Appalling Courtroom Instructions by the Presiding Judge to Help Convict Trump

Let’s tune into Jonathan Turley’s analysis of Judge Juan Merchan’s instructions to the jury in the New York Hush Money Trial of Trump.

  • I am back in the courtroom for the instructions.
  • This judge has stated that he wants to stay close to the standard instructions. The problem is that this case is anything but standard. We will be looking for some of the outstanding issues, particularly on the standard of proof for key elements like “unlawful means.”
  • Yesterday was chilling as the judge allowed the prosecutors to engage in what some of us view as highly improper arguments. That included effectively testifying on facts not in the record. Merchan’s view of “argument” was considerably broader for the prosecution than the defense. For the prosecutors making objections, the strike zone seemed like it stretched from dugout to dugout. For the defense, it seemed the size of a postage stamp.
  • Judge Merchan is now instructing the jury. He has ruled that the jury will not be given copies of the instructions but can ask for them to be read to them again. [Mish: This is the norm in New York state trials, but it does seem silly.]
  • Judge Merchan is giving the standard instruction that they can reach inferences based on facts such as inferring that it rained from seeing people in raincoats. It is a rather quaint instruction after Merchan allowed the prosecutors to state as a “fact” that federal election violations occurred in this case. There is no such violation in this case, but Merchan did nothing to correct the erroneous impression. To carry forward the analogy, Steinglass was just yelling at the jury that there was a virtual hurricane on a perfectly sunny day but the judge remained entirely silent.
  • Merchan also instructed that they may consider the interests of the witness in the outcome of the case. One of the least convincing parts of the closing argument of the prosecution was the claim that Michael Cohen was attacking Trump and selling merchandise to feed his family. Steinglass portrayed Cohen as struggling in his luxury multimillion dollar condo while making millions. It was a far cry from pushing a food cart down Broadway to support his family.
  • Merchan instructed that Cohen is an accomplice and, as such, there is a special concern over such testimony particularly when there are benefits for testimony. There must be corroborating evidence. In other words, you may not convict the defendant solely on the basis of the testimony of Cohen.
  • After the federal election violation, Merchan says that the second crime is falsifying other documents. This creates a redundancy with the NY election violation on the falsifying documents. It allows the government to allege the falsification of documents as a felony and then allows such falsification to be also the unlawful means for certain documents. The third is the violation of tax laws.
  • So a dead misdemeanor for falsifying business records was zapped back into life by alleging that under NY election law 17-152 it was done to influence the election by the unlawful means of falsification of business records. It is so circular as to produce vertigo. So the jury finds some documents were falsified to use the unlawful means of falsifying other documents. That is only one of three possible crimes and the jury does not have to agree on which was the basis for their conviction.
  • The absence of a witness on media practices is becoming more and more significant. Such a witness could have discussed how stories are often killed or planted by campaigns in light of the press exception for common practices by the media. Instead, the prosecutor was allowed to state as a fact what the common practices of the media are in a campaign.

This Will Backfire on Democrats

This trial should never have occurred. The state wants a conviction for an unspecified crime that Trump was never charged with, and it all started with a misdemeanor .

This can backfire spectacularly. The easiest way is for acquittal.

But the most spectacular way would be for an appeals court to overturn the conviction and absolutely blast Justice Merchan for blatant errors.

The best Democrats can hope for is a hung jury. Ironically, if there is a decision, it may be better for the Democrats if there is no conviction.

If this weren’t playing out right in front of me, I wouldn’t believe it. What do these s.o.b.s do if Trump is convicted? Lock him up? Let him post bail? Strike him from the ballot? Or . . . maybe we can skip all of that and get enough of a war going that in a patriotic spirit the government postpones (cancels) the election.

I thought this lesson was learned during the Days Of Our Lives Clinton Monica saga. GOP got pounded for pursuing it. Same will happen to Democrats for these soap operas. Americans don’t like it. Maybe once they start going down these paths there is no turning back? I do not know why but there was no scenario where Trump would get weaker.

This is not a Trial about Donald Trump it is a Trial about what is going on in Washington DC and the rulers of Uniparty.

