White House Deputy Chief of Staff for Policy Stephen Miller said the Trump administration is considering suspending habeas corpus, depending “on whether the courts do the right thing.”
President Donald Trump has argued that the U.S. is being “invaded” by undocumented immigrants and has acted accordingly. In March, the administration invoked the 1798 Alien Enemies Act to justify the due process-free deportations of more than 230 immigrants to El Salvador, where they are being incarcerated without charge. On Friday, Miller suggested that Trump may suspend habeas corpus, which was most famously done during the Civil War.
Miller fielded questions outside the White House, including one from the far-right, conspiracy-peddling site Gateway Pundit.
“President Trump has talked about potentially suspending habeas corpus to take care of the illegal immigration problem,” he said. “When could we see that happen, do you think?”
Miller replied:
Well, the Constitution is clear, and that, of course, is the supreme law of the land, that the privilege of the writ of habeas corpus can be suspended in a time of invasion. So, I would say that’s an option we’re actively looking at.
Look, a lot of it depends on whether the courts do the right thing or not. At the end of the day, Congress passed a body of law, known as the Immigration and Nationality Act, which stripped Article III courts, that’s the judicial branch, of jurisdiction over immigration cases. So, Congress actually passed, it’s called jurisdiction-stripping legislation. It passed a number of laws that say that the Article III courts aren’t even allowed to be involved in immigration cases.
Courts are ultimately the arbiters of what “the right thing” is, per U.S. laws. However, Miller is making clear the administration is prepared to arrogate to itself the right to determine whether court orders are valid or not. Indeed, the U.S. Supreme Court last month upheld a lower court ruling ordering the Trump administration to facilitate the return of Kilmar Abrego Garcia from El Salvador. Trump is currently defying the ruling.
What Is Habeas Corpus?
Habeas Corpus deals with illegal confinement without being charged with any crimes.
The phrase is from the Latin habeās, second person singular present subjunctive active of habēre “to have”, “to hold”; and corpus, accusative singular of corpus “body”.

On April 27, 1861, the right of habeas corpus was unilaterally suspended by President Abraham Lincoln in Maryland during the American Civil War. Lincoln had received word that anti-war Maryland officials intended to destroy the railroad tracks between Annapolis and Philadelphia, which was a vital supply line for the army preparing to fight the South.
Lincoln’s action was rapidly challenged in court and overturned by the U.S. Circuit Court of Appeals in Maryland (led by the Chief Justice of the Supreme Court, Roger B. Taney) in Ex parte Merryman. Chief Justice Taney ruled the suspension unconstitutional, stating that only Congress could suspend habeas corpus.
In January 2007, Attorney General Alberto Gonzales told the Senate Judiciary Committee that in his opinion: “There is no express grant of habeas in the Constitution. There’s a prohibition against taking it away.” He was challenged by Sen. Arlen Specter who asked him to explain how it is possible to prohibit something from being taken away, without first being granted.
The Department of Justice in the George W. Bush administration took the position in litigation that the Military Commissions Act of 2006 does not amount to a suspension of the writ of habeas corpus. The U.S. Court of Appeals for the D.C. Circuit agreed in a 2-1 decision, on February 20, 2007, which the U.S. Supreme Court initially declined to review. The U.S. Supreme Court then reversed its decision to deny review and took up the case in June 2007. In June 2008, the court ruled 5-4 that the act did suspend habeas and found it unconstitutional.

Courts do not grant entry into the country(privilege) so why are they involved with individuals that don’t even have privilege. This is clearly an executive issue to deport them. There is clear guidance within the executive branch set out by congress for review of illegal aliens. The only time the court should be involved is if the executive did not follow their own rules or congress, which are by the way are subject to change by the executive or through legislation.
The real problem is the Supreme Court and Roberts. They are the ones causing the problems. They had the chance to hand down some clear guidance and F’ed it up or did not enforce their decision on the lower court. At this point, I think it is time for Trump to have a heart to heart with Roberts. ‘Stay out of the Executive and get the courts in order or I will come looking around in the court system’ We all know that judges and prosecutors think they are above the law. The fact is Trump is only accountable to the House of Representatives.
By the way – what about all the habeas claims of the people that were guided into capital building. The people that got swatted complaining at school board meetings and Trump himself. If Roberts does not balance the scales of justice, we have no self-balancing government, and this will lead to the inevitable outcome of tyranny and revolt.

Deportations are within the purview of immigration courts that are part of the executive branch under the auspices of the DOJ. The due process required is substantially less than what an American citizen would be entitled to in a federal court.

