Two Associates of FTX Founder SBF Plead Guilty to Criminal Charges

Noose Tightens Around Sam Bankman-Fried

The Rats Rat on SBF

The Wall Street Journal reports Caroline Ellison, Associate of FTX Founder Sam Bankman-Fried, Pleads Guilty to Criminal Charges

Caroline Ellison, the former chief executive of Alameda Research, a trading firm tied to FTX, and Gary Wang, FTX’s former chief technology officer, both pleaded guilty to criminal offenses similar to those Mr. Bankman-Fried was charged with last week.

Ms. Ellison, 28 years old, pleaded guilty to seven counts, including wire fraud and conspiracy to commit securities fraud, according to her plea agreement, which was signed Monday. Mr. Wang, 29, pleaded guilty to four counts, including wire fraud.

The Securities and Exchange Commission and Commodity Futures Trading Commission also sued Ms. Ellison and Mr. Wang, alleging they committed civil securities and commodities fraud. Both agreed to settle the SEC’s and CFTC’s claims and to accept liability, with monetary penalties to be decided in the future, according to the regulators.

The SEC said Ms. Ellison, from 2019 to 2022, manipulated the price of FTT, a digital asset that FTX issued. Ms. Ellison did so at the direction of Mr. Bankman-Fried, according to the SEC. The price manipulation allowed Alameda to inflate the value of FTT that it held and used as collateral for undisclosed loans from FTX customers, the SEC said.

Mr. Bankman-Fried on at least two occasions became worried about the price of FTT dropping and told Ms. Ellison to have Alameda buy FTT, the SEC’s complaint says. Binance, a rival crypto exchange, was also a large holder of FTT tokens; its announcement in November that it would sell its FTT stake caused the price of the token to plummet, although Ms. Ellison had offered publicly to buy Binance’s holdings of FTT at $22 each.

The SEC alleged that FTT is a security, giving the agency authority to oversee how it was traded. FTX’s profits from selling FTT to investors helped fund the exchange’s growth and development, the SEC said.

“Ms. Ellison and Mr. Wang played an active role in a scheme to misuse FTX customer assets to prop up Alameda and to post collateral for margin trading,” SEC Chair Gary Gensler said. “When FTT and the rest of the house of cards collapsed, Mr. Bankman-Fried, Ms. Ellison, and Mr. Wang left investors holding the bag.”

In May, when digital assets plummeted amid the $40 billion crash of TerraUSD and Luna and crypto lenders recalled billions of dollars in loans from Alameda, Mr. Bankman-Fried directed billions in FTX customer assets to Alameda so that the trading shop could maintain its lending relationships, the SEC said. Mr. Wang and Ms. Ellison were aware of the transfer of funds and Ms. Ellison then used FTX customer’s assets to repay Alameda’s debts, according to the complaint.

This is a recognizance bond, the only thing at risk if he flees is his parents’ home. He undoubtedly has huge crypto assets and multiple passports. I predict he will be living in luxury in Hong Kong within 6 months. He should have fled to Hong Kong when his scheme started to unravel, but he stupidly thought that the Bahamian government would protect him. Ellison wisely sat in Hong Kong, hired a connected US lawyer, and struck a deal with the knowledge that they would not be able to extradite her so they had to give her a sweet deal to get her to flip on SBF.
The most laughable part of this is the judge’s finding that he is not a flight risk. If the same person had not donated millions to politicians would they be set free like this?

SBF is not a ‘flight risk’ because he ‘donated millions to (Democrap) politicians.’

BIG QUESTION that people should be asking: SBF said he had no stash of cash and all of FTX assets are frozen now. So where did he come up with $250mn in bail? Oh sure, it’s a leveraged deal with the bondsman but they always make you put down 20-50%. Where did SBF get 20-50% of $250mn?? The crime continues in front of our very eyes.

He did not have to put up any cash, it is a recognizance bond. His parents did sign off as guarantors and pledged their home as collateral. SBF undoubtedly has a huge stash of crypto, which he will spend after he flees on this ridiculous bail.

And he has options which Snowden didn’t.
Nobody wanted to touch Snowden at the time; he miscalculated that Hong Kong was a safe haven.

When will people ever learn? Money is gold and nothing else. Paper currency is a bigger ponzi than FTX could ever dream of being, yet all the comments here act like they are somehow any smarter. Unless you are out of the banks and into physical gold, silver and platinum, all of your wealth is at serious risk of collapse from the Global Debt Ponzi (GDP). Intelligent people should see the signs and then run for the exits, worrying more about return of their capital than return on their capital.

As Minsky would say, we are definitely in the Ponzi stage of this business cycle.
How pervasive are the Ponzi schemers? What are the risk exposures? How can we know? Let’s start with Bermuda.
How culpable are the authorities in Bermuda? Why are these islands of corruption allowed to exist? Follow the FTX paper trail to its source! I wouldn’t be surprised if there are City of London/ Washington D.C./Wall Street connections. We should probably call it the CL-DC-WS complex.
SEC is claiming jurisdiction. Will SEC investigate the whole corrupt food chain? Time for full discovery, full disclosure, fines, perp walks then REFORM!
It’s time to make an example of, not just the headline Ponzi criminals but their well-heeled enablers and collaborators in the banking system.
Am I being naive?

For a start maybe you should learn to distinguish between Bermuda and the Bahamas. SBF was in the Bahamas not Bermuda!

SBF diverted millions into the campaigns (and bank accounts) of dozens of members of Congress. If SBF goes down, so do the members of Congress he bought and paid for.
He will get off on a legal technicality, or he will get Jeff Epsteined. He will never serve time.
That’s just the way the federal legal system works.

