.
- Ford made the statement while under counseling for a broken marriage.
- The therapist’s notes from 2012 say there were four male assailants, but Ms. Ford says that was a mistake. She now says there were two male assailants, but there were four males at the party. The notes say four boys were involved, a discrepancy Ford says was an error on the therapist’s part. Ford said there were four boys at the party but only two in the room.
- Ford says she wanted to remain anonymous but shed failed to do so.
- “I thought he might inadvertently kill me,” said Ford. “He was trying to attack me and remove my clothing.”
- Ford said she was able to escape when Kavanaugh’s friend and classmate at Georgetown Preparatory School, Mark Judge, jumped on top of them, sending all three tumbling.
- The Washington Post reports “Ford said she told no one of the incident in any detail until 2012, when she was in couples therapy with her husband.”
- Jim Gensheimer, a friend of Ford’s, told the San Jose Mercury News that Ford has been “trying to forget about this all of her life, basically” and that she has told him that she is afraid to sleep in bedrooms that do not have a second way out.
- Kavanaugh “categorically and unequivocally” denies Ford’s allegations.
- A source close to Kavanaugh claims that Kavanaugh did not know Ford. We obviously need to hear that from Kavanaugh, not a third party, if indeed Kavanaugh made the claim.
- Sen. Orrin Hatch, R-Utah, told reporters Monday that Supreme Court nominee Brett Kavanaugh categorically denied allegations that he committed sexual assault at a high school party in the early 1980s — and told the senator he was not at a party similar to what his accuser described.
- In a statement to Fox News, Hatch’s office said that Kavanaugh told the senator “he was not at a party like the one [Ford] describes” and added that Ford “may be mistaking [Kavanaugh] for someone else.”
Those are the facts. That makes none of them true. Rather it is a fact that those claims have been made.
If anyone disputes those statements have been made, I will gladly modify my list.
Bright Line Denial
Points 10-12 are clear denials, but we need to hear them from Kavanaugh himself.
They are in sharp contrast to fuzzy statements made by Ford.
Ford also claims her therapist made incorrect notes.
One of the ways liars attempt to deflect such stories is to make fuzzy statements. In this case, Kavanaugh “categorically and unequivocally” denies Ford’s allegations.
Implanting False Memories
The vagaries of memory are well known, all the more so when they emerge in the cauldron of a therapy session to rescue a marriage.
How reliable are memories of abuse “recovered” during psychotherapy?
That’s the question Psychology Today addresses in its report on Implanting False Memories.
> Dr. Elizabeth Loftus from the University of California identified two primary research paradigms that she studies in her memory laboratory at the University of California at Irvine. The first paradigm, which she calls the “misinformation” paradigm involves testing research subjects on a specific event and seeing how accurate their memory for that event is afterward. The second paradigm, focusing on implanting false memories, involves bringing subjects in and asking suggestive questions and seeing whether that influences recall of past events. As she concludes in describing her research, “we’ve done hundreds of experiments involving thousands of subjects showing that it’s relatively easy to change people’s memory of the details of an event that they’ve actually experienced.”
> Despite the ethical limitations imposed on laboratory studies of artificially created memories, research showed that creating false memories of a relatively benign childhood experience, i.e., becoming lost in a shopping mall as a young child was easily induced. Vagaries of Memory
The article discussed false memories of Paul Ryan, Mitt Romney, and Hillary Clinton.
Implanting of false memories and deterioration of memory over time are a well-established fact.
Admittedly, we do not know if it applies.
Nor can we be certain Hillary had a “false memory” or she was outright lying when she made her claim of “ducking gunfire” in Bosnia. Even her daughter, Chelsea, denied the gunfire claim.
So, was Hillary lying or did she really believe she was under gunfire?
All we can say it seems plausible if not extremely likely, that Ford either was outright lying or she has false, fuzzy memories.
Santa Clause Theory
This brings us to a Twitter discussion that also highlights the problem facing Kavanaugh.

I was asked if I assumed Ford was lying. My response, was 16 hours ago (which is why I strongly prefer a timestamp to this one whatever ago nonsense).
I publicly stated “I am neither dismissing the allegation outright, nor defending Kavanaugh if it’s true.”
That brought up the Santa Claus theory as well as this ridiculous reply.

