EU Opens Article Seven Process Against Poland: Poland to Leave the EU?

Article seven is a charge against a country for having non-European values.

Specifically, the charge against Poland relates to its judiciary, but the EU also took Poland, Hungary, the Czech Republic, and Slovakia to the European Court of Justice (ECJ) over migrant issues.

Yesterday the European Commission triggered an Article 7 procedure under the Lisbon treaty, which could, in theory, lead to the imposition of sanctions against a member state. This procedure’s final vote by the European Council will require unanimity, and Hungary has already said it would veto any attempt to impose sanctions on Poland. For that reason alone, the procedure is likely to fail. The Commission is going ahead because the symbolic act of starting the procedure matters more than the eventual outcome.
In the next step of the process, the Council has to pass a vote by a majority of four-fifths to determine that there is a serious risk of a member state failing to comply with the democratic values of the EU. The European Parliament will first have to give its consent. The procedure culminates with a vote at the European Council, where unanimity would apply. A veto by Hungary ends the process. The question is whether Hungary will actually come to the aid of Poland, and risk political isolation in the EU, or whether they will stick to their pre-announced position.
FAZ notes this morning that the case against Poland is similar to a case against Romania, where the government is seeking judicial reforms to facilitate corruption by government officials.
There are no signs of the Polish government backing down. Shortly after the announcement by the Commission, President Andrzej Duda signed off on two of the controversial judicial laws. The reaction of Poland’s new prime minister, Ma­teusz Mo­ra­wiecki, was mild in tone but hard in substance. He said the reform of the judiciary was necessary.
Where will this lead? We noted an interview in Die Zeit with the Polish political scientist Renata Mienkowska, who said Poland may leave the EU after 2020 if it ceases to be a net recipient of EU funds. If the governing party PiS wins the next parliamentary elections, due in late 2019, it may not have much of an interest in staying in the EU beyond the end of the current budget period in 2020. She called an EU-exit by Poland “absolutely possible” despite the fact that a large percentage of Poles appear to support EU membership. The reason is that the support for the EU is soft, and could easily turn into opposition.

Non-European Values

The notion of European values is a joke.

Nonetheless, no matter what one thinks of Poland’s judicial reforms, as long as any other country supports Poland, it is difficult for the EU to do much.

In this case, Hungary has stated it would side with Poland.

Romania may do the same given the EU has concerns regarding Romania’s judicial reforms.

Migration Analysis

Poland and Hungary refuse to take any migrants. The Czech Republic and Slovakia refuse to take their alleged “fair share”, yet another violation of “European values”.

The EU did not bring Article 7 charges against that block of countries as it was guaranteed to go nowhere. Unanimity would fail by at least four.

Instead, the EU took the case to the ECJ which ruled in favor of the EU in September.

“All members of the EU must respect the ruling,” Manfred Weber, the head of the of the largest faction in the European Parliament, told a news conference. “The legal fight is over.”

Legal Fight Not Over

The legal fight is not over, because the countries will not abide by the ruling.

On February 24, 2017, the Danish Supreme Court ruled the Principle of EU Law Does Not Prevail Over National Law.

By numerous measures, the legal fight is not over.

Toothless Tiger

Merkel stated that it was “unacceptable for EU states to disregard the court.”

But until the EU can find a way to penalize the offending countries, the EU will remain a toothless tiger.

Sanctions require unanimous approval. So do treaties. And there is no provision to kick a country out of the EU.

The body is large and unwieldy.

If the EU does find a way to strip Poland of subsidies, it may leave the EU.