Variations on a theme
Ponzi Ponzi Ponzi
It may seem like people were gullible to think you can get something for nothing.
But isn’t that the foundational theme of Modern Civilization: more output for less input?
TheCaptain
TheCaptain

Reply to  Webej
No, more output for less input is not a Ponzi IF the efficiency of the input increases. In fact, more production for less labor is the very basis of technological advancement. However, the stock market is not a machine, it’s a casino. No work is done in the stock market yet everyone puts in X and is hoping for x+2, 2x or 2^x when they come to take their retirement savings out at some point.
THAT IS A PONZI and they have taught every gullible fool to participate and never get out. It will end badly.

The federal government sits on Hunter’s laptop from hell for literally years, but they can bring charges and extradite SBF in days and hours. What’s the hurry? It’s not like SBF can expose the entire Democratic Party being part of this gargantuan fraud, right?

These plea deals always make me nervous. It is not justice for US when for example: of ten crooks, nine take plea deals to jail the leader for along time. Maybe police at all levels and gov attorneys at all levels are just lazy to let nine walk the streets and commit more crime.

I find it amazing how fast the DOJ and SDNY could get plea deals and charges along with getting
Sam extradited back to the states when the Bankruptcy was filed Nov 11 . Amazing isn’t it how
quickly this happen especially since we are talking many Billions of dollars . Then you compare
it to the Michael Flynn case of a simple lying to the FBI and all the continuations and
everything that took 3-4 years just amazing when you think about it .

One alternative (among many) is that SBF knows the fix is in. Given the political bias of the DOJ, SBF will receive a slap on the wrist and then he gets to spend whatever he has hidden away.

When discussing the likely outcome for SBF and friends, keep in mind that this is the same DOJ that…
1) laid out Hillary/Bill’s illegal doings, and did nothing,
2) used the fake Steele dossier to get warrants to wiretap Trump et al,
3) sat on the Hunter laptop during an impeachment trial that would vindicate Trump,
4) has conspired with Twitter to eliminate YOUR freedom of speech, and
5) has consistently engaged in instances of political bias…

You might want to add the same Administrative state that tried to frame a candidate then elected president
for crimes and collusion. Involved were the Judicial branch , Doj ,State Department , FBI and CIA along with
their mouthpiece the mainstream media . That really is a insurrection . After evidence that showed lies put
forth by the government to move public support for wars in Vietnam , Iraq and so on. that ended up killing 100s
of thousands if not millions of innocent people . The likely now that they were behind the assassination of JFK
and cover up of it . That many have believed for along time but were called conspiracy theories .
That is a short list but you get the point .

Proof in your mind or his?
The statements he made are vague enough that a lot of things constitute ‘proof’ they did those things (for example if they say sat on the laptop story for a month, is that long enough to be considered sitting on it). The question is, is that enough proof to prove anything important and in who’s mind.

There is a very large amount of proof if YOU cared to look for it. And, no, I do not ‘feel important’ by saying it. Actually, it saddens me to see how easily the nation has been hoodwinked, which is what happens when you control the media/narrative. That said, even a modicum of critical thinking will reveal the fraud. For example the download speed of the files from the supposedly hacked DNC server corresponds to the write speed on a thumb drive at the time. Ergo, an inside job, not Russian.

The download speed of DNC files is a critical factor. The download to thumb drives inside the DNC proves Russia was not responsible for the DNC hack.
I assume you understand why the DNC email files are so important. They constitute core corruption. Thereafter, survival of the DNC is the focus. Group think takes over; coverup and media control of the narrative become essential. Lies proliferate–for example, the Steele dossier is concocted and fed to the DOJ/FBI… Trump cannot be tolerated as an outsider to the DC establishment, especially a second term because that is when Trump has nothing to lose.

I wouldn’t take anything coming out of the DOJ SDNY to the bank . They charged him
1 day before he would voluntary testify before congress . They likely are covering
the evidence or use the (can’t say anything because on going investigation) I guarantee
the plea deals are they can’t speak of anything of this as part of it . The lawyers involved
are the same that are always called in to cover tracks for Dems including the one Sam has .
It is likely cover for all the money and were and who it went too will never see the light of day.
Same as it ever was .

Not unexpected. Classic Prisoner’s Dilemma. SBF was probably a significant flight risk with enough money stashed away to do a Carlos Ghosn so they had to cut off that route early on. He will never see the light of day but the others will. For the next few years we will be seeing a lot of clawbacks from a lot of people and organizations.
For Binance it’s a bit more difficult since it has no head office. I wonder if Zhao is staying away from countries that have extradition treaties with the US? I would advise him to. What’s funny is that he said that auditors can’t understand crypto accounting as a reason for not using one. I wonder also where Binance’s servers are located.

Actually, I’m pretty sure the deal was worked out long before the two co-defendants spoke with investigators or assistant US Attorneys. Ellison is represented by Jamie Gorelick, who was the United States Deputy Attorney General (the #2 at the DOJ) during Pres. Clinton’s first term. Gorelick also was Vice Chairman of Fannie Mae from 1997 to 2003 and has been on Amazon’s Board of Directors since 2012. In short, Ellison has smart,well-connected counsel: the deal was probably finalized before Ellison ever spoke to a prosecutor or investigator.

Congrats. JG is 100% democrap. Her role on Fannie MAe is very revealing–no background in finance/banking–she announces no problems, a year later there was a $10B accounting scandal. She was also on the 911 commission–and blamed the ‘wall’ between agencies (that enabled the attackers to avoid exposure) on the Church Commission–a coverup of mismanagement and Clinton’s destruction of the CIA old guard? You tell me.
