Five Big Immigration Reform Roadblocks
The Wall Street Journal discusses The Five Biggest Roadblocks to Trump’s Immigration Agenda
1: Immigration-court backlog
Most immigrants in the U.S. illegally can’t be deported without a hearing in immigration court, where they have a chance to ask for asylum or another avenue to stay in the country. But immigration courts are so backlogged that hearings are being scheduled as far into the future as 2029.Outside experts estimate that Congress would have to hire about 5,000 immigration judges—the system now has roughly 500—to efficiently sort through all existing cases as well as new ones.
2: Lack of ICE agents
The U.S. Immigration and Customs Enforcement agency is responsible for arresting immigrants in the country illegally, detaining them and deporting them. It has roughly 6,000 agents on staff and funding to jail about 40,000 immigrants at any given time. It doesn’t have nearly the fleet of planes needed to deport millions of migrants back to their home countries.
Republicans are hoping to use a budget process known as reconciliation to pass billions of dollars in spending for ICE as well as Trump’s border wall without needing Democratic votes. Even if the money comes, it will take the government time to recruit and train new ICE officers and make new detention space available.
Trump plans to declare a national emergency soon after taking office, which could unlock additional money taken out of the Pentagon’s budget for projects such as border-wall construction. Members of the National Guard or other troops won’t be allowed to perform immigration arrests, however; at best, they could be used for ancillary tasks, such as transporting immigrants. Trump’s designated border czar, Tom Homan, told The Wall Street Journal that military bases and planes could aid a deportation campaign.
3: Blue-state resistance
Immigrants living in the country illegally are often concentrated in big, Democratic-led cities such as New York, Chicago, Los Angeles and Denver.
Chicago Mayor Brandon Johnson said in a CNN interview recently that he wouldn’t be cooperating with federal immigration authorities. “The law is very clear,” he said. “Local police officers are not federal agents.”
Denver Mayor Mike Johnston has expressed support for limited deportations for migrants who crossed illegally and have committed violent crimes, but he is strongly opposed to mass deportations. Johnston has said he was prepared to go to jail to resist Trump’s plan and encouraged others to protest.
While it is still possible to arrest people living illegally in blue-led cities, it is far more challenging without local cooperation. Trump’s immigration advisers, including Homan, have publicly discussed cutting off federal grants and even pursuing criminal prosecutions of the officials enforcing sanctuary policies.
4: Lack of cooperation from foreign countries
Among the reasons President Dwight Eisenhower was able to pull off a broad deportation program in the 1950s, which Trump cites as a model, was that everyone he sought to send out of the country was from Mexico. But over the past few years, immigrants crossing into the U.S. illegally have come from record numbers of countries, such as China, India, Mauritania and Uzbekistan.
Many of the newly arrived migrants in the U.S. come from countries where diplomatic relations are frayed or even nonexistent, such as Venezuela.
U.S. immigration law allows immigrants to be deported to third countries if their home countries won’t take them back, but getting a third country to agree is rare. Trump has pledged to strike safe-country agreements with countries in Latin America and even Africa. He managed to reach an agreement with Guatemala during his first term to send asylum seekers from elsewhere in Central America there, but the agreement was short-lived. Only about a thousand people actually were sent.
5: Legal challenges
Many of the changes proposed by Trump and Stephen Miller, his incoming deputy chief of staff and longtime immigration adviser, can only be done through Congress—or perhaps even through a constitutional amendment.
A core issue they have attempted to surmount is that under existing law, migrants can legally ask for asylum even if they have entered the country unlawfully. Trump, and even Biden, sought to get around this by making asylum seekers live in Mexico while their claims were being weighed, jailing them, or coming up with new rules to make asylum seekers otherwise ineligible. As long as the law remains on the books, however, the government will struggle to find legal ways to narrow that right.
Trump’s pledge to end birthright citizenship, the practice of designating any baby born in the U.S. as a citizen no matter their parents’ immigration status, likely can’t be changed by Congress—let alone the executive order Trump has proposed. Most legal scholars say it would require amending the Constitution, a rare and difficult process.
Economic Insanity of Deport them All
There is no national mandate to deport 15 million people. Besides, the cost of doing so would be enormous.
There would be an immediate labor shortage on construction jobs, hotel cleaning, agriculture, and restaurants.
Only One Sensible Approach
The only sensible approach will require cooperation from Democrats.
Republicans might be able to get funding issues passed with perfect cooperation from Republicans, but that would not fix legal challenges to “Remain in Mexico”. Nor does it fix Blue State Resistance.
Ending birthright citizenship is not going to happen so it would be stupid to waste any political energy on the idea.
Path to a Deal
The way to a deal involves giving legal status for dreamers and mixed families in return for more funding for a wall, more judges, and ICE agents.
Throw in some additional funds for cooperation for cooperation from cities and states and you will have a solid deal.
Republicans could ram through some funding issues, but not remain in Mexico because it is a non-budget item subject to filibuster.
Deport them all would lead to legal challenges and blue state resistance. It would also increase the costs.
Also, Trump could easily lose four Senators if he were to opt for the economically foolish deport them all scheme.
Finally, there is overwhelming public support for getting rid of the criminals.
What’s a Good Deal?

