That’s the way it looks to us so far in the case of last week’s arrest by federal agents of Milwaukee County Circuit Court Judge Hannah Dugan for allegedly helping an illegal migrant evade Immigration and Customs Enforcement. Judge Dugan was charged with obstructing a federal proceeding and concealing an individual to prevent an arrest. A federal magistrate found probable cause for the arrest upon reviewing a 13-page criminal complaint.
The alleged facts as laid out in the complaint by FBI special agent Lindsay Schloemer don’t look good for the judge. Judge Dugan was scheduled to preside over a hearing in a case against Mexican national Eduardo Flores-Ruiz, who has been charged with criminal battery.
But Mr. Flores-Ruiz was also in the U.S. illegally, and an immigration official had issued an arrest warrant for him. ICE deportation agents planned to arrest him at the courthouse. ICE sometimes seeks to arrest illegal migrants in the public areas of courthouses because that’s where they can locate migrants accused of crimes. They are also safer than a home arrest because the migrant will have had to go through a security checkpoint.
The complaint says Judge Dugan was “angry” upon hearing the ICE plans and raised objections with other judges. Witnesses say she then invited Mr. Flores-Ruiz and his lawyer to leave through the “jury door” so he could avoid arrest. The deportation agents nonetheless spotted Mr. Flores-Ruiz in a public area of the courthouse and arrested him as he attempted to flee down the street.
Judge Dugan is an officer of the court. The deportation agents were fulfilling their duty to detain an illegal migrant under a lawful warrant. Even if she disagrees with federal deportation policy, Judge Dugan can’t obstruct federal officers seeking to enforce the law.
It’s especially concerning that, in the process of allegedly helping Mr. Flores-Ruiz, Judge Dugan canceled her hearing on his alleged domestic crime without informing the prosecutor or the alleged victims. They were left sitting unaware in the courtroom, according to the complaint. If Mr. Flores-Ruiz had managed to escape arrest, how would his victims have received their day in court?
I have been very critical of Trump in cases where I thought he did not follow the law or the court. This case goes the other way.
Dugan is unfit to be a judge if the facts are as presented above.
I am in a very small minority but I want all sides to follow the law.
If there are cases of activist judges (or activist Administration rulings), I want all sides to follow the normal Appeal Court process.

Judge Dugan, just like everyone in the U.S. accused of a crime (such as Trump), is entitled to due process. The so called “facts” are not facts until as so determined in an evidentiary hearing. If she broke the law, then consequences should follow.
However, the rationale for ICE being allowed to lay in wait in a Court House to make arrests is way off. Already, it is hard to prosecute crimes committed by employers on low level workers, sexual abuse crimes…as they often require witness testimony of undocumented migrants. There is no reason ICE could not have waited until AFTER the hearing on the alleged domestic violence and then make the arrest outside the Court House.
Our Courts should be recognized as a safe place. The victim did not get her day in Court as ICE prevented it.

How do you determine if they were legally allowed or illegally crossed the border without due process? Do you just take ICE’s word for it? They are never wrong, correct? Like when 20 armed agents raided the house of a US citizen in Oklahoma, and had the mother and three daughters in their underwear on the front lawn while they ransacked the house, and it turns out ICE was looking for the prior residents.
At the time CBP One app was in use, requiring some identification of the applicant. I would say that suffices as ‘allowed’ to enter.
Other people were picked up from the river banks or caught in groups moving into the USA. These people were photographed, asked for ID, etc and processed to transportation hubs. Also a ‘legal’ entry.
Those who evaded CBP officers, with no record of their entry, are ILLEGAL.
As for an incident in Oklahoma, ICE had ‘reason to believe.’ When the prior president lets in millions of people without validating them, BLAME BIDEN for CBP mistakes.

The fundamental requirement to enter the US is to present oneself at the border at a legal entry point. FULL STOP. Anything else is an illegal entry.
For a US citizen or resident alien, to do otherwise, (with exceptions for virtual reporting such as CBP ROAM), or even to miss the time deadline to report, is an automatic $5K fine.
But how do you know they crossed illegally, unless you actually catch them at that exact time? That’s the problem. And for the record many immigrants come by plane, not a land border, and then overstay their visa or entered fraudulently claiming they were a student, like Elon Musk did.

I tend to disagree with you Stu, but not on this. From what we read here it sounds like weird behaviour and due process should be able to establish that. There may of course be more to the case but again, from what we see here it looks like obstruction of justice not based on law but on personal preference.

The Supreme Court has barred her from being a judge until further notice. If she’s convicted I doubt the Supreme Court will allow her to go back to being a judge. If she’s not allowed to be a judge then she would lose her job. Also this is Federal court so it won’t be her county judge friends.

There was interaction between the judge and the arrest team. The judge wasn’t happy they were there. But two members of the arrest team watched Flores walk down the public hallway and enter the elevator. One of them rode the elevator down with him and they still managed to loose him for a bit before arresting him outside the courthouse.
Seems like they had plenty of time to arrest him after he left the courtroom.

Private prisons would be a bad investment. Once the activist judges and the injunctions are slapped down then ICE will have the ability to round up and send to the harsh prison in El Salvador all the worst of the worst illegals.
The payoff to send hundreds so far is only 6 million and I’m sure a deal could be hatched with El Salvador to take thousands more. Give the country a zero tariff agreement and a few hundred million each year and they could take not just the criminals ICE rounds up but also every illegal currently doing time in federal prison. And why stop there? I’m sure most taxpayers would be happy if every illegal in state and county prisons were sent to El Salvador to serve their sentence as the cost would be a fraction of what is currently spent. And as a side benefit it would reduce overcrowding in US prisons.
