Pennsylvania officials have admitted willingly counting illegal ballots. It’s time to prosecute. 
State Supreme Court Rules Against Fraud
Please consider State Supreme Court: Incorrectly Filed Ballots Will Not Be Counted in PA Senate Race Recount.
With a recount ensuing, incumbent State Senator Bob Casey argued that undated or misdated mail-ins should be allowed to count. However, on Nov. 18, the Pennsylvania State Supreme Court ruled that they will not.
In a statement presented to the court, Judge Kevin Brobson says “I write to disabuse local elections officials of the notion that they have the authority to ignore Election Code provisions that they believe are unconstitutional.”
This stems from Bucks County officials voting against the advice of their solicitor to count undated and misdated mail-in ballots. Bucks County Democrat Commissioner Diane Ellis-Marseglia had some bold claims in response to this ruling.
“I think we all know that precedent by a court doesn’t matter anymore in this country and people violate laws anytime they want,” Ellis-Marseglia said. “So for me, if I violate this law, it’s because I want the court to pay attention to it.”
Woefully Insufficient
The Supreme Court order is woefully insufficient.
In addition to no further counting, all illegally counted ballots need to be removed. If that did not happen, we need to start over.
However, Republican Dave McCormick is ahead by 18,000 votes and that’s too big to steal.
One of the worst aspects of this will be the “I told you so comments”. But Shenanigans like this did not cost Trump the election in 2020. The margins then, as as now, were too big to steal.
But comments like those of Ellis-Marseglia will inflame the “Stop the Steal” sentiment, and justifiably so.
Time to Prosecute
Regardless of how one feels about the 2020 election, and this one, the one and only way to stop this kind of purposeful fraud is to prosecute these cases to the fullest extent of the law.
Ellis-Marseglia is begging to be tried, convicted, and sentenced to jail for her actions. And that is my recommendation. She wants publicity, so let her have it from a prison cell.
In addition, we seriously need to re-think mail-in ballots for multiple reasons.
Ironically, we may end up giving thanks to Ellis-Marseglia, hopefully in her jail cell, for proving beyond a shadow of a doubt that we need national election reform.

The title of my post said “vote” fraud. I corrected to “election” fraud.

I don’t disagree, but I wonder how many ballots we’re talking about. Also what does “misdated” mean exactly? Also is this voter error, or an error from the pole workers, or did the post office mess up the mail-in ballots? Or were the instructions vague or imprecise?
If its a significant number of ballots, how can this be avoided next time?
Yes, prosecute. It is the only way to put a stop to this insidious behavior of ignoring the Judiciary.
Undated and misdated ballots ? If they were ballots that got back to the state before certification why does it matter ? Doesn’t the state track every voter anyway ? States can make up any rule to disenfranchise voters under current election control procedures.
The better thing to do is to give states until the date of congressional certification to count all the votes. As long as they come in before early Decembr why does it matter ? This is why 50 states shouldn’t be allowed to disenfranchise legal voters. The system the way it is allows states to disenfranchise voters based on random and arbitrary laws. They can pass laws making it illegal for some people to vote. Should we follow that law too?

For once I agree with you Mish. I like it better when you take a stand on these kind of issues and don’t get all squishy well because of the data (which in this case doesn’t apply as it is a matter of law). We all should take a stand against this kind of behavior regardless of which side of the political spectrum we stand on. The only problem for the Democrats is that they would find themselves in the distinct and possibly long term minority if it weren’t for their constant underhanded practices in election fraud.
They could avoid being in long term minority, but to do so they’d have to shift policy stances to attract more voters (a la Clinton in the 1990s).

You can say what you want about if there was election fraud or not but when you see people do bullshit like this along with no voter ID in blue states the perception will always be that the election was fake no matter who wins. If you want people to accept the results you need the election counting process to be transparent and speedy. I certainly hope that Trump will ram through election reform that gives us this. That would be his greatest achievement in my opinion because it is the first principle of democracy.

I dont think that the 2020 election was stolen. But looking at the data one must acknowledge a strange pattern. The total number of votes for Biden (and Trump) were significantly higher than before or after. Given the media buzz around 2024 (Musk, Swift etc etc) I do not understand why the turnout is that much higher in 2020. Im not an expert in the US election system but I just read that the mail-in voting system changed in 2020 vs prior years, but again, the lower turnout in 2024 is still surprising. I think you have some (significant) errors on both sides (also the Trump votes seem too high) but I dont believe that an orchestrated steal could work in any way (main reason: you need to involve too many people). Do you know any good analysis about the 2020 election and why the turnout is that high?
In my opinion such an analysis should be front page in the NYT, CNN, WaPo (same as an analysis on COVID vaccines etc) acknowledging that this is the data and you can then argue about the interpretation of the data.

I think the George Floyd incident in Summer 2020 brought out many voters. And I think many (unfairly) blamed Trump for all that.

Let me clue you in on something: If you want to make your efforts at cheating not look so blatant you throw some votes into your opponents totals in order that the differences appear less obvious. That’s why both parties vote totals for 2020 are so distinctly out of line with the numerical totals of the previous presidential elections and 2024. It’s not rocket science as they say.

All mail in ballots are not created equal. California will mail a ballot to the address (or nearest intersection) of anyone who registers online to vote FOREVER without ever verifying that the person is alive, still lives there, or even ever really existed. Just check a box that you’re a US citizen, make up a name, SSN and whatever else they ask. Yes, you read that right. Check it out for yourself at CA Sec of State website.
On the other hand. In Florida the Election supervisor of every county sends you a notification to your mailing address on record for every election asking if you want a mail in ballot sent to you.
Florida tightened up after the 2000 election.