Florida Congresswoman Maria Salazar, a Republican, has some great ideas.
Her “Dignity Act” would allocate $35 billion in funding to enhance and improve infrastructure and technology between and at ports of entry. It also reforms the U.S. asylum system to make a final determination of asylum eligibility for most asylum seekers at the border within 60 days.
Start there, seal the border, reinstitute remain in Mexico, and move on.
As long as the sanctuary cities and states understand the only agenda is deportation of criminals, most of the mayors and governors will go along.

Why is everyone calling them illegals? They were let in and released with an asylum hearing date many years in the future. They were givin permission to work, free housing, medical care, cash assistance, etc.

As an insolvent, majority Hispanic nation, the future is bleak.
These people are here to stay and the USA is finished. They are non-western and will vote in socialism. They do not have the habits, culture and Anglo stamp that created the success this country has known. Americans innovate, China and India copy us. The Europeans regulate. But if you replace the majority of the population with non-western people you wind up in a hellhole nation.
My answer is to move to Europe within 2 years. All of the continent is turning right. Hard right. They will not hesitate to stop the replacement underway there. They have experience with beating back the barbarian invaders. They will do it one more time.

That way they can’t undercut US workers with cheap labour and will only employ such guest workers for genuine labour shortages.

The only way to stop massive immigration (legal or illegal) is by implementing a depression with high levels of unemployment (in excess of 10%). Given the ramshackle structure of USA’s government and private financing, that’s certainly possible. You tell me if the cure if worse than the disease.

While I agree that they ALL need to go, we can’t exactly allow 30 million illegals in our country to be begging for food along our highways. But there are other ways to accomplish the same thing.
For starters, instead of EBT cards, require them to show up at soup kitchens for their food. Cheaper for us, much more inconvenient for them.
Second, no free housing other than mass shelters. Again, cheaper than housing them in public housing or hotel rooms. A huge disincentive for them.

Texas is the only state that keeps records of immigration status when someone interacts with the justice system (ie, gets arrested). CATO studied that (you can read it here: https://www.cato.org/policy-analysis/illegal-immigrant-murderers-texas-2013-2022) and found:

And yet there are an estimated 1000 Al Qaeda members in the US. And it was hilarious for the first 3 years, NOBODY wanted to point the finger at illegals for causing some of the increase in inflation. Fortunately, that seems to have changed about six months ago, when various SMEs started talking about how this was a real issue within inflation, especially in terms of housing / rent.
This is F-ing ridiculous. People can enter illegally, but then you can’t get rid of them? Meanwhile people who want to immigrate legally have to wait years to enter? The legal system is fundamentally broken; Burn it to the ground and restart with The Constitution as the only law of the land.
When the constitution was written, anyone could show up in the United States and stay forever anytime they wanted.
So, current law is actually a lot more restrictive. Might want to consider that before getting rid of all immigration law.