The curious thing about that Tweet is it supports just what I was saying.
Another Fact
By the way, that’s another important fact. Kavanaugh’s mom was involved in a foreclosure ruling involving Ford’s mom.
Biased people like @mbobbish who accept Kavanaugh is necessarily guilty on the flimsiest of evidence are a huge part of the problem.
Where the Hell Are They?
I have a set of simple questions for all the /#MeToo’ers.
- There were allegedly four men at the party. What are the other names?
- Where are they?
- Where there other women at the party or was Ford the only woman there?
- Is it easily believable that a 15-year old girl told no one about this incident ever, until 36 years later, under therapy, and the memories are indeed accurate?
- Is it possible that Ford’s memories are indeed accurate but she has the wrong guy?
- How unlikely is it that Ford has a planted memory?
Please pay close attention to questions 5 and 6.
It is because of those question I stated, “I was not dismissing” the allegation. It may be true, but the wrong person.
Fair Hearing Unlikely
Meanwhile, mainstream media and the court of public opinion are both so heavily biased, the only way Kavanaugh can get a fair hearing is if Ford recants her story.
Presumption of Innocence
In France, one is presumed guilty until acquitted in court.
In the US, it is supposed to be the other way around.
Admittedly, I will sometimes take a position. In the case of Ray Moore, since nine women spoke out, I chose to believe the women.
In the case of Kanavaugh, he put himself on the line with a strong denial. That alone is evidence he did not do it.
Four Possibilities
Conclusion
The facts suggest that it is far more likely that Ford is either caught up in a blatant lie or she has false memories.
I am willing to change my mind if anyone else from the party can provide credible evidence.

There are lots of possibilities. From one extreme to the other, with no way to know which is correct, here are some of them:
The fact that so many people who knew him then and now voice that he has always been a perfect gentleman tend to render #1 unlikely. The fact that she passed a lie detector test tends to render 7 unlikely.
Many people are making comparisons between this, and cases like Clarence Thomas, Al Franken, and Harvey Weinstein. In my opinion, none of those are like this. Regardless of what you believe are the facts of those cases, all three were cases involving recent behavior, and involving multiple alleged events.
If it’s recovered memory, I would tend not to believe it. Not that I don’t think recovered memories are always true or false. A 15 yo has a high probability of remembering it if it happened. In some cases no.
The other aspect is that people often stuff traumatic events until middle age when age and life slowing makes it so you can’t. So waiting doesn’t really bother me. The parent part is interesting but no more believable or not believable than judge not wanting to testify due to politics and party lines.
Maybe there is a way to be fair to all parties — including us citizens who are watching aghast at this expensive circus.
The Senate could agree to confirm Kavanaugh, with the proviso that, if he is subsequently found to have lied about this long-ago incident, he will be impeached, removed from the bench, and prosecuted for lying. Similarly, if the woman is found to have lied she will be prosecuted to the fullest extent of the law.
Kavanaugh is given an opportunity to withdraw his candidacy for the Supreme Court. The woman is given an opportunity to withdraw her accusation. If neither takes that opportunity, Kavanaugh gets appointed to the Supreme Court and a Special Counsel is appointed — a real one, not another Muller — with a remit to interview everyone under oath, seek confirmatory details, and report to the Senate within a strict deadline of 2 months. Whoever lied will then suffer the consequences.
Just think about this where and when did you lose your virginity? How much can you remember about that even though it was long ago. I think much like this you can remember details. I can remember walking to elementary school and a guy pulled up and asked for directions, (he was masturbating) I just thought he was a weirdo with his pants down but remember it pretty vividly and in detail the car, where it happened and my parents and school officials reactions which I did not understand at the time. So to not remember any details seems to me total BS, so she is either lying as she is aligned with the left and leftists or she dreamed it or made it up in her head.
The more I read these replies the more relieved I am that I choose to not associate with partisans. On the one hand it becomes a self-reinforcing echo chamber, and on the other idiotic obtuseness.
The truth may be in the middle. He may be guilty. He may not be. The question that needs to be answered is if he is guilty or guilty of say half of it, does it prevent him at 53 from being a justice from something at 17. It was a different era and even if guilty of what she says a conviction was not likely. He buddy being silent is curious.
I think about that (Judge not testifying) and I think that in this hyper-partisan environment I don’t think I’d testify on behalf of my brother! Heck, the accuser won’t even testify!
The majority of the Senate is supportive of Kavanaugh. Mark Judge would be testifying in a friendly arena. So, I am not buying that he is refusing to testify because of partisanship.
If Mr. Judge would testify that nothing like this happened and Kavanaugh would be confirmed every democrat would hate him and hound him at restaurants like they do to Trump administration members.
If Mr. Judge would testify that nothing like this happened but Democrats would make the issue Mr. Judge’s character (he wrote some fratboy type book decades ago) and the Democrats would succeed enough so that couple of the NeverTrump republicans would flake and vote against Kavanaugh like Mr. Flake or some other nevertrumper then Mr.Judge would be hated by Republicans.
Best move is what Mr. Judge is doing aka say the claims by Hillary donating and Democrat loving and Womens March marching and pussy-hat wearing Mrs. Ford are bunch of bullsh*t and NOT true and stay away from the television cameras and hearings ginned up by desperate Democrats.

