Reuters reports Fed Governor Cook declared her Atlanta property as “vacation home,” documents show

A loan estimate for an Atlanta home purchased by Lisa Cook, the Federal Reserve governor accused of mortgage fraud by the Trump administration, shows that Cook had declared the property as a “vacation home,” according to a document reviewed by Reuters.

The document, dated May 28, 2021, was issued to Cook by her credit union in the weeks before she completed the purchase and shows that she had told the lender that the Atlanta property wouldn’t be her primary residence. The document appears to counter other documentation that Cook’s critics have cited in support of their claims that she committed mortgage fraud by reporting two different homes as her primary residence, two independent real-estate experts said.

Administration officials led by Bill Pulte, director of the Federal Housing Finance Agency, have used mortgage documents from her Atlanta and Michigan properties to accuse Cook of claiming both as her “primary residence.” The allegedly false claims of residence, which could improve mortgage and tax implications for a homeowner, led Pulte to refer the matter to the Department of Justice, prompting a federal investigation and an order by President Donald Trump to dismiss her.

The documents cited by Pulte include standardized federal mortgage paperwork which stipulates that each loan obtained by Cook for the Atlanta and Michigan properties is meant for a “primary residence.” But documentation reviewed by Reuters for the Atlanta home, filed with a court in Georgia’s Fulton County, clearly says the stipulation exists “unless Lender otherwise agrees in writing.” The loan estimate, a document prepared by the credit union, states “Property Use: Vacation Home.”

The document appears to help Cook’s case, said two real-estate experts who aren’t involved in representing her. That’s because it indicates that during the loan-application process, she told the lender she intended to use the property as a vacation home.

In another point that could help Cook’s case, she never requested a tax exemption for the Georgia home as a primary residence, according to property records and a Fulton County tax official.

A separate document reviewed by Reuters, related to a federal form completed by Cook as she obtained security clearance for her role at the Federal Reserve, shows that in December 2021 she also declared the Atlanta property as a “2nd home.” Though unrelated to the mortgage, the declaration on that document, a supplement to a U.S. government national security form known as SF-86, is consistent with the claim on her Atlanta loan summary.

Last week, Reuters reported that Pulte’s own father and stepmother had declared two homes in two different states as their primary residence, prompting a town in Michigan to remove a tax exemption for their home there and charge the couple for back taxes. Pulte and his parents didn’t respond to requests for comment about the matter.

Everyone is missing a key point. Cook had weak credentials, poor academic scholarship and was a DEI appointee. Those are grounds for replacement too.

I personally know of 10,001 people that inflated the FMV of their real estate of a signed personal financial statement to many banks

What I don’t get is that even if Trump’s allegations eventually turn out to be true, how can he be legally allowed to fire her immediately (as he is trying to do) when not only has she not been convicted of anything yet, but it’s obvious that the investigation into the allegations isn’t even complete.

Also, firing for cause involves something you did while employed by the entity doing the firing. She wasn’t confirmed and wasn’t on the job when she filled out these mortgage documents. Imagine being fired several years into your job for a DUI that was discovered from 10 years prior to your hire date.

some morons are citing an NBC report that Cook had paperwork that the second mortgage was a “vacation home.” That was PRELIMINARY paperwork with ZERO legal standing. It showed the higher mortgage rate for a second home (which she rejected) and then signed the actual legally binding UNDER PENALTY OF PERJURY with the lower rate locked in – that’s absolute proof of fraud.

Probably, but maybe not. It depends on whether she actually resides in the Atlanta house at least part of the year or whether it was rented out. In other words, strictly an investment. Starting in 2023 second home mortgage pricing became roughly equivalent to loans for investment property. In 2021 when she got the loan, pricing on loans for 2nd homes was much better than for investment properties. If she used the Atlanta property herself – even a little bit – then she didn’t commit fraud. If she leased it out from the jump, then she did. 95% chance apology owed.

In any case, Trump should quit the crap and Pulte’s family should be investigated.

Homestead status doesn’t tell how a property is being used. In some locales a property can be homesteaded if it’s being rented to a family member of the owner. If the owner bought the property using financing for a second home while intending to immediately rent it out on a long-term basis, that would be fraudulent – even if the tenant were a relative. Fannie Mae has special exceptions when buying a home for a low-income elderly parent or handicapped child, but then the loan gets owner-occupied pricing. If Ms Cook applied for financing for a second home and used the property herself at least some small portion of the year, then she did nothing wrong.