Side note: if the VISEGRAD doesn’t leave because of migration then it may choose to leave rather than be conscripted into an all EU military which would be quite different than a NATO alliance. NATO recognizes each nations sovereignty and military campaigns are voluntary (except if mutual defense article is triggered). There is no way in hell or heaven the VISEGRAD nations will allow their citizens to be conscripted into an EU military campaign or war without sovereign approval after watching the EU accept tens of millions of migrants without sovereign approval. The EU elites have tried to bully the VISEGRAD nations as the Soviets did before them on the migrant issue. Expect the EU elites to do the same conscripting EU members. The issues between the EU elites and EU members and the EU populace is growing. The distrust is growing. The common ground is disappearing. There are billions in Africa and the middle east. There is another billion people in India, Pakistan, Bangladesh. There are another billion in China. How are you going to stop billions of people from entering Europe, particularly if there is even 1 EU nation with an open gate willing to accept them…and force them on other EU member states. How are you going to get 2-5% of the EU population to leave? They wont leave voluntarily to go to a hell hole when they are getting housing, transportation, food, medical care, cash stipends, phone, clothing, etc. These people are there for free money and as we see from their accusations of replacement and racism and protest…these African and muslim migrants will pull down the pillars of western civilization if it means they can continue to get their social welfare benefits. If the EU accepts them then there will be civil war. If the EU blocks them, they will invade. That’s why Europe is militarizing Africa but you cant militarize a continent against slave traders and human smugglers operating on a scale of millions. On that scale its war not a police action. On that scale you need a Napoleon or a Hitler not a bureaucracy. At its core, the problem is the over-populated world is invading the depopulating world.

I don’t think any of the VISEGRAD will leave unless they choose to do so. The only populations in Europe who defend immigration are Britain (media & Londoners), Australia, Sweden, France and Germany. I work with these Europeans and they are so blindly indoctrinated with leftist socialist values that they are will to turn their nation into a 3rd world Shariah caliphate rather than appear Islamophobic or racist. However, in the poor and working class all over Europe they want their country back. They want Africans and Muslims deported and the borders closed to immigration. Even if the EU had the power, the VISEGRAD has many on their side. If VISEGRAD were to leave, then don’t think for a minute Russia would not try to (hook or crook, friend or foe) to neuter or neutralize the VISEGRAD so it is not a threat to Russia and not an asset to the EU.

It appears the liberal wave of government by the “elite” has run out of steam. Now that the public has the benefit of the internet, it is much harder for the press and the government bureaucrats to continue their concentration of power against the citizens. Whether in Catalonia, Poland, or the US, the population is becoming aware of the fraud of powerful central governments.

“European Values” having led the lot of them to fight essentially permanent wars, sometimes genocidal, amongst themselves; from the dawn of Europe all the way up until a pair of nuclear armed non-European superpowers forced them to live by outside values for awhile……………. Not sure if this latest pogrom bodes well for the future.

@Maximus_Minimus what bothers me is that every other country in the world that is NON-white, does not have to be diverse. And no one calls them racist for it. But if I white majority county dares protect their borders to stick up for their historical racial composition, culture, religion….they are deemed by the the world media as these horrible racists. Why is is that racism applies to white countries but no other racial majority countries? It is total BS is what it is. And the fault of the liberal world media.

Why is it expected in the world that any white majority county MUST take in 3rd world immigrants? You don’t see China, Japan, South Korea, Iran, Brazil, Mexico, Pakistan, Israel, etc…doing this sh*t? They are smart, they are going to “diversify” whitey’s countries, but leave their own countries racially, culturally, religiously homogeneous. Jus wait until there are penalties, fines and sanctions issued by the EU against countries outside the EU that also do not hold to – not European values – but cock-ups on immigraion by Merkel thag would also bankrupt their own countries. How is it possible that the EU will punish its own members and then trade with countries that do exactly the same as those that it punishes. It is increasingly apparent that the left wing populist libtard socialist center of european politics does not reflect the interests of the people of europe and hence, the EU does not represent european citizens, only trough feeding left wingers who are feathering heir own nests at the expense of everyone else. Merkel is toast, Macron is being show up for the toy boy with no balls that he is, spain is about to get a lot smaller and italy preferes bunga bunga to EU EU. Unless the EU returns to its non-islmaic roots, it is toast.
