- One thing Democrats could do—with basically no strategic downside—is to hammer home the message that voters should ask for and return their mail ballots as early as possible, which makes it more likely they’ll be included in tallies on election night.
- In most states, mail ballots received by Election Day will be counted with other ballots on election day; in some states they’ll even be counted first, in fact. It’s ballots postmarked by E-Day but not yet received (allowed in some states but not all) that can cause a late shift.
- But if Democrats return their ballots sooner, the late shift could be mitigated or even reversed. There’s maybe the slightest hint of that already in North Carolina, where Democrats represent 49% of absentee ballot *requests* but 54% of ballots *returned* so far.

Some states allow early voting in person. That’s also a good solution for those worried about lines and Covid.
There were some objections to Silver’s Tweets. One concerned Ohio where if you request a mail-in ballot you have to vote mail-in or by a provisional vote if you change your mind.
I fail to understand the objection. Request a ballot early and vote early if you want to vote by mail. If you delay too long, then vote in person.
Four Pivotal States Likely Will Not be Called Election Evening

- The Pennsylvania Supreme Court ruled that ballots can arrive as late as Nov. 6 and still count as long as no evidence (e.g., a postmark) exists that they were mailed after Election Day (Nov. 3).
- A state judge in Michigan decreed that ballots can be counted as long as they are postmarked by the day before the election (Nov. 2) and received by Nov. 17.
- A federal judge ordered Wisconsin to count absentee ballots that are postmarked by Nov. 3 as long as they arrive by Nov. 9.
- And North Carolina reached a tentative court settlement with plaintiffs that, among other things, would allow ballots to count as long as they are postmarked by Nov. 3 and arrive by Nov. 12. (However, the settlement still needs to be approved by a judge before it officially goes into effect.)
Legal Challenges to State Rulings
The GOP legislative leaders in Wisconsin have already appealed that decision to the 7th Circuit Court of Appeals, and Republicans say they plan to take the Pennsylvania decision to the U.S. Supreme Court.
Potential Impact
The rulings, if upheld, and they should be, would give a tiny boost to Democrats.
If the challenges are upheld late enough, it could impact the outcome of the election in Pennsylvania or Wisconsin.
Either way, it increases the odds we do not know who won on election night.
Pennsylvania, Michigan, Wisconsin, and North Carolina are swing states. If all four go uncalled on election night, then we likely will not have a declared winner.
Wisconsin Twist
The Wisconsin appeal will be heard by a three-judge panel of the 7th Circuit Court of Appeals in Chicago.
That court includes Judge Amy Coney Barrett. It’s unknown whether Barrett will wind up on the panel that hears the Wisconsin voting case.
Pennsylvania
The Pennsylvania Case may be much ado over nothing.
Republicans are asking the Supreme Court to weigh in only on the state court’s ruling pushing back the deadline for mail ballots to arrive. The state court ruled that such ballots must be counted if they are postmarked by Nov. 3 — and even if they are not, “unless a preponderance of the evidence” shows that the ballots were mailed after Election Day.
Republicans argued that the ruling allows ballots to be counted even if they are cast after Election Day. “The Elections Clause of the United States Constitution vests the authority to regulate the times, places, and manner, of federal elections to Pennsylvania’s General Assembly, subject only to alteration by Congress, not this Court,” the Republicans wrote to the state court on Tuesday. The Hill first reported the filing. Democrats said they will oppose the GOP’s efforts to delay implementation of the new ballot deadline.
There are two issues in the Pennsylvania lawsuit. The first involves ballots postmarked by November 3. Those should be counted. And if they are, the second challenge is trivial.
The second issue pertains to counting late ballots “unless a preponderance of the evidence” shows that the ballots were mailed after Election Day.
The percentage of ballots with a missing or illegible postmark received after election day has to be miniscule.
In Pennsylvania you can easily request a mail-in ballot. So the simple remedy is to vote early.

Except for five states that do not rate to figure prominently on election night (Texas, Louisiana, Mississippi, Tennessee, and Indiana) voters have ample time to vote early by mail if they wish to do so.
Of those five states, it is conceivable, but not likely for Democrats to flip Texas.
Some Texas polls are within margins of error but Trump has about a 75% chance of winning that state by my estimation.

The concern is not about Trump refusing to leave if he loses. Rather, it’s about steps he could take or states could take to declare the election invalid or come up with two sets of electors.
Trump and the states are not powerless. Pennsylvania could become a powderkeg if the vote count is very close.

If your mind is made up, then there is no excuse (except in 5 states) for not getting a mail-in ballot and voting early.