You’re obviously not a real estate attorney or a journalist, so why so much confidence (hubris)?

Of course, the DOJ will eventually have the final legal documents she signed, including (according to this research) how Cook applied for the actual loan she took out. If she told the lender the loan was not for a primary residence, how (in your expert legal opinion) is she guilty of anything?

It’s easier to charge someone of a crime (especially for political reasons) than it is to prove it. This article is giving some context – and actual expert opinion – for why the legal case will likely be dropped or dismissed later.

Don’t like it? No problem. But please spare the rest of us your politically-driven hubris about why Reuter’s article experts are wrong and you know better.

Trump’s case in NY has already been adjudicated within a court of law after him and his businesses were charged (which is as far as it’s gone against Cook at this point). Evidence from both sides was presented, expert testimony was requested and heard, (none of which as happened yet in the Cook matter) and a legal liability claim against Trump was found and ordered as a judgment.

See the difference? If not, Judge Judy is free to watch online or on TV for how the legal system works

And yet, Trump has already had two bites at the legal apple (currently Cook has had zero because she’s not had her own day in court yet – only in Trump’s court of opinion). And the appeals court reduced the size of the fine against Trump, but did NOT rule the original judgment was in error.

Why can’t you compare these two on an apples-to-apples basis? It’s not that difficult. Why is everything Trump right with you, instead of looking at his actual individual actions (like not seeking yet similar mortgage fraud claims against Pulte’s relatives)?

Monetary austerity is not the answer. Monetary abundance that simultneously implements beneficial deflation via a 50% Discount/Rebate policy at retail sale and at the retail point of Finance, that is your loan payment, is the answer.

The current FED charter re-inforces the monopoly paradigm of Finance AKA Debt ONLY and hence that charter is the problem. Enabling The FED to fund the above and other aligned policies resolves the problematic effects of the current monopoly.

Can someone please highlight the loan rates for the loan estimate & the final loan application?

I mean it is possible that the first “loan estimate” was not what she wanted, so she changed her mind, intentionally maybe, in order to secure a better rate.

Per Mortgage News Daily, the 30YFRM rate on May 20th was 3.16%. On June 22, it had climbed to 3.26%. Not a huge difference but maybe just enough to convince you to go with the Primary residence designation to secure a favorable, locked in rate?

I mean these are all the things that will come out in court, if it comes to that.

I totally agree this is a shady way to get rid of a Fed governor, but someone please fill in the details here, so we can actually know for sure if she committed mortgage fraud like lots of people do but don’t get caught.

Like seriously, when you get a loan, you have to let the bank know about all of you outstanding debt. How hard would it be to allow every bank see how you filed your previous home mortgages? If you go to apply for a new loan, then the bank can immediately see where you’ve already declared another home your primary residence. And if you haven’t removed your homestead exemption related to the primary residence, then you’re SOL on getting a new loan as a primary residence.

I mean we do have computers that talk to each other, right?

Based on my account, if correct, this wasn’t a mistake. You don’t go from claiming it’s a 2nd home on paperwork that generates a mortgage estimate to saying it’s a primary residence a few weeks later.

There’s a difference here, Bob. No reading the contract is different from changing material information that you yourself have to provide.

I agree with you; I doubt her lawyers will use the non-reading defense either. BUT I doubt they will need to.

Most loan documents (that are standardized for federal MBS) have such standard boiler-plate language, but are legally based upon the actual (varying) documents signed at a local bank or credit union extending the loan. So no harm locally, probably no foul federally.

But it doesn’t affect me directly. If she’s guilty of mortgage fraud, prove it in court and THEN hold her accountable. I’m in favor of that.

But you’re purposely avoiding the main point here (as you often do for political POV reasons). Cook has not been convicted of anything illegal at this point, but Trump’s administration has accused her of such. Will Pulte and Trump’s DOJ also accuse and put up for prosecution Pulte’s family members since they did the same (if anything, the local government there has already found them explicitly liable as they removed the tax exemption).

Yoh put words in my mouth. I never said she is guilty. I just responded that you can’t use hadn’t read the contract as a defence. Let the court decide but I would like the court to address it very soon.

Where did I say you thought she was guilty? I said you’re purposely not commenting on the main point of why/whether Pulte’s family members should be held to the same standard by Trump’s DOJ

And BTW, the Court doesn’t care how fast you or others want it addressed; we have a standard of due diligence in this country for determining guilt

“Loan estimate” prepared weeks earlier is not sufficient to claim lender had “agreed in writing”.