Kavanaugh said he wasn’t at the party. If the Dems can prove he was, case closed. Why should Judge testify? He already said he wasn’t at such a party. Would you want to go on national TV in front of that bunch of jackals and have them ask you questions on any subject? Just to establish your credibility, you know.
What party? The accuser can’t remember when and where it was. She can’t remember how she got there, how she got home or anyone else who was there. How is Kavanaugh supposed to defend himself against that?

As far as I understand it she can’t remember what year the party was, what month or an exact or inexact date, nor indeed where the party was held. So all in all she can remember b*gger all, which suggests that it is a tissue of lies. She then claims that the notes made are wrong, but one has to ask how the hell would she know ? She can’t remember can she ? She is a liar and actually Kavanaugh should sue her.
Yeah sure they might be able to find some parties that Kavanaugh went to. Then what? Dems will claim that Kavanaugh was there at the party. If this is the standard of proof, everyone can be proven guilty.

IMO opinion the possibilities are:
She is lying and Kavanaugh is telling the truth
Kavanaugh is lying and she is telling the truth
She sincerely believes her position (but the event never occurred) and Kavanaugh is telling the truth
She is telling the truth (the event did occur) and Kavanaugh sincerely believes it never occurred.
They both sincerely believe their respective positions
How do we know which of the above four outcomes is the correct one?
A. She passed a polygraph test regarding the alleged incident. At the very least, that lends credence to the position that she sincerely believes the incident occurred. If Kavanaugh would take and pass a poly, it would go a long way to bolster his position.
Mark Judge, the friend of Kavanaugh, who was also supposed to have been in the room, is refusing to testify in support of his friend. That is very curious to me. If Judge sincerely believed it did not happen, then why not testify to that fact? Wouldn’t you do that to help your friend make it to the SC? Don’t you find his unwillingness to testify puzzling?
If she is lying about it, why? What does she have to gain, and why would she subject herself to all the abuse which is coming her way? Note that Kavanaugh has a very good reason to lie about it – his SC seat is at stake and it will be next to impossible to prove that he is lying.
Women do not forget who attacked them sexually.
Unless some evidence comes out that she is lying, it seems to me that we are looking either at outcome 2, 3, or 4.
That polygraph sure is convenient. Who administered it? What specific questions were asked? Saying “she passed a polygraph” isn’t enough without more details.
Which begs the question why she took a polygraph in the first place if she always intended on remaining anonymous? Why delete all of her internet presence? Everything was scrubbed over a week ago, and that’s not an easy thing to do. Who helped her? I’m willing to bet it was full of anti-Trump hysteria, we already know she was a D activist.
My bet is she’s been huddled with a team of congressional staffers the past few days prepping to testify and even they can see that it would be a disaster to let her appear before the committee.
This is going to backfire spectacularly against the Dems in November. Even left-leaning women can see how easily their husbands and sons can have their lives ruined by baseless accusations from the Left that are impossible to defend.
There’s a reason “innocent until proven guilty” is a thing in this country.
I believe she took a poly on the advice of her lawyer, who knew what she would be facing. That makes sense.
I simply do not see the reason behind her actions IF she is lying. Is she getting paid? Does it further her career?
Further, the concept of a Democratic conspiracy also makes no sense. The reward is, what – Kavanaugh doesn’t get seated? So what – Trump will appoint another conservative for the seat, and very likely the Senate will be Republican so they are back to square one.
The risk is the conspiracy is discovered – and that would be horrendous for the Democratic party.
In short, the risk/reward ratio for a Dem conspiracy seems way out of whack.