I had advised not to pay attention to this Trial as I believed it would turn into a lot of silly noise. It has turned out so much Bigger then imagination was able to conceive.

Third world real estate simply isn’t worth what NYC real estate was valued at on January 1st. Most real estate developers in NYC are now bankrupt.

Pension funds, insurance companies…. and of course campaign contributors to Kathy Hotchul … all effectively bankrupt no matter how this fraudulent trial ends.

Lots of commercial real estate owners with heavy concentrations of assets in NYC are now bankrupt. Its just simple math. They levered their buildings 5 to 1 (they put down 20%) or more likely 10 to 1 (they put down 20%, but half of that was borrowed via other channels).

Real estate in third world jurisdictions is worth substantially less than in places where the rule of law prevails. At least 20% less, probably more like 40% less. Ergo, all the equity in these real estate owning companies is wiped out, and then some.

NYC property tax collections are also going to plummet, a trend that was already in progress before this sham trial.

NYC will take decades to recover from this stupidity

This mimics a Soviet style show trial in the late thirties. I experienced this lawfare type of thing myself in late 1963 and early 1964. I was one of the leaders of the local civil rights “movement” and the local police and DA were desperate to get rid of us (I was a senior at University). After a sit-in two men who were local klan members shared me up the street with knives draw and actually chased me around a police car that had pulled up. They threw me in the police car took me to the station and charged me with carrying a deadly weapon which was a pepper spray type of thing. They warned me not to charge the two guys who were trying to kill me whom they knew from previous arrests. The police sad that the klan knew where I lived. Next they called my parents at 2:00am and made me sound like Al Capone. I had no money for a lawyer and had to plead no contest. My parents kicked me out of the house and I became homeless for nine months. I finally was graduated later on in the summer of 1965. I know how they can charge you with anything and then break you financially to make you plead to something. General Flynn anyone?

Funkenstein said that Gov Hochul (who is a bimbo outside of this case and not a prosecutor who would make such decisions anyway) promised not to use the legal precedent set in this case against other people and businesses.

Bragg did not make this error on his own, and there were lots of other shady people involved… hence her assurances that they won’t abuse the legal system again are hollow.

Maybe the charges should not have been pursued, but do you really think Trump didn’t do pretty much what the prosecution is suggesting he did? I mean maybe he’s not guilty by reason of not enough proof but there can be no doubt in any reasonable persons mind that he is not innocent.

He did the dirty deed with the porn star, paid her to keep quiet, and then tried to bury it and probably made it a tax deduction all to win an election.

The net effect of course is that he likely stole 2016 from Hillary.

The other question is how does a genius like Trump ( and a stable genius at that) get himself in so much trouble? I mean wouldn’t you expect him to be 10 or 12 moves ahead of an old geezer like Biden and those idiot democrats? He must have been having an off day.

Years ago, Detroit was an amazing city to live in. Mansions and wealth everywhere. In addition to the car companies, there was Mo-town music, there were all sorts of food processing companies, thousands of small businesses.

Today, Aretha Franklin’s house is a wreck. There are sections of the city with several blocks in a row are 100% abandoned houses. Street lights don’t get turned on, because the city can’t afford it. The bulbs were smashed long ago, the copper wiring was stolen and sold for recycling value.

Real estate prices in a banana republic do not get the same values as real estate in a city that used to respect the law.

No matter what this jury decides or how long it takes to have the ruling vacated on appeal. Even if the jury fully exonerates Trump and calls out the judge as a fraud (highly unlikely but lets just say for arguments sake)… NYC real estate prices are worth less than half of what they were last New Years Day.

If NYC residents had trouble getting your building superintendent to fix something last week when the building was worth more than the mortgage, just wait until you try to get anything fixed now.

And I don’t know how NYC residents can fix this. Apologizing to Trump (however unlikely that might be) isn’t going to fix this

It’s lose-lose for the Democrats. If Trump is acquitted the Democrats lost on a trumped up charge. If he has a hung jury then he still wins because enough jurors saw through the Democrat’s inequity. If he is condemned then the view would be that a prejudiced jury under the influence of the Democrats have weaponized the judicial system. Frankly, this is so obvious that I wonder whether the objective all along was to augment Trump’s chances of winning the election. Perhaps the swamp is not as fetid as we think and that enough parts of it have realized that the country under Democrat leadership is a direct path to disaster.

