IRS Postpones a Blizzard of $600 Threshold 1099-K Tax Forms In 2023

The Internal Revenue Service on Friday gave millions of Americans a one-year reprieve on new tax-reporting requirements, delaying implementation of a law that requires e-commerce platforms such as eBay, Etsy and Airbnb to give the tax agency information on users with more than $600 in revenue.

Congress passed the $600 threshold for Form 1099-K reports as part of the American Rescue Plan Act in March 2021, scheduling it to take effect for tax year 2022. Until the change, platforms had to report users’ income to the IRS if they had more than 200 transactions and $20,000 of revenue. Lawmakers lowered the threshold to boost tax compliance in an area where it is often lacking—unreported business income.

The $600 threshold would affect many gig workers who are independent contractors and haven’t been reporting income on their tax returns. Paying taxes on those earnings could come as a jolt.

The issues are different for many sellers on eBay and similar platforms, especially “casual” resellers cleaning out closets and attics. The gross revenue on the form isn’t necessarily all income. Such vendors may not owe any tax if they are selling items for less than they paid—or, when it comes to selling inherited items, less than the item’s value on the date of death.

Two Cases 

There are two cases here. The first is someone who makes a living with repeat transactions and the second is the average person cleaning out their closet.

The real reason for the delay, however, is the IRS is not at all prepared to handle potentially tens of millions millions of 1099-K forms.

In addition, taxpayers would have to keep receipts of everything. Lawmakers tried to address the issues but could not reach agreement. 

Not wanting a blizzard of 1099-K forms, the IRS postponed the requirement.

There was no legal requirement for Trump to disclose his taxes. He promised to do so, clearly a lie, but except under oath lies are not a crime. 

If lying was a crime, all politicians would be in jail. 

If there is fraud or errors it is up to the IRS and the State of New York to investigate, not Congress for political purposes.

I received a 1099 last year from ebay for a few graphics cards that I sold. It was a difficult and complex tax form that I needed to fill out that assumed I was a business with wages cost of goods sold ect. This was just old stuff I’d had kicking around for years. They said they were going after Billionairs so it wasn’t a surprise when actually they came after me.

Who did we need rescuing from? Fauci was funding Gain of Function research in China. Not proven, but highly likely that Covid-19 was created in a lab, not by nature. Fauci continues self serving Gaslight, that the origin was only natural.
Covid-19 was treatable with existing antiviral drugs. We didn’t need a rescue plan. As Drs. Fareed and Tyson could protect their Covid patients, any Dr. could have, if allowed to by Fauci and company in the public health agencies.
Nor should the economy have ever been shut down. There were a number of scientists that knew that. It is the people in the agencies who are supposed to be protecting us, that created this mess that they claim to be saving us from.
Rather ironic that Congresses idea of an American Rescue Plan, is raising taxes, instead of an investigation into the corruption surrounding the public agencies Covid-19 response.

Trump’s tax situation and gross abuse of power by the Pelosi Congress are clearly revealed in “…The IRS audits of Donald Trump’s tax returns were at times unusually deferential to his tax advisers, according to a nonpartisan report from congressional tax specialists….”
What, exactly does ‘unusually deferential’ mean? Does it mean that usually, the IRS is not deferential; meaning it is rude, antagonistic, uninformed about the tax code, and generally ineffective if not outright incompetent? MY experience is a resounding YES!
My one IRS ‘audit’ had to do with deducting Foreign Tax Credits for Alternative Minimum Tax. Having read the appropriate legal/IRS materials, and generally having a low opinion of tax accountants, I filed my return, including an explanation/interpretation of the very poorly written (ambiguous) AMT-FTC rules. Upon being notified of the negative outcome, I finally reached the IRS-AMT department. They were unable to clarify. Not that IRS policy prevented them from doing so, they didn’t understand the law/rules. I pursued this all the way to the AMT department lawyer–his response was ‘…well, I don’t understand it. You will need to hire a tax attorney.’ Around this time, my bank accounts were seized. Seriously!
One a positive note, my letter to the IRS did get attention after I advised I would by filing a claim against the IRS in Tax Court. My letter (outlining names, times, discussions etc) was directed to the IRS ombudsperson. Now, she worked from her home from 6 am to 10am, for a few days each week, so it was difficult to communicate. However, after we had talked on the phone, three days later I received a full refund.
Deferential… I suspect Trump’s tax advisers knew the law/rules far better than the people working for the IRS.

So I’m trying to understand whether it’s transaction or total. I renovate houses and pay my main contractor, my painter, my sheetrock guys, my plumber, electrician, … Most individual bills are under $600 because I keep them current … but totals certainly go way over that. This is going to be a bit of a nightmare for folks who try to keep their nose clean from either side of the transaction.