My concern is more for what this means for our country. This lady has made completely unsubstantiated allegations against a public figure, and has no proof whatsoever. And Congress, the media and the weaker minded go nuts over it.
Why should our best and brightest (not saying Kavenaugh represents that) ever consider taking an important public role? When any yokel can come out and say anything and half the population will believe them?
And this isn’t a conservative/liberal thing. We had a ton of people believing Obama was a Kenyan Muslim. The Founding Fathers knew what they were doing when they limited the right to vote. It is obviously not something every American should be doing.
If government is properly limited, who happens to hold office, and on what basis, is irrelevant.
Ditto for a properly functioning legal system. If an alleged misdeed isn’t clear and obvious for all to see, courts have no business intervening.
The important criterion for whether a legal system is proper or not, is that it never harasses the innocent. If it occasionally helps catch and judge the occasional genocidal child murderer, that may be a nice thing, but not really all that important. Not ever, under any circumstance, harassing anyone not guilty, is the important part.
From that follows that anyone who wants to make a claim that someone caused them harm, and get court aid in redressing that, needs to do so at the absolute earliest possible moment. As any delay, makes it harder, hence costlier for the innocent third parties paying for the courts, to determine whether anything inappropriate actually can be reasonably proven.
If a “victim” lacks the decency and respect do that, both towards the courts and their ability to accurately make decisions, and towards the people paying for the upkeep of the courts; they forfeit any claim they may once have had to aid from the state. At least from any even half civilized and half justifiable state. Banana republics with Kangaroo courts designed explicitly to optimize for ambulance chasers’ ability to shake down the rest, obviously do differ in that regard.

In the absence of knowing, without extremely strong grounds (e.g. seven women accused Moore so I am willing to believe them), there is little reason to believe the accusations.
What I am most interested in regarding this thread is why do Republicans get their panties all twisted up so much over Democrats not bending over for them after they suffered 8 years of incessant Republican obstructionism during Obama’s presidency? How does that work in your brains? It is a fascinating phenomena to observe. Perhaps the student has become the teacher?

Now let me look at it from another angle. Who is the paying the politicians – tax-payers. These politicians gather together (in the name of doing our job) and SPEND OUR MONEY. Now they want to delay the confirmation, which means another sitting by this bunch and more tax-payer’s money down the drain.
Tax-payers should have the right to determine how their money is spent. Is this the way the tax-payers want their money to be spent?
Tax-payers are being taken for a ride and it is time for ‘No taxation without accountability (to a dime)’ moment. At present the tax-payers are providing the politicians a jolly good ride.

Dispositive evidence in a 30+ year old groping case which was not reported to parents or other authorities at the time? There can’t be any, but there are some additional parts of the girl’s (she was a girl at the time) story it would be good to hear about:
Some people want to believe the woman. OK — a question for them: If a minor behaves stupidly and (fortunately) does no physical harm, and then as an adult behaves impeccably for his entire life, is it fair to punish that individual for his long-ago lapse as a minor?
The main lesson from this woman’s tale is that it is stupid beyond belief for 15 year old girls to go to unsupervised drinking parties with older boys. Using the standard the Lefties want to apply to Kavanaugh, any woman who was stupid enough to behave that way as a minor should never be allowed to have any role as an adult in the education of young women.
Actually, the issue is now whether Kav is telling the truth in proclaiming that he never went to such parties, did not know this girl, and did not drink heavily. If those are shown to be lies?

I was going to suggest that we hear from some of Dr Ford’s high school classmates. Then I read that a group of 200+ alumnae (now 500+) from the classes of 1967-2018 has already written an open letter supporting her. I doubt most of them know Dr Ford personally yet they have already concluded that she is telling the truth! I agree with you that Kavanaugh cannot get a fair hearing when the mob rules. Democrats just deployed the nuclear option. They will come to regret it in time.

The only other person she remembers being there besides Kavanaugh categorically denies it happening. Kavanaugh has been through about a dozen full FBI investigations since this supposedly happened – security clearances, other confirmations, etc, with zero indication of this in his character. If there were corroborating witnesses don’t you think they’d have spoken up by now? The Left will stoop to any depths to outright destroy anyone who disagrees with them.