A loan estimate is not legally binding. It’s like the difference between a stock price quote at one time vs an executed trade 4 weeks later.

Or alternatively, can you quote the case law that defines “legally binding” for the definition of whether ‘agreed in writing’ applies only to the mortgage document or any other ‘writing’ documents that come from the mortgage creator?

That’s what the courts will sort out. You don’t know, Mish doesn’t know, and I don’t know.

My point is that since none of us knows, she’s not in the clear, because she did legally sign documents claiming primary residence in 2 locations concurrently.

It’s so amusing watching everyone read their own biases into random tidbits of non-relevant information.

If this sort of thing brings down Pulte too, so much the better.

Remember back in the 1980s and 1990s when people with political ambitions would get busted for failing to pay the Social Security tax for their domestic employees (nannies, etc.)?

This is the same sort of corrupt venality, but on a larger scale.

People step down or are let go from positions all the time for reasons that are considered unacceptable, unethical or moral hazard which won’t land them in jail.

As I’ve said above, I’m not a fan of using this kind of leverage to get her out the door.

BUUUUUT,

If she did willfully commit mortgage fraud, then that’s more than enough to say she’s not fit to serve as a Fed governor.

And like I asked above, if my account is accurate, it sounds like she changed her mind on the status of the home.

That’s not a simple mistake like putting the wrong year on a check like we all do occasionally in the first few days of a new year.

Anyone who purchased a house with a mortgage knows that everyone reads the first page of stack and then moves to multiple “sign here”.
The first page has the money amounts. And they either ‘look’ right or they don’t.
Also the person conducting the closing is trying to rush through the process because they have another one scheduled soon.

What I’ve laid out a possibly, if not VERY likely is that she willfully changed the status of the home in the final mortgage application.

She provided the information to get the loan estimate and did the same thing to get the mortgage. Unfortunately for her, it appears she MAY have been caught executing mortgage fraud.

This wasn’t a lazy, I don’t want to ready the contract mistake.

This was: I changed my mind on how I want to claim the home.

The contract was generated from her statements / inputs, be them on-line or to a person.

The people who “read the first page of stack and then just “sign here” are the same types who lost their asses in 2008-2010.

Any house buyer NOT reading the details of their mortgage paperwork didn’t learn a critical lesson from the Great Recession.

The only person who has their ass on the line in buying a house is the buyer. Everyone else is just doing a job, and humans aren’t perfect. But the buyer is putting their life savings on the line.

At any given time, some of the realtors, lenders, and mortgage brokers are going to be scammers. A lot of people got scammed out of their life savings between 2007-2010. A lot more are about to lose their life savings in the next 5 years as the second bubble implodes. And some are going to have it a lot worse as they find out, far too late, that their paperwork was done wrong.

But anyone who foolishly trusted the current broken system with their life savings probably deserves the lesson they’re about to learn.

I’m not here to defend Pulte, but it’s funny how you’re so willing to try to pull the sleight of hand, suggesting what she did was OKAY to commit mortgage fraud which is EXACTLY what she did if I correctly stated what happened. Yes, I could be wrong. Time will tell.

Personally, based on what I’ve read to date, I’ll be stunned if this goes to court to be adjudicated on the merits of whether or not she actually committed mortgage fraud.

For now, it’s about wrangling over whether or not Trump has the authority to remove her, not whether she’s actually guilty of the crime.

Why doesn’t someone ask Trump how this works?

I mean, he was already found liable in court earlier this year for him and his business associates knowingly misstating the value of assets on financial documents for loan purposes.

So he knows the financial documents he signs, right, and didn’t care about the legal truth? So why should Cook get fired and not him – since he is literally the chief of the executive branch of the entire US?

If anything, maybe he should invite Cook down to Mar-a-Lago for another insider preference celebration. I mean, Cook’s emulating the President, right, for his approval? Isn’t that what we’re all supposed to do here?

The X/Truth Social ‘news’ cycle doesn’t work that way. Interesting thought experiment as to whether this is a supply or demand issue?

Do pundits like Trump supply this news quickly (without context or research) and people respond accordingly? Or do the sheeple demand this type of immediate political POV BS and Trump (and others) simply accommodate them?

Regardless, I think it shows many Americans are close to moronic (whether on the supply or demand side) of news ‘information’. And it’s sad we can’t educate ourselves or other society members better.