It’s $600 total for the year.
But this announcement has to do with 1099-K forms. You give 1099-NEC to your subs and those rules stayed the same at $600 as they have been for many decades. (Although you used 1099-Misc forms until a few years ago before 1099-NEC were created. )

You misunderstand the purpose. The purpose is to be able to dirty anyone’s nose whenever the IRS feels like it. Selective enforcement allows tax laws to be used to keep specific people in line. Remember, everybody’s done something illegal in their past.

that’s about the best news coming out of DC in forever. us peasants love the crumbs. i personally wouldn’t care, but i was already advising my maids and 20 something folks who zelle each other for meals……..and offering to help them file their tax returns…………..i’m decades out of tax accounting business and only trade, but always help the simple small folks learn how the game is played. there are 2 tax codes. one for employees, who pay all the taxes. and one for owners, where the majority of tax code and regs is written with all the freebies and credits and proper and lawful deductions. i’m glad i read the rules to the game of life as a young man. i’m always shocked how many did not, or go through life impervious to the rules of our game.

This sort of ignores the fact that the top 1% pay 38% of the federal taxes and the top 10% pay 70% of the federal taxes … and bottom 47% pay none. So there clearly are some bennies to not being the big earners.

I’m still angry that I was disallowed deducting 3 piece suits as necessary work uniforms.
I have never desired to wear such a suit, not even for weddings and funerals.

How about doing something simple and that makes sense. Just have a national sales tax and eliminate income taxes. I think Herman Cain was a proponent of this. Our tax laws are basically a full employment act for tax accountants.

The 1099-k idea is a total disaster. There is absolutely no instructions on how to account for it, just that you do in fact have to account for it on your taxes or the IRS will treat the entire amount as income. If you cleared out you closet on ebay and lost money what forms do you use? This is the opposite of going after fat cats not paying their fair share. They wonder why Joe sixpack are not democrats?

“Flagged for moderation” is a black hole that pops open often without cause. I don;t think you are being singled out for saying the wrong thing. It would be nice to know what the ‘trigger’ rules are. I think one rule may be editing a comment ‘too much’ within the 5 minute window.

Whatever illegal and stupid things they do to “get Trump”, they are creating a legal precedent. It won’t stop at just Trump. No matter how bad one suffers from Trump Derangement Syndrome, once the legal precedent is set it applies to all ex Presidents.
We all know the raid on Trump’s home was both illegal and stupid. A first year attorney can get everything thrown out with their eyes closed — and Merrick Garland should know this. Like every President, Trump didn’t pack up his stuff from the White House; staffers and the Secret Service “stole” whatever documents and transported them to Marlago. DUH! Trumps nuclear launch codes were changed the instant he left office, they can be published on the front page of the NYTimes and it doesn’t matter. Whatever other classified stuff was supposedly there, it clearly wasn’t that important or they wouldn’t have waited 18 months to recover it. It obviously wasn’t that important. And whatever it was, it was under Secret Service protection.
Garland isn’t qualified to practice law if he doesn’t know all of this. The raid was clearly just a pretense to steal Trump’s tax returns. Again, before anyone starts foaming at the mouth about “getting Trump” at all costs — you are creating a legal precedent that applies to all Presidents and for that matter everyone else. Be careful what you wish for.
Biden’s brain is dementia mush. If he had any brain activity left, he would fire Merrick Garland on the spot. What are the odds Biden’s home will get raided looking for (more) evidence of his taking bribes from foreign powers? Thanks to himself and his corrupt Attorney General, Biden will just have to accept weekly raids. And his drug addict son too. Legal precedent was set.
Merrick Garland’s home will get raided too. He’s not even an ex President, he has no rights at all. The man tried to lead an insurrection against parents concerned about their own children. Raid his house now!!
The potential for abuse is unlimited. Any competent attorney should have seen this from the outset.

Trump tax returns are the 100th thing that was supposed to land him in jail. So when will Trump actually be charged with a crime?
I guess this is the new student loan repayment. They’ll just keep pushing it back until it doesn’t hurt them in elections.

Any first year law student can see the material collected from the Maralago raid can be used publicly to embarrass Trump (tax returns being the example here), but none of it would be admissible in a court of law (during a trial, not in discovery). Every bit is easily thrown out, with loads of legal precedent why. Merrick Garland knew this the moment he approved the raid. It was always about politics not law.
Once the legal precedent is set, it applies to all Presidents — not just Trump. And it applies to everyone else too.