Unfortunately, on the Internet, everyone thinks they are a constitutional attorney, immigration legislator, trained economist, etc.
Most of these ‘stances’ can easily be debunked with a simple Google search, but a lot of people don’t want to do that because they are lazy or the actual results don’t match their political POV.
Case in point here, where the solution to your response is just to add a new amendment to the Constitution. Easy, peasy!
Illegal immigrants are not here legally, therefore they have no rights, period! They are invaders, not guests! The second an immigration court determines they are illegal, they should be deported on the spot! That’s not what happens now!
This makes sense. Once everyone gets their court date and is found to be in violation of the immigration laws, they should leave or be forced to leave.
But the cost of this is what Mish has been writing about. You do realize federal immigration courts are located throughout the US? So at every such hearing, ICE agents with vans/planes will have to be at the ready in case that person is found to be deportable. Then load them up, arrange crossing/landing permission at the origin of country on the fly, and send them packing home.
It is theoretically possible and certainly what many people want. But please do not complain later about your purchase costs (due to labor shortages) or taxes (due to massive ICE spending increases) when they go up. You gotta pay to play (or to have a legitimate opinion). Otherwise, stew in your own basement quietly

Don’t worry, I won’t. The cost of shelter and food would immediately drop, and inflation would likely fall. Throwing out 2 to 3 million *illegal* immigrants who are consuming more government fiscal resources and services than they contribute is just what the doctor ordered. A return to fairer elections is just a bonus.
From what I’ve read, there are at least 2.5M illegals who’ve committed crimes or have deportation orders. That’s a lot of illegals to go after year one.
#1 – At least for a year or more, this isn’t an issue given the number mentioned above.
#2 – On day-one, Brandon ice’d ICE into desk jobs. Well, on Trump’s day-one this will be reversed. Like I said the other day, securing the border went from $30-40B in 2017 to at least $200-300B today. I would expect Trump to ask for at least $100B in this FY. Some of that will go to hire more ICE agents.
I fully expect Trump under his national emergency to enlist NG troops to perform logistics like fly planes, provide security on guard bases, etc. It’s called a national emergency for a reason and under those circumstances the use of NG troops inside the US becomes very expansive.
#3 – I fully expect Homan to ask the DOJ to bring charges against Dem mayors who break federal immigration law. How quickly this happens and how it plays out is hard to say, but this much is for sure. Today, in terms of the sheer numbers of illegals and the extent to which Brandon / Mayorkas have abdicated their constitutional duties is unlike any time in US history. This is a major part of this “mandate” everyone believes Trump was given in terms of immigration.
#4 – I’m not an expert in this area, but I’m sure Trump’s people will find work arounds.
#5 – Deporting anyone here illegally isn’t against the constitution. I’m sure Trump’s DOJ will seek some sort of setting aside of the asylum claim / requirement based on how egregiously easy the Brandon administration has made seeking asylum in the US. Now doubt however, the legal challenges will be many and a difficult hill to climb.
#3 is only one I’d say is likely to happen based on 1st 4 years.
With regard to #5, it’s true that it’s not illegal to deport people who did not legally enter the US.
The catch is that you can’t do that until you follow immigration law and give them their day in court to prove (or not) that they have legitimate refugee status under various laws granting such status to various groups.
So you could try to change the law, which takes quite a bit of time, or you can hire/train a LOT more ICE officers and judges, like Mish points out. That also takes a lot of time (my guess would be at least half of Trump’s 4 year term if not all of it) and would be really, really expensive – assuming you could find people to hire in the first place. There are an awful lot of unfilled police officer jobs out there already, I’m not sure the pool of law enforcement talent is deep enough.
The quickest and most effective way to get people to leave would be to enforce e-verify really strictly. But the business peeps would throw a fit, which is why we’ve never done it.

Most American’s want Trump to stop funding the Ukraine war, keep us out of future conflicts, support Israel, and continue the Abraham Accords to bring more Arab nations into peaceful, normalized relations with Israel.
Most American’s want Trump to push back on China, even if that means using smart / targeted tariffs. This also includes onshoring manufacturing back to the US, especially in strategic goods.
Most American’s want Trump to find ways to reduce inflation which means cutting government spending, again in smart ways.
