Appeals Court Blocks Biden’s Vaccine Mandate in a Blistering Rebuke

An Illegal OSHA Mandate

In a Strong Rebuke, the 5th Circuit Court of Appeals blasted Biden’s OSHA vaccine mandate.

Key Judicial Points of the 5th Circuit

  • On the dubious assumption that the Mandate does pass constitutional muster—which we need not decide today—it is nonetheless fatally flawed on its own terms
  • Rather than a delicately handled scalpel, the Mandate is a one-size-fits-all sledgehammer that makes hardly any attempt to account for differences in workplaces (and workers) that have more than a little bearing on workers’ varying degrees of susceptibility to the supposedly “grave danger” the Mandate purports to address.
  • The Mandate is staggeringly overbroad. Applying to 2 out of 3 private-sector employees in America, in workplaces as diverse as the country itself, the Mandate fails to consider what is perhaps the most salient fact of all: the ongoing threat of COVID-19 is more dangerous to some employees than to other employees. All else equal, a 28 year-old trucker spending the bulk of his workday in the solitude of his cab is simply less vulnerable to COVID-19 than a 62 year-old prison janitor.  
  • In light of this immense complexity, one might naturally ask the Agency—is this situation truly amenable to a one-size-fits-all Mandate? 
  • At the same time, the Mandate is also underinclusive. The most vulnerable worker in America draws no protection from the Mandate if his company employs 99 workers or fewer. The underinclusive nature of the Mandate implies that the Mandate’s true purpose is not to enhance workplace safety, but instead to ramp up vaccine uptake by any means necessary
  • If the deficiencies we’ve already covered aren’t enough, other miscellaneous considerations seal the Mandate’s fate. For one, “[t]he Agency cannot use its ETS powers as a stop-gap measure,” Asbestos Info., 727 F.2d at 422, but concedes that that is precisely what the Mandate is intended to do here.
  • It lastly bears noting that the Mandate raises serious constitutional concerns that either make it more likely that the petitioners will succeed on the merits, or at least counsel against adopting OSHA’s broad reading of § 655(c) as a matter of statutory interpretation.
  • The Mandate likely exceeds the federal government’s authority under the Commerce Clause because it regulates noneconomic inactivity that falls squarely within the States’ police power. A person’s choice to remain unvaccinated and forgo regular testing is noneconomic inactivity.

The last bullet point above says it all: The “True purpose is not to enhance workplace safety, but instead to ramp up vaccine uptake by any means necessary.”

The Appeals Court ruling was unanimous, and rightfully so. 

Biden can appeal to the Supreme Court but the mandate is so obviously flawed I doubt the SC would even hear the case. 

What the Hell is Going On?

The mandate was so fatally flawed one has to wonder what the hell Biden was thinking when he had OSHA issue the ruling. 

Then when a lower court stuck it down, Biden could have walked away. 

Instead, he made an inane appeal and got blasted out the the water in a stunning rebuke. 

Are there no legal experts on Biden’s team? 

Given the public is overwhelmingly against the mandate, one might also ask, are there no opinion experts on Biden’s team that understand his ratings dive in the polls?

Brick Head Meets Brick Wall

With that, the bricks in Biden’s head just hit the brick wall of common sense by the 5th Circuit Court of Appeals. 

If you think this will have an impact on Biden, you are probably wrong.

Things which can’t be applied universally, are exactly what has no business being even mentioned in anything purporting to be valid Law. “Accounting for differences…” is exactly nothing at all whatsoever, other than carte blanche for pure, discretionary and arbitrary rule.

The vaccine mandate has nothing to do with safety or reducing the spread of covid. It’s so the democrats can claim they stopped covid via their vaccine mandate which will be dutifully reported by the mainstream media as a fact. It’s their only remaining hope in the mid terms. Without almost everyone being vaccinated, their story falls apart. Even to many of the braindead watchers of CNN.

The real thing this all has also brought out for companies is how delicate their balance truly was. The liabilities and risks will never go away. I once worked at a place where an employee kept coming to work when he had a strange virus. One day he didn’t wake up up was found dead in his apartment. This was back in 1996. It turned out he had a virus that killed him but was easily spread at work. The whole department had to get tested and was quarantined.  I would expect companies to err on the side of caution and make most workers non essential and allow them to work remotely when they can. Those essential workers that must go in person to perform their job duties will be valued differently by companies going forward.

