As expected, the Biden administration does not give a damn about Supreme Court rulings, the Constitution, or strong legal arguments.

It’s an outrage that lawsuits brought on by Republican elected officials have blocked critical student debt relief that would have been a lifeline for more than 40 million Americans—nearly 90 percent of whom make less than $75,000 a year.
“President Biden, Vice President Harris, and I will never stop fighting for borrowers, which is why we are using every tool available to provide them with needed relief. Earlier today, the Department of Education initiated a regulatory process to provide debt relief, so we can help the working- and middle-class borrowers who need it most.
“Additionally, today the Department finalized our new income driven repayment plan, Saving on A Valuable Education (SAVE), which will be the most affordable repayment plan in history. Outrage Indeed
The outrage is Biden’s purposeful and clearly unconstitutional rebuff to a clear and clean ruling by the Supreme Court. The court ruled that Biden did not have authority to cancel $400 billion in student debt. The power of the purse belongs to the legislative branch of the government, not the executive branch.
Nonetheless, Biden will cut to zero the minimum debt repayment for millions to zero, effectively cancelling their debt. Everyone else gets a 12-month ramp and a repayment program that will save borrowers at least $1,000 per year.
Additional Details
- The most borrowers must pay toward their undergraduate loans is 5% of their discretionary income, down from 10%.
- No borrower making less than 225% of the federal poverty level will have to make a monthly payment.
- Loan balances will be forgiven after 10 years of payments — instead of 20 years — if the original loan balance was $12,000 or less.
- Borrowers won’t be charged with unpaid monthly interest, so balances won’t grow if they make their payments — even if that monthly payment is $0 because their income is low.

President Biden has no constitutional authority for these action. Even Nancy Pelosi understood that.
Flaunting the Supreme Court
Perhaps you think student debt should be cancelled. I strongly disagree. But that is not the point. The point is, as Nancy Pelosi understood: “People think that the President of the United States has the power for debt forgiveness. But he does not have that power.“
The Supreme Court quoted Pelosi in its ruling.
You may believe in student debt cancellation, but you should not believe nor want presidents taking matters into their own hands with powers they do not have. Both Trump and Biden have taken such actions, but Biden far more often than Trump.
Since when do presidents get to spend $400 billion without any such law being passed by Congress? Try never, as it should be.
This effort by Biden, to the tune of $400 billion, was clearly unconstitutional.
But here we go again. If you did not understand before, you should understand now. President Biden cares far more about buying votes than he does the Constitution, flaunting the Supreme Court along the way.

In general, politicians like to buy votes, but never in history have we seen a president challenge a Supreme Court decision so quickly and forcefully starting with a statement from Biden’s Secretary of Education.
The court is a public body. There will be another lawsuit. What would an appropriate response be from the courts.
In case you did not notice, Biden is doing as much as humanly possible to stoke inflation.

The Democratic and Universal Monetary Assistance for Stupid Students act.
Otherwise known as the DUMASS act.
The Higher Education Relief Opportunities for Students Act (passed in 2003 and signed by George W. Bush), known as the HEROES Act, states explicitly that the secretary of education may “waive or modify any statutory or regulatory provision” to help loan recipients affected by “a war or other military operation or national emergency.”
So it would seem on the face of it that the actions of the Biden Administration followed the law. Perhaps Congress should pass a bill stating otherwise if it disagrees.
Education – whether it is University or Trade Schools – should be more accessible in this country with having to mortgage your life to pay for it.
More support for Public Universities in the U.S. would more sense.

Can you really buy votes if you give people the money before the election? There’s no incentive for them to vote anymore. You have to promise them money. And the flipside is this type of action angers more than half the electorate, and angry people vote. This is piss poor politics.

Assuming that the Student Loan laws don’t allow the President or the executive branch to change the terms of the loans (I really haven’t heard this discussed) then I would agree with the Supreme Court ruling on student loans. However perhaps Biden should just declare a national emergency and divert funding to pay for the student loans. This apparently would be constitutional since Trump did that to build his wall. I didn’t agree with that Supreme Court decision.
What everyone is forgetting is that the lack of compromise in politics is causing many issues to go unaddressed. The executive branch (President) is issuing many executive orders that seem to be contrary to laws and the constitution. This occurred under Trump also.
Our presidential democracy is one of the worst types of government when there is no cooperation between parties. A parliamentary democracy would work better (although perhaps not well) in these situations.
There has ever and always been one good way to get out of unpayable debt: bankruptcy. Student loans are the only debts that are barred from discharge in bankruptcy.

The debt payments go to zero but the balance still remains unpaid so your negative equity will be a big drag in getting car and house loans. And since it is a decree by Biden it can be blocked or annulled unpredictably. Makes it hard to plan for the future.
There is no solution for past student loans. Future students should avoid above all the expensive private schools who no longer give the value for money and go to state schools which still do.

I believe Biden only canceled the government loans. He did not cancel the private loans since neither he NOR congress have that power.
That’s why one of the lawsuits that was from the 2 people (not the 2nd one from multiple states) was thrown out. Those 2 clearly had private loans and would not benefit from this jubilee while continuing to be punished by their own loans.
The government should EXIT the student loan business entirely and make it all private loans. Then either college costs would drop dramatically (as they should) or no one would go to college.
I don’t know how long it will take for this to get back to the Supreme Court. But, the Biden Administration is definitely flaunting the Supreme Court Decision as the Department of Education Principal Deputy General Counsel Reed Rubinstein stated the Heroes Act couldn’t be used to cancel student loan debt. Rubinstein also stated the Higher Education Act of 1965 could not be used to cancel student loan debt. Further, the government is obligated to aggressively collect all debts.
Secretary of Education of Cardona should explain to Congress why he believes plan B isn’t contrary to 31 CFR 901.1(a).