You are missing the “secret sauce” of the American democratic experiment. That secret sauce is the idea that everyone has universal and unalienable rights. The U.S. Constitution only applies on U.S. soil. Thus, any person on U.S. soil has these unalienable rights, citizen or not. One of these rights is due process under the law. Suppose a person crosses into the U.S. without going through the official process and without the proper paperwork because they claim they are fleeing political persecution, or they are fleeing for fear of death or violence. They have the right under our Constitution to due process to prove their claim in these cases. Before a judgment can be made on whether or not they can stay or be deported.

I disagree. Judge Boasberg demanded that the administration bring Abrego-Garcia back to the US. The Supreme Court changed the wording to say that they have to “facilitate” his return. Salvadoran President Bukele says he’s staying put in prison. If Bukele puts him on a place to the US, then the Administration can’t refuse him, but SCOTUS can’t force a sovereign foreign country to remove a guy from their prison. So, Trump isn’t defying anything.
So El Salvador can push the US around now? Is that your argument because it makes Trump look like a weak impotent fool.

Deportation is NOT an execution. It can be corrected. If an error is made the person has the opportunity to fix it. To demand perfection in the deportation process when the importation process is intentionally broken is insanity. It puts in jeopardy the sovereignty of the country and clearly puts citizens at risk.

He drives around with Local Sheriff near Yuma (I think) and the Sheriff makes some strong points about how things changed rapidly once Trump was IN. He also said that it dried up nearly the day that Trump made noises about closing our southern Borders. It is TRULY remarkable when he interviews a local Hosp. manager and what she says is amazing (I will not spoil it).

Australia where I currently live detained illegals for years in places like Manus Island and Nauru when they tried to enter illegally. My son worked on deportation and transportation flights for a while 10 year back so Trumps deportation flights are nothing new. My other home country of Egypt detains illegals in conditions far worse than 3 hots and a cot. That applies to most countries outside soft cock Western countries, at least Trump has stiffened the borders and shafting illegals back.

Which in no way stops anyone from deporting illegal immigrants after due process. Due process is not there to help people avoid justice. It’s there to avoid innocent people victimized by the government. Without due process, you could be as easily sent away to El Salvador as the illegal immigrant. And how simple was it to just accept, nay encourage, the infiltration? Hand them money, cell phone and some fictional hearing in 10 years. What’s the point of an ID if it doesn’t serve as an ID? I understand not wanting to live in a society where at any moment one can be stopped to “show papers”. At the same time, I have to show papers to get employed, to fly and to claim the right to drive.

I am not a constitutional scholar, but if you read the 14th amendment, a lot of things are open to interpretation. What Trump should do is to support the illegals that he wants to deport, after determining that they are here illegally. He will then be sued. The case will go to the Supreme Court, and they will have to determine if due process was exercised. The constitution does not say that due process means a hearing in court.
a court of law for a hearing which might last half an hour is for sure worth it, versus letting some cop or ice officer, on the beat decide who is legal or illegal.
The problem is immigration courts are months behind due to lack of sufficient judges. Where do we house tens of thousands of people who are awaiting their hearing?
The real solution is to make immigration court service more attractive so the army of underworked US attorneys find it more appealing as a career path versus chasing ambulances… but I don’t see that happening anytime soon.

i imagine it’s hard to get an exact figure, and am fine conceding it’s 3.3 instead of 2.5 or 2.8. it’s still less than 30 million by an order of magnitude.
the 10 million figure nost commonly trotted out by MAGA includes all encounters, which omits that most of those encounters resulted in expulsions (it also ignores deportations, which were ongoing).
to be clear, i think 2.5M is outragerous and agree w Trump closing the border. what i don’t agree with is him wanting to do away with HC or to do away with due process. Also, deporting students because of their protest activity, and more generally harassing tourists and visa holders by encouraging border control to act like a-holes.

I will point out that the data in your link only covers Feb ’21-Oct ’23 so for the entire 4 years the ‘official’ number would be noticeably larger than 2.5 million, but certainly well below 30 million.

As with the detentions during the Obama years vs Trump’s first term, it would appear the similarities are greater than the differences (at least with respect to the rate of removal).
One facet that I haven’t seen spelled out is what portion of illegal crossings that are known to officials (via detentions or observed remotely by camera/sensor) do not end up in detention. In other words, how many individuals cross and are not processed in some manner.

Courts the arbiter of “what the right thing is” … ? The statement is absurd. The courts weigh damages and harms brought before them following laws enacted by legislatures, with an eye toward boundaries as defined by the constitution. SCOTUS is the final arbiter on US Constitutional law. With the caveat that no one, and especially no court, is infallible. One example of the courts overreach is to decide what a so called invasion is. That’s not the court’s jurisdiction. The executive is charged with foreign policy. Period.

Obviously if the POTUS has final say on what’s an invasion and there’s no way for courts or congress to challenge that, and if POTUS can them use an invasion as a reason to suspend constitutional protections, then constitutional protections are literally worthless and there is zero check on the power of the POTUS by the other branches of government.