Strong Advantage Biden
Made up minds benefit the person in the lead.
Like it or not, it is preposterous to suggest anything but a clear and substantial Biden lead.
Biden’s lead is not insurmountable, however. Trump can still put it out.
But Biden is a solid favorite now and Trump needs a dramatic late reversal to pull out a victory.
Trump’s challenges on mail-in voting (and other nonsensical Tweets) may very well be a huge effort to vote early.
The main irony is that early voting includes some who would not bother showing up on a bad-weather day to vote in person on election day.
In that regard, Trump’s Tweets are counterproductive for him winning, but he just cannot shut his mouth.

Which other countries do mail-in voting? Curious. Foreigners I know used to laugh out-loud about not requiring voter-ID. Now they’re falling over and rolling on the ground with giggles.

Nevada and Colorado are not going Blue because of mail-in voting.
NV is going blue because of an influx of people moving there from elsewhere.
CO is an environmental state.
Don’t be surprised to see some states in the NorthEast where the majority is strongly white go the other way.
I think Colorado has a lot in common with NV when it comes to population increase. Almost 1 million people have moved there since the 2010 census and I think quite a lot of that was from the true blue west coast where people simply can’t afford housing anymore. Making Denver almost as unaffordable. My best friend in Oregon (two good friends in fact) moved there, and Mish I think it goes a lot further than simply being an environmental state, though that is true. In their last election they voted in Governor Polis who is not only a preogressive democrat but an openly gay man as well. That takes some democgraphic shifting.
I also think this is why AZ is in play, it is estimated that 7.3 million people live there now, in a state as arid as that it makes you wonder where they plan to get the water they will need. This is up from 6.392 million in the last census. Again most of the increase is from other western states.
Even Utah went from 2.76 to 3.2 million and all but a few were from the coast, the rest seem to be from Illinois. 🙂
Texas has increase by 4 million, that is huge. Florida up 2.4 million even with it’s dodgy reputation.
These are demographic shifts that spell trouble as the areas grow ever more urban in character because as I have pointed out often enough the problems of urban areas are far FAR different from rural areas, they are a lot more complex and usually a lot more expensive. That was why your old home state was so purple red in the counties outside of Chicago and it’s suburbs, and that is why the rural red republicans basically cannot win, they are outnumbered. But when it comes to the unequal distribution of senators and of course president the red rural areas have far and away more representation, especially in the senate, and that was okay when it was not a third of a billion people, 85% of whom live in urban areas. Now those people are so underrepresented that I honestly believe we will have to go to a unicameral government of something like 900 representatives only.
This is pointed up nicely by the fact that Wyoming has two senators for it’s 563,000 people – that is about 282,000 people per senator. California has 40 million people so 20 million per senator, that level of unequal power is not tolerable.
Perhaps we need a feature in the constitution that says in order to qualify for statehood your state must have a minimum of two million and a maximum of 5 million. Force larger states to break apart at 5 million and combine smaller states till they reach the threshold for statehood.
What the answer is I do not know, but we have is unacceptable.
Northern California should be made their own state and Eastern California as well and this would create two Republican states.
Northern Nevada could be their own state too and this would create another Republican state.
Colorado could be split in two and leave with the other the Democrat areas and the other with the Republican areas.
Virginia could be split into two and leave the Democrat voting Federal Government bureaucrats in the other and the rest of the state that is heavily Republican to the other part and maybe call that Southern Virginia,
etc.

They should have 5-8 house members less and would have 5-8 house members less if the census based on which house seats are allocated to the states would NOT count illegal immigrants for house seat allocation purposes.

What a mess. I don’t personally think mail is voting is a good idea at all. It centralizes a process and fewer people controlling more power is never a good thing.
It’s pretty simple. You walk up, you show a document with your name on it and you vote. If you don’t have ONE document with your name on it you don’t deserve to get a vote.
Democracy never works for very long. It had a good run but I expect it’s time is coming to an end. Humans always cheer their own demise.
In all Western European countries you have to show ID to vote.
In less developed countries outside of Europe they dip your finger in permanent ink that last for several days to make sure you only vote once.
USA has neither of these systems.
USA should make ID mandatory to vote like Europe does.
In Europe early votes work as follows:
You go to a designated early voting place, provide your ID and make the vote individually in the booth and then place it in a closed envelope and it is stamped by the early voting official and dropped into a box that will be taken to the counting place where the counts start in the morning of the election date so the early votes are all counted when polls close that day and then they start counting the voting days votes.
There is no leaks of the early voting totals because this is highly regulated and the counters are spending that day just counting and will continue counting into the night and there are representatives from each party able to be in the counting place to make sure there are no irregularities and each vote is looked at by several counters.
It is totally anti-Democratic to mail people their mail-in ballots in their homes and then have them fill them out in their homes because this leads to pressure and coercion to vote a certain way from family members and relatives in quite many cases.
I think it good to complete your ballot at home.
My ballot will have:
10 local issues
2 school issues
11 state issues
4 judges
1 state rep
1 state board of education
1 each: US rep, Senator, President