This is 2024. ALL voting should be electronic through a computer/cellphone only. PERIOD.
You don’t have a computer or you can’t get to one in the weeks leading up to an election, then you lose your vote.

Elon Musk is very pro tech and he stated that ALL ballots must be paper. Anything electronic can have built in back doors, secret access codes, have hack able weaknesses, erase-able memories and the possibility that it will show on screen that you voted for candidate R but tabulates it as candidate D.
Require voter ID. A passport, a drivers licence, or a government issued voter ID for those who neither drive nor travel. Require drivers licences to have a mark showing if the driver has citizenship so non citizens cannot wrongly vote.
For anyone who cannot get to a polling place as they are oversea they can go to the US embassy or consulate. For the military they can have voting on base or ship.
For the elderly, infirm, hospital and nursing home patients etc they can have a polling official go to their place of residence in the weeks before the election at an agreed upon time to get their vote.
No mail in ballots. A full paper trail, thorough checking of of the validity of the ID.
Perhaps even add a security biometric scanner at the entrance of polling places to record every voter. If they vote twice or attempt to pass themselves off as someone of similar appearance to the stolen or borrowed ID of another then they will be caught.
Anyone trying to cheat, steal votes or voting illegally should get a felony conviction and lose the privilege to vote for life.
And voting should be a privilege and not a right. Once someone owns property above a certain value, or has paid a certain level of taxes, or is a member past or present of the armed forces (or their spouse); then they get the vote. Nuts that illiterate trailer trash living on government welfare gets to vote when they turn 18 when the founding fathers system only gave the vote to those paying for the system.

That scenario is more appealing. Trump age 74-78 with consecutive terms is less scary than age 78-82. How was Trump going to prove a certain percentage of ballots were fraudulent? Vote fraud is the perfect crime. Lacking clean voter rolls and confirmed voter identity, there is no way to prove a percentage of ballots is bogus.
But now we see how they cheat and are willing to cheat. They simply create ballots for unknown voters! Do these ineligible voters even exist?
You may want to read up on the PA election laws the (R) party wrote to address what you said – years ago to stop the massive fraud seen in Philly by (D)s pre-Trump. These ballots are real, but have date/sig issues on the outside of the ballot envelop.
What I saw in 2020 was a lot of cases that should have been heard in court, with full discovery, but were thrown out mainly due to bogus claims about lack of standing and/or lack of time.
The time interval between Election Day and Inauguration Day is too short for any serious investigative process nowadays. And electronic voting makes it too easy to delete or taint the primary evidence.
Every voter and candidate is harmed by voting fraud, so standing should be automatic for any vote fraud case.
All of the above is why it is absolutely vital that all election systems be transparently robust against fraud. To be perceived as just, the results have to be unquestionably accurate and delivered quickly.
Every election is a mutually agreed nonviolent alternative to “civil war” between factions, and only fraud-free voting prevents the more contentious elections from actually becoming civil wars. Many cases historically … see especially the Battle of Athens (Tennessee).
Equally, in 2020 Democrats and big tech told us the elections are so safe and secure, that even discussing the possibility of election fraud would get you banned from social media.

This one is easy. Everyone was looking at the 5 swing states that magically reversed the Trump lead on Election Day eve. All the bending of vote count rules that courts decided to ignore thereby colluding to install the wrong guy.

Fraud or simply trying to make sure that all eligible voters’ ballots are counted? We should go to the polling places as was done for most of my long life. Voting should require some effort by the citizenry. Vote by mail invites fraud.
We cash checks, transfer money, buy real estate, all on line or through the mail. There’s no earthly reason we can’t vote the same way.
Make it a national holiday; delete one of the existing federal holidays to make room for this one. And don’t forget #TermLimitsNow, #EndTheFed, and a Balanced Budget Amendment!

Mmmmm…..I’m not sure I get your point. You are saying it is *not* fraud to count votes that are clearly disqualified by the rules even after receiving a court order to follow those rules, while publicly acknowledging that you know the rules are being broken and that you have received a court order specific to you and to that particular count to comply with the rules but since you confident that by their nature they will support your preferred outcome you will go ahead and include them with the valid votes anyway.
As for your larger point about making it easy for voters to have their votes counted, you miss the whole point of voting as it is understood in North America. The goal is make sure that votes matter. If the count is so easy or conversely so restricted that the count doesn’t really mean anything, then the votes don’t matter so why bother even having a vote as a method of conferring legitimacy on to the authority structure.
Even you in your comment use the phrase…. citizens have their votes counted….. The only convenient way currently available to establish citizenship is to require i.d. There are a large number of very vocal people (and probably you for that matter) who think that having to show qualified identification is a major, unfair obstacle to getting your vote counted.
Here in PA, you need an ID to vote by mail. You DON’T need an id to vote in person – so there’s that…

I’m here in the Pittsburgh area, and agree with you. What the comments aren’t aware of is the complete overhaul of the voting systems by (R) years ago. The request system, id, bar codes, tracking system for mail-in ballots.
What we’re talking here is not voter fraud, it’s a BS criteria for the outside security envelop for a date and signature having nothing to do with the ballot itself. I vote mail-in every time, and drop it off at the election office weeks in advance. There’s nothing fraudulent about that. Biggest problem is that the (R) party refused (and continue to refuse) to allow counting ballots as they come in so there’s a vote total on election day.
All that said, these election board people are breaking the law, and they need prosecuted.
I think people who want their votes to be counted should be expected to accurately fill out an envelope, either on their own or with help. Carelessness is not an excuse.
Put the effort into making the rules straightforward and helping people know how to follow the rules… not into allowing them to break the rules.
We do not, for instance, allow drivers to violate the traffic laws just because they are careless – nor pedestrians.