Biggest thing I see coming out of all this is some workers are essential while others are not. Most workers will never have to go back to an office again and work has been permanently changed to being remote where it can. The essential part of the economy will start compensating workers for the risk they are taking by working in person. This will be better for these workers and the unions where applicable. This is a massive structural shift in the economy overall based on who is considered essential. What if government and economic stats were changed to weigh essential workers differently than non-essential workers. Imagine essential workers making much higher wages than non-essential workers.

Problem is, noone in charge of anything, including “valuing” and “weighing” anyone, is even remotely essential…… Haven’t been for decades. And furthermore, they are the ones The Fed handed “ownership” to whatever declining “assets” the debt Ponzi is built on top of. Hence, whatever less they have to settle for nominally, in order for someone who has a real job to get a raise; will simply have to be compensated for by robbing the latter ever harder via debasement, in order to prevent to Ponzi “system” from collapsing. His staff were thinking that some employers would enforce it before the dust settled, the result of which would be some people vaccinating to keep their jobs and some (mostly conservatives) getting fired.
When the rule is struck down, those vaccinated because of it can’t unvaccinate and there are no damages for a lawsuit (for 99% of them).
Those fired… maybe they can sue.  I hope they do and win.  I’m skeptical though.

Few if any are getting fired. Most are still working remotely and will permanently. There is precedent in some professions that mandate a flu shot or wear a mask during flu season.

Novavax is working on a COVID vaccine using the same traditional technology as the hepatitis-B vaccine. It promises to be MUCH safer. I might be willing to get a shot of that vaccine after more than 2 million people have tried it and 6 months of side effects have been studied.

I just watched a video on bitchute about a woman that contracted transverse myelitis after a hepatitis B vaccine that she got for work and is now paralyzed from the chest down.  She sued the California Department of Corrections (and Workers’ Comp) and won… it only took 5 years.

Beyond legalities, the problem with an OSHA vaccine mandate, is that the Covax causes injury and death, which creates a workplace hazard for employees who submit to receiving the jab, to keep their job.

When do they revise the definition of vaccinated? Multiple studies show that vaccine protection weens dramatically. Israel studies show protection weens about 10%/month while studies in  Sweden show that protection is near zero after 7 months. Accuracy may be somewhere in between but, based on medical research, a vaccinated individual should have a booster every 6 months until COVID is defeated. Due to mutations this may be a lifetime commitment. 
So you can have a vaccinated (current definition in the US) super spreader walk into a workplace and infect multiple people but someone with natural immunity cannot even enter the same workplace.
The verdict was unanimous for a reason. What happened to forming policies based on science and accurate data?

Well the big issue is the vax is the way back to a better economy and a prepared military.   Plus i would assume a better stance as a nation if it mutates into something worse.

This will be an interesting case to follow.  Constitutionally it appears defensible as it clearly does not mandate vaccinations, but instead dictates workplace safety protocols of vaccinations or regular testing.  From the SHRM webpage on OSHA workplace safety regulations: “Occupational Safety and Health Administration (OSHA) standards are
rules that describe the methods that employers must use to protect their
employees from hazards. There are OSHA standards for construction work,
maritime operations and general industry, which is the set that applies
to most worksites. These standards limit the amount of hazardous

The problem I see is that the CARES Act gave pharma liability immunity, but not to business.  If there is a mandate – and workers submit to a vaccine against their wishes – and adverse reactions occur.  Then what?

So what exactly would Covid fall under.

But the problem is there is no distinction. It’s a sledgehammer approach as the court correctly ruled. If it was broken down into some meaningful measures based on working circumstance it *might* have a hope of passing. Then for how long exactly will this be in place? And what about for regular flu and other communicable diseases. There is a big problem… IF the goal were to prevent the workplace hazard, then:
* ALL employees should test since the vacc doesn’t prevent infection
* ANY recovered employees should be exempt from the vaccine and testing requirement as the CDC records no recovered person to have transmitted the virus
BUT, they only mandate a vaccine or test. Demonstrates the goal is to vaccinate, not to stop the disease, nor protect the workplace.
Now, increase insurance premiums for not getting vacc’d, understandable because that is where a vacc helps, but stop the spread? at work?

I can only say that it would be the best thing for healthcare workers.
I wish that weren’t the case…..But because there are a lot dumb people in that industry who can’t judge their risk very well…and by not getting vaccinated (and still working)…..they create a public health hazard.  
Overbroad? Maybe. But people who lay their hands on other peoples bodies and breath their exhaled breaths in the course of their work have no excuse for skipping vaccination.
I expect the Supremes likely will hear it, because there is no precedent whatsoever for any judgement about such a mandate…over something that concerns the public health of every man woman, and child in the country. That’s pretty broad too, Mish.