I just look at voting differently than most people. I personally have never had to wait to vote but I understand areas differ by density.
Replacing a system that has worked very well for a long time in one of the most decisive elections in recent memory just doesn’t seem like a good idea. The system we have while in convent at times has worked well.
At this point I don’t think it matters though. One side is promising money for votes and that always signals the end of any democratic system.
I’d be with you, if the government would provide enough voting resources for the walk up and show ID experience to be < 20 minutes. Unfortunately, we have lines like the DMV for voting. Until that’s fixed, mail in is really the only viable option.

Apr 29, 2019 – SALEM – Ten people in Oregon have been convicted so far in voter fraud cases stemming from the 2016 election.
That was out of about 50 suspected fraudulent votes.

As far as mail in ballots go, I think most democrats now see that even if they requested and got one they will not vote it but instead not risk its not counting and go to the polls in person anyway, in spite of the threats by republicans. I know I will be going to my local polling place and casting my ballot in person.
Part of my reason is this, my signature looks different enough each time I sign that a corrupt election official selectively deleting dem ballots can use that as an excuse to pull mine – as if a corrupt election official in Florida actually needs an excuse. There was a time before chip enabled debit and credit cards when we had to sign for almost every transaction like checks, but in the years since maybe once every other month at most. I can barely even hold a pen these days no less have a signature look like it used to.

Obama inherited a budget from Bush that carried the largest deficit on record to that point as well as the global financial collapse, and that actually was why McCain could not win even when lifelong democrats like me voted for him. More than $1.2 trillion in his first year because Bush had to spend the money but refused to tax to pay for it.
Over eight years he got that deficit cut by more than half, and Trump has already added well over $6 trillion in new debt in his three budgets so far, his fourth which begins next week will have a deficit of $2 trillion more and that is if the congress does not pass another couple trillion in Covid relief. His final budget deficit could be over $4 trillion by itself.
Here is an odd tidbit though that Mish might want to squirrel away in his endless vault of knowledge, the US Treasury Department under Munchkin has terminated public access to the searchable DEBT TO THE PENNY function at the treasury website. You use to be able to go and type in a date and or a range of dates and get the starting balance and the ending balance to the actual penny on that/those days, and copy the results. It was taken down and a new version that I cannot make work put up in it’s place. So I would have typed January 20, 2017 and got the starting balance of the debt and then today’s date and see where it stands right now, subtract the smaller from the larger and presto you have the Trump deficit to the actual penny.
I do recall it was just a few hundred million below $20 Trillion that sad day when he took office. $26,786,132,350,375.35 as of Friday. So as you can see Trump’s first three FY budgets are already at an average of $2 trillion per year. We will hit $27 trillion before October 1, 2020 which is the start of FY 2021.
Nice post. I too had notice that change by the USTD but thought it might be an error… I guess now it confirms that public access to that data has been removed. In January of 2017 I imagined the US debt by 2021 to be around 25 trillion and then again by 2024 about 30 trillion. IMHO those numbers will now be shattered and by 2028 the total debt will be over 35-40 trillion. Trump campaigned on totally paying the national debt…. Imagine that? I new he couldn’t do it. Help! I live in NC and have already received my mail in ballot but I still don’t know who to vote for- Biden or Trump?! I’m annoyed at the democrats for the delays on more stimulus and for wanting to spend so much. I worry that if Biden is elected there will be massive overspending by the government. Although the spending would likely benefit me and my family I’m on the fence. Also concerned about the protests continuing if Trump wins. M in NC, if you can look at Trump and his henchmen in the senate and not be shaken to your core then I can predict right now you will vote for him, and it is the last ballot you will probably ever cast that is counted or means anything. If it comes down to theoretical dollars and cents to you then you should vote for Trump, even though he has added $6 trillion to the deficit in his first three budgets, that is nearly a 400% increase per year in debt over Obama’s last budget he inherited. I would say look at what he does and not what he says. Bush left the nation with an economy that was ravaged by the global financial collapse and the biggest deficit ever. I am a democrat in Florida and I have always been a pretty liberal person, because I believe that people should be able to live their lives as they want to. That does not mean I am inflexible, I did vote for Reagan against Carter, and for McCain against Obama, though I did like Obama and voted for his reelection. Some people did not like how he governed but given how the senate GOP blocked him and refused anything he tried to do, the way his nominees could not get any hearings, the gridlock they imposed on the democrats it is a wonder we survived to the 2016 elections at all. Biden was not my first choice or even second, and I do not like Harris at all, but as a veteran I would vote for a ham sandwich before I would vote for a man that refers to our war dead as suckers and losers.