I find it interesting because from my perspective at least it’s like the Democrats are intentionally trying to get Trump elected. It’s like a comedy show watching these bungled prosecutions most of which shouldn’t have happened or should have happened on a timely basis instead of right in front of the election. I am an Independent and not fond of Trump but all this harassment of him pisses me off further at the DNC.

Jury nullification is a defacto right of any juror. If the juror keeps thier mouth shut, exercising it is difficult, if not impossible, to prove. When on a jury you don’t have to explain the rationale behind your verdict to anyone,including other jurors.

Reminds me of when Bill Clinton and Loretta Lynch met in a private jet on the airport tarmac in 2016 to exchange photos of their grandkids and certainly not to discuss Hillary’s case.

I dislike Trump but the weaponizing of the justice system and grand canyon-size double standards (like Trump’s classified document case when Biden gets a pass for doing the exact thing) is actually driving me to root for Trump and support him.

This is a cluster f#ck of biblical proportions for NY state’s legal system. The legal precedent being set by allowing the fraud to go to a jury trial, the circus of having an inept clown posing as a judge using a courtroom to go after a political opponent … these are things expected of a third world shit hole, not the North American center of capitalism and rule of law.

The NY bar was considered the toughest in the USA to pass. Being a NY state bar member used to be different than being a Zimbabwe bar member.

NY real estate values are going to plummet. The exodus of the wealthy, and more importantly the brain drain out of NYC … regardless of how fast this nonsense gets appealed … the damage to NY is done.

Trump can fix his situation on appeal, and it will be easy.

NY state is going to have to purge judges chambers, convict their DA (which means every case he was on has to be retried).

NY is truly fucked, and they did it all for nothing. They won’t “get Trump”. They won’t convince anyone Trump is worse than whatever people already thought. Trump’s reputation isn’t going to change; if anything people will sympathize with him.

I’ve been wondering about whether this might be the actual plan after all.

Convict Trump on some bogus charges and get the MAGA supporters riled up (marching etc) similar to what happened on Jan 6th only on a nationwide basis.

Use this as a pretext for declaring another insurrection with the goal of declaring martial law. Allow martial law to be the guise for keeping Biden in power (can’t have a Republican/Democratic conventions under martial law, it would be too dangerous then extend that ‘too dangerous’ through the election and declare Biden as an unopposed winner).

Sure, it’s the stuff of movies, but with Biden looking increasingly unlikely to win by the day this would be the perfect way to keep him in power and since he’s so senile he wouldn’t even object or know better than to let it happen.

There are hundreds of wealthy real estate developers in NYC (besides Trump) who have NDAs against their “secretaries”, “nieces”, and whatever euphemisms we are using for Stormy Daniels profession. Once a legal precedent is set, its not just Trump who goes on trial.

NYC is already F#cked with a capital F because the other clown claimed it is illegal for real estate developers and banks to have different guesses of what a building might be worth.

Of course, this case is going to get appealed until long after Trump is offering to rebuild the pearl gates of heaven. The damage to NYC’s reputation will go on for long after that.

The question Mish didn’t address (and the answer isn’t obvious to other commentators either) … how does NYC send Alvin Bragg and the corrupt judges to prison to correct this mess? They have to fix the legal precedent, not just apologize to Trump

As I understand it,

  1. The Trump organization should have accounted for the payments to Michael Cohen as “hush money” or “non-disclosure agreement” instead of as “legal services”.
  2. And because it was meant to affect the election it should have been reported to the FEC as a campaign expenditure. Maybe a campaign donation, too.

So no precedent is set for ordinary non-disclosure agreements. Although a whole lot more discretion is advised concerning sex-relations with another person. Former VP Mike Pence has a good plan.

Clearly you don’t understand the case at all. None of that has been proven, and this crazy judge says it doesn’t matter whether the anti-Trump jury believes it. The judge (not the jury) decided this as a “fact” even though the evidence says it isn’t true at all.

That same third world bullshit can now be used to attack anyone with “the other” political affiliation in NYC.