I believe that it is well established now that vaccinated people can be infected and contaminate other people as well as the non vaccinated. The only difference is that the non vaccinated can be more serioulsly impacted.

There is no way to prove this.  The people who got it might have gotten mild cases anyways.  What CAN be shown is that Covid shots wear off beginning the day you get them, that vaccinated people can get sick with Covid, can wind up in the hospital and can die.  And that even if the vaccinated don’t wind-up in the hospital when they contact Covid, they still have to stay home and quarantine because they can transmit as well as a unvaxxed person because the Covid shots don’t actually kill the virus.
Y’all got snooked and now stand to suffer the more silent, long-term damage predicted from weaken hearts to blood clots to vascular damage to autoimmune diseases that may take years to show themselves.

(1) So, why not demand that every living being in the United States of America get two shots and a booster? Would this include Congress? Would it include illegal aliens (excuse me.. “undocumented migrants”)? 
(2) What does being vaccinated have to do with your place of employment? Private employers typically hire younger workers, but the most vulnerable are older people who are past retirement age. Why not first demand that they be vaccinated?
(3) Why only demand from those firms employing 100 workers? Does that mean full time, part time, temporary? How many companies are there that employ less than 100? Here in my state of Montana the average # of employees at private companies is 8. There are 61 million employees in small businesses and the average number per company is about 10.
(4) What is the justification for the extreme financial penalty on the employer? After all, it is the employee who is not getting vaccinated?
(5) What is the “proof” that a person is vaccinated? Counterfeit vaccination documents are available for a price.
(6) What about natural immunity? I recently heard a statement by a physician that people who have had Covid are 27x more protected.
(7) I have had Covid and a recent Antibody test that showed that I had a high level of antibodies and one shot. Is that good enough? If not, why not?

They will likely hear it just to establish precedent. But I fully expect it to be struck down in it’s current form. It’s way too broad based.
Medical people who worth with patients all day are vastly different than say truck drivers or loggers or golf course employees who may not interact with another person during their entire day. Most OSHA mandates are based on working conditions as they should be.
Incidentally, hospitals are free to require all their employees get vaxxed just as any corporation can. Most don’t want to push the issue at the moment with record levels of jobs waiting to be filled and so many people just opting out of working. The company I work for (3300+ employees world wide) just had a town hall video conference on Friday about how things are going and they specifically said they still won’t require vax for US employees because they believe Bidens mandate will fail.

How the heck do you get the right to decide that people are ‘dumb’ if they don’t do what YOU want? Perhaps they look at the ‘vaccine’ and realize that two shots DO NOT GIVE IMMUNITY, and the shots are effective for only a few months, hence the booster shots.
Worse, the ‘government’s talking head’ figure, Fauci, has consistently lied and changed his mind, and is clearly not the ‘expert’, and may be corrupt given his dealings with China, and Wuhan in particular.  And the guy in charge, President Cluster Fudge, was elected because he has a PLAN for Covid.  Clearly, bull$hit!

The vaccine has been proven to have zero efficacy and doesn’t prevent transmission or infection.  It supposedly reduces symptoms of the current variant, but the trials were fraudulent (according to whistleblowers), and the control group was eliminated (public info), so there’s no basis to say these mRNA therapies have a net benefit over a non-vaccinated persons’ immune system.   On the other hand both my parents had strokes, and a co-worker had a stroke (a vegetable in a hospital), soon after receiving these therapies–could be a coincidence but I highly doubt it.

29,934 fatalities, and 2,804,900 injuries, following COVID-19 injections.

This database maintained at EudraVigilance is only for countries in Europe who are part of the European Union (EU), which comprises 27 countries.

The total number of countries in Europe is much higher, almost twice as many, numbering around 50. (There are some differences of opinion as to which countries are technically part of Europe.)

So as high as these numbers are, they do NOT reflect all of Europe. The actual number in Europe who are reported dead or injured following COVID-19 shots would be much higher than what we are reporting here.

The EudraVigilance database reports that through October 19, 2021 there are 29,934 deaths and 2,804,900 injuries reported following injections of four experimental COVID-19 shots:

From the total of injuries recorded, almost half of them (1,311,861) are serious injuries.