I won’t tell you who to vote for, but I’ll tell you some of the things that will influence my vote.
I will not vote for someone that has blatantly broken the law while in office. Mueller dedicated an entire volume of his report documenting the case that Trump obstructed justice during his investigation.
I will not vote for someone that uses public funds for his personal benefit. Trump withheld aid to Ukraine in exchange for an announcement of an investigation into his political rival.
I will not vote for someone who refuses to take the responsibility of leading the country during the greatest crisis we’ve faced in the last 75 years. In the first months of the pandemic, states were bidding against each other AND the federal government for supplies. Even now, we’re 6 months in, and what is our federal response? What is our national strategy? All I see is experts saying one thing, and the White House reversing it within hours. It’s been a mess, and the only clear message has been “you’re on your own”.
Reagan once said, “are you better off now than you were 4 years ago?” Well, are you? Has the Trump admin improved your life on any way over the past 3.5 years?

Later it was revealed the FBI agents themselves said there was no problem with the registration so FBI lied to Flynn and threatened him and his son.
The FBI agents in Mueller’s team even bought professional liability insurance for themselves because they were so convinced the Mueller/FBI investigation was totally rotten to the core and they would be taken to court if the truth would be revealed.
Many agents joked that the leaders of the investigation really led by Andrew Weismann (Mueller was just a figure head who did not know his own report when questioned on it in Senate/House) were playing “Collusion Clue” where just talking to somebody who had talked to somebody was evidence of collusion.
Latest news is that CIA analysts thought that Russia wanted Hillary Clinton to win but the Obama loyalist and ex-communist CIA director Brennan did not want that in the 17 intelligence agencies assessment so he put his own loyalists to write the report that totally left out facts that showed Russia wanted Hillary Clinton to win and only claimed that Russia wanted Trump to win.
The 17 intelligence agencies assessment was written by CIA under Brennan and FBI under Comey and NSA wanted to wash it’s hands of it since signal intelligence did NOT support it’s claims so NSA only put in that they have “moderate” confidence in the reports claims.
The rest of the intelligence agencies were just tacked on to make it seem that the Brennan/Comey hatchet job had more weight.

Graham has a weak lead, and no money left. SC looks like it has straightforward mail in voting and in person early voting.
LM, it is hard these days to put faith in polling, but given that is the only evidence we have of the political mood of the country I would say the republicans are in very deep caca. In reality the fact that Graham is dead even tied with an African American male political novice in South Carolina; home of Strom Thurmond, pretty much sums up how deep that caca really is. That Graham is far FAR behind in campaign financing is yet another though I do not like to indicate our elections come down to funds in the bank, I prefer to think of it as people voting with their dollars and a good indication as to how they will vote with ballots in hand.
There are several deep red states where the republican incumbents are polling at or below the tied mark like Alaska, like Montana, like SC, like NC though that state is not as red as it used to be, like Gardener in Colorado, though I also would no longer call that state red anymore either, like Arizona, and other GOP senators that are in trouble and appear to be losing, like Collins in Maine, like Cornyn in Texas who has been up by 1 or 2% well within the margin of polling error. Like Joni Earnst in Iowa who is trailing Greenfield the democrat.
All those races could go either way except for Collins, McSally, Tillis, and Gardener who need actual miracles to stay in office. Even in the deepest red state in the nation, Alabama, the democrat incumbent will lose but not nearly by the margin that the GOP expected. And this tells me that because so many races are so close it will come down to black voter turnout. Even Alabama could turn the red tide if every voter votes.
I am also going to my polling station to vote in person, and if I find it blocked or if I find any intimidation of ANY kind I will be calling the cops to see to it my vote counts. There really is no state more crucial than this one, in a fair election we can deny trump Florida and while I think a reasonable electoral count as it now stands means even Florida cannot save the orange fat ass I want to see the biggest landslide possible so he cannot claim it was rigged. And we know he will, it is simple, he SAID he was going to call it rigged many times. He plans to attack the integrity of this election and the only way to stop him is if all democrats vote.

If Trump’s goal is to motivate every Republican to vote because they think Democrats are trying to steal the election I think Trump’s message however clumsily put is working.
If Trumps goal is to make Democrats nervous so they would not do the kinds of mail-in ballot fraud that are possible I think Trump’s message is working.
It is however likely that Trump’s messaging is causing Democrat leaning voters to vote in states with mail-in ballots sent to every voter that otherwise might not have voted on election day but this is more about the fact that those states send everyone mail-in ballots.
