US President Donald Trump said Wednesday he planned to detain “criminal illegal aliens” at the notorious Guantanamo Bay military prison, used for holding terrorism suspects since the 9/11 attacks.

Trump made the shock announcement as he signed a bill allowing the pre-trial detention of undocumented migrants charged with theft and violent crime — named after a US student killed by a Venezuelan immigrant.

He said he was signing an executive order instructing the Pentagon and the Homeland Security department to “begin preparing the 30,000-person migrant facility at Guantanamo Bay,” Trump said at the White House.

“We have 30,000 beds in Guantanamo to detain the worst criminal illegal aliens threatening the American people. Some of them are so bad we don’t even trust the countries to hold them, because we don’t want them coming back,” Trump said.

The Republican said the move would “double our capacity immediately” to hold illegal migrants, amid a huge crackdown that he has promised at the start of his second term.

Calling Guantanamo a “tough place to get out of,” Trump said the measures announced on Wednesday would “bring us one step closer to eradicating the scourge of migrant crime in our communities once and for all.”

It has been used to indefinitely hold detainees, many of whom were never charged with a crime, seized during the wars in Afghanistan and Iraq and other operations that followed.

At its peak about 800 people were incarcerated at the site on the eastern tip of Cuba. Testimony from detainees documenting their abuse and torture by US security personnel have long prompted domestic and international criticism.

Former Democratic presidents Joe Biden and Barack Obama both pledged to close the facility, but both left office with the prison still open.

Free Torture Too?

Does this executive order come complete with free torture?

Regardless, I fail to see how this action is legal, but legality hardly seems to matter anymore.

We will soon find out on legality because there is sure to be a court challenge to this executive order.

I suspect this EO will be shot down quickly, but we will see what sticks and what doesn’t.

If the courts uphold this action, here’s the upside: Democrats will scramble to cut an immigration deal with Trump, and Trump’s terms will be harder.

This threat, even if it doesn’t stick, will accelerate a movement towards a deal. But does the end justify the means?

Addendum: What About the US Lease?

Somehow it seem to me that holding illegal immigrants has nothing to do with coaling or naval station.

The lease treaty agreed to from February 16–23, 1903 stipulates that the Republic of Cuba lease to the United States specific lands in Cuba, notably the land that surrounds Guantánamo Bay, for the purpose of coaling and naval stations, for as long as necessary.

The Cuban-American Treaty of Relations of 1934 replaced the Cuban–American Treaty of Relations (1903) in which Cuba committed to: not permit a foreign power to obtain a naval base on the island. not go into excessive debt. grant the US the right to intervene in Cuba for the maintenance of (an adequate) government.

Yes, Mish, ratcheting up the use of EOs can be dangerous to us all.

If Trump can now use the military on US soil (without a Congressional declaration of war) to carry out the arrest, detainment or deportation of people, what’s to stop the next Democratic President declaring a national public health emergency and ordering the military to confiscate all F-150s and handguns through an EO?

Where does it stop? Why can’t we have Congress create all new regulations and funding initiatives (even if all of it will currently be Republican-friendly). That’s how the rule of law is supposed to work

I like what Trump is doing on many fronts.

But, America is really starting to look and feel like the Roman Empire just on the verge of going from republic to dictatorship.

The senate increasing full of plutocratic babbling idiots completely indifferent and out of touch with the populace.

A presidential office deciding to, and being led to take increasingly unilateral power and dictatorship JUST TO KEEP THE COUNTRY IN SOME STABILITY.

All while the rationalization for serving the public just because serving oneself and those who back you in office.

How is using an area leased for the specific purpose of a coaling station and naval facility being used as a prison? The only persons that should be there are sailors and marines and the only prisoners sailors in the brig.
Don’t get me wrong, I think most of those 30,000 detainees should be executed if they committed rape, murder, torture etc but if they are sentenced to US prisons then it should be a prison on US soil and if they are wanted in another country then send them there. If it is a risk that they might come back then give each of them a legal warning that they are outlaws in the US (outlaws have no protection under the law and can be shot on site by anyone, including shoot to kill, shoot to cause pain, as target practice, lynch them, crucify them, burn them etc).

If illegal immigration is first and foremost always a military operation (as you say), why do we have both a separate Border Patrol agency and ICE (Immigration and Customs Enforcement)?

Regardless, this is a version of the “first they came for…and I said nothing” saying.

We established long ago, not to extend legal rights to terrorists (15 are still there)…
adding “criminal illegal aliens” to that list now…
perhaps “the enemy from within” is next.

Two important distinctions from a decent article “What has changed with immigration under Trump and what is still playing out?“:

“An 1878 law prohibits military involvement in civilian law enforcement, but Trump and his aides have signaled he may invoke wartime powers. Trump said in his order that the Defense Department can assist with detention and transportation.”

“The Biden administration did not use military planes.”

Fact check.

The executive order was not rescinded. They pulled the memo, which was a directive to the department’s to freeze fund distribution. It was a bit confusing, but not that confusing. The left wing media finally found an issue to gnash their teeth over.

Caroline Levitt made it clear during a press gaggle that the EO had not been rescinded.

Congress is in charge of appropriations. So the funding was rescinded by a bureaucrat’s “memo” instead of an EO? And now the memo is gone so we’re back to the original two-page Presidential EO (which still goes against the enumerated powers of Congress).

This affront to the legality of the appropriation process is still a problem for many of us. If the purpose of the EO is such a good idea, why not have Congress (which is on Trump’s side now) change the funding and appropriations when it next convenes?

With all the space in the US, hard to believe this is the best solution. And I suspect costing the US a lot. My question, why cant we leave Cuba alone? In what world should the US have dominance over all the countries in this hemisphere. Torture? Seems like an awfully big leap.
This decision will be litigated and if found illegal it will be rescinded like the other EO. But if not, what a great idea!

This administration is not afraid to try new things and is not running roughshod over anyone (unlike the last), so just relax and let it play out. In the meantime, Trump is definitely getting his point across regardless.

I don’t think so Mish. We’re literally running the exact same traps from 2016 and it’s looking highly likely dems sweep Congress in ’26 then start impeachment hearings for one or more Trump crimes committed over the next two years.