Truly, Biden is usurping Congress when the Education Department’s own counsel states that only Congress has the power to cancel student loan debt, and the Speaker of the House also states only Congress has the power.
I think that the cancellation of student debts could be done only together with a big change: these debts in the future could be cancelled by a personal bankruptcy, like the other usual debts.
The banks should then be more careful to grant loans, and see if the planned studies actually lead to something useful.
This should also force the education system to be less greedy.
Student loans cannot be cancelled by bankruptcy. If they could, then everyone would file for bankruptcy the day they graduate.
The problem in today’s world is that everyone is a sore loser. Absolutely no one seems to accept any decision that doesn’t align with their own point of view on the subject.

It’s not “that simple”. The Federal government set up social security to provide benefits, originally, to those who exceeded their death age. Today, since many people live far longer and Congress has not adjusted the benefit age, many more people are receiving the benefit. The fact that this is contributing to bankrupting the country doesn’t make one a socialist for claiming a benefit Congress created and forced one to pay in to. The fact that Congress was irresponsible and spent all the cash decades ago to fund their various projects shouldn’t be directly on the shoulders of the average person who is now drawing the benefit they were promised. Student loans are a different beast. Congress never promised that student loans would be affordable. Taking student loans is voluntary. No one was “forced” to take student loans. The student isn’t out money via taxation and only now claiming the benefit of education funding. The situations are quite different. Bringing health care into the equation doesn’t help matters. Americans have been conditioned to look to the government for all manners of fiscal benefit, to their detriment. Congress promised relief (via benefit) but never looks at the cost side of the equation, and in doing so, alters the economic scales to the long term detriment of the country’s fiscal health.

Congress has to give them, but in this case Biden did this without congress in an attempt to directly buy votes. Once the government begins that, you end up on the road of moral hazard and hyperinflation. Countries like the UK have tuition fees, and those with ‘free’ college only allow a narrow subset to attend.

Nothing in the US Constitution grants power to federal government to be involved with student loans plus health insurance, flood insurance, providing food, providing shelter and much more. If I’m a SCOTUS Justice, my input is federal student loan program is unconstitutional and must be disbanded.

The evidence is mounting to the point that even the mass media are now asking questions about the president’s dealings with other countries. Public opinion has turned. The impeachment of Trump over Ukraine is being recognized as a president doing what the US Department of State and Dept of Justice did NOT do because of political bias.
While it is unlikely that a US President will be charged as a traitor, Biden will forever be known as the president of graft and corruption.

Really the men who wrote the Constitution saw the world far differently from the popular vision today. Think about it. Women did not vote. Blacks did not vote. How many others did not vote? What were the qualities of those who could vote? Why was it like this? Mob rule was not the intent of those who formed the Republic.
I’m so glad we’ve returned the adults to the room to defend our institutions and system of government.

While some people talk about fairness etc, this is far more important than student debt, or boomers. It is about structural change which bodes very poorly for the future of the USA.

One has to earn a diploma. It is not something everyone deserves as a participation prize, Zardoz. Not everyone deserves to be a doctor, just because other people are doctors. Not everyone deserves to be an engineer, just because others are engineers.
The people demanding Biden cancel their student loans are as much about ‘me’ as the people you are referring to.
These 20 million or so deadbeats demand that the other 330 million be responsible for personal loans that the deadbeats took. Who are the selfish ones?
It’s not the slightest bit fair, nor is it fair to you that your kids now vie against foreign college grads who had their education provided by their governments.
It’s even less fair for the 60% of students that pay for themselves and now have to price their loans into their wages while no other OECD country does.
In the big , competitive globalist picture, college in the U.S. is a far greater obstacle than any other developed nation, long term this means s.t.e.m. will grow slower for us than other countries.
No, It’s not fair to you, nor is it fair to the students who pay for themselves.
However – China, India, Europe don’t care, their grads are happy to take our place.

And then we have the fairness of the H-1B & 2 visas to contend with.
Apple, MS, Google, FB, et al take huge advantage here. The whole program should be mothballed over the next 5 years with a real education program to get existing & future college grads ready to take over these jobs.
Visas are another issue. But you should know that visas are not needed to hire people to work in America while living at home in India and elsewhere. Companies are going to pay as little as possible. By paying Indian, living in India to do customer service, sales, software development, research etc, they save 80 percent or more of what they would pay to get the same work done in the USA.
I was in India last week and meet people who are working for huge American companies from their homes. They are highly paid by Indian standards, but that means $1300 @month.
Agree, the H1-B program has been abused to the benefit of C-suite bonuses at the expense of regular Americans.
Global trade overall has hurt the average American while benefitting exec’s and shareholders, unfortunately that bell can’t be unrung.
Menial labor always goes to the cheapest workers, leaving us with education, and we’re the only country that doesn’t offer it…tuition has to be factored into wages here..

Almost everyone in the USA expects someone else to pay the national debt and will refuse to pay their share when due. That means default and the end of the USD.
You think paying $100,000 each on the national debt is bad, wait until the USD is worthless. THAT will be painful.
The USD is near worthlessness already to those of us born in the 1940s and grew up in a lovely home in a beautiful area with a gigantic lot in Southern California that cost less than $10,000. When one man working for a $8000 / year salary was supporting 4 children and a wife who remained home to love and support the children. They have so devalued the USD it is hard to fathom for us who remember.
