The Wall Street Journal notes How the U.S. Arms Pipeline to Israel Avoids Public Disclosure

The U.S. has sent tens of thousands of weapons including bombs and precision guided munitions to Israel since Hamas’s Oct. 7 attacks using procedures that have largely masked the scale of the administration’s military support for its closest Middle East ally, according to current and former U.S. officials.

The administration has organized more than 100 individual transfers of arms to Israel, but has only officially notified Congress of two shipments made under the major foreign weapons sales process, which are usually submitted to lawmakers for review and then publicly disclosed, U.S. officials said. In both cases, the administration used an emergency rule that avoids the review process.

The rest of the transfers have been approved using less public mechanisms available to the White House. Those include drawing from U.S. stockpiles, accelerating previously approved deliveries and sending weapons in smaller batches that fall below a dollar threshold that requires the administration to notify Congress, according to current and former U.S. officials.

“While the State Department has no legal obligation to notify below-threshold arms transfers, using this process to repeatedly end-run Congress—as sales of this quantity suggest—would violate the spirit of the law and undermine Congress’s important oversight role” Sen. Chris Van Hollen (D., Md.), a member of the Foreign Relations Committee, told The Wall Street Journal.

This stuff is non-transparent by design,” said Josh Paul, a State Department official handling congressional relations who resigned in October in protest of the Biden administration’s policy on the Gaza war.

Reflections on the Spirit of the Law

Biden openly flouts not of the spirt of laws but actual laws, and brags about that as happened with student aid.

The only people who fully understand any laws are the lobbyists who write them.

In this case the weapons industry likely lobbyists inserted provisions to allow the president to ship weapons at will.

What’s Cookin’?

The U.S.-supplied arms since the beginning of the Gaza war include at least 23,000 precision guided weapons, including Hellfire air-to-ground missiles, drones, and Joint Direct Attack Munition kits, which turn unguided bombs into “smart” bombs, along with other similar weapons, U.S. officials said.

Israel has also received 58,000 155mm artillery shells and munitions for its Iron Dome air defense system, the officials said.

Now guess what. The Pentagon will complain we don’t have enough of a weapons stockpile and will request more “defense” spending.

Republicans and Democrats will be happy to oblige.

A Wall Street Journal investigation found that since Oct. 7, Israeli settlers have been rapidly building illegal roads and outposts across the West Bank. This work is sometimes done under armed guard with funding from the Israeli government.

Normally the Journal has a share button but the accompanying video does not offer one.

There are 15 major roads and 5 settlements underway with military protection. These settlements and roads are illegal under international law.

The pace of construction is surging. Typically it takes years to build a road. Now they are finished in days.

Biden, who opposes the construction as well as Israeli plans in Gaza, sends concealed weapon shipments with no strings attached.

He is lobbying Congress for more Israeli aid, also with no strings attached.

Somehow we are spoon fed the idea these wars are a national security risk to the US.

Actually, it’s our meddling that’s a security risk.

Some challenged the notion the settlements are illegal. But the international community including the US admits they are illegal.

United Nations Security Council Resolution 2334 of 2016, which passed 14-0 with the United States abstaining, declared that Israel’s settlement activity in the occupied Palestinian territories, including East Jerusalem, “has no legal validity and constitutes a flagrant violation under international law”, and demanded that Israel “immediately and completely cease all settlement activities”.

There is another issue here. Under the Nonproliferation Treaty, the US can’t supply aid to countries that have nukes and haven’t signed the Nonproliferation Treaty. Thus, it is illegal to give aid to Israel. But, our corrupt bought off politicians look the other way. Israel has the US trained like an abused puppy.

Regarding the “illegality” of Israeli “settlements,” several points:

  1. Declarations of the UN have the moral authority of its member states, which include criminal states such as Iran and China along with every Third World pesthole (I’m being polite) on the planet.
  2. The last prior occupant of Judea and Samaria with a reasonable legal claim was the Ottoman Empire. The Ottomans lost their empire at the end of World War I.
  3. Prior to 1948, the Etzion Bloc of four kibbutzim, established between 1943 and 1947, existed near Jerusalem and Bethlehem, where Jewish “settlements” are now deemed illegal.
  4. When Israel declared independence in 1948, the Jordanian army (the Arab Legion) invaded. The Etzion Bloc had been under siege from Arab irregulars since 1947. In May 1948 Kfar Etzion, the outermost community, surrendered to Arab forces, after which Jewish inhabitants were massacred. Other villages also surrendered.
  5. By the armistice in March 1949, Jordan’s Arab Legion had seized what’s now called the West Bank. As this was a war of aggression, Jordan never gained legal title to the territory.
  6. In 1967, Jordan joined other Arab states in another war against Israel, at the end of which Israel controlled Jerusalem and the rest of the area west of the river.
  7. In 1988, Jordan formally renounced any claim on Judea and Samaria, ceding it–without legal authority–to the “Palestinians.” In doing so, the kingdom stripped this population of Jordanian citizenship.

On what basis can anyone assert that Israel’s control of Judea and Samaria (and hence its “settlements” there) is illegal? The last legal owner was the Ottomans. Jordan was never legal sovereign. Israel gained control in a defensive war.

UN Resolutions do not have the effect of law. They are mere suggestions. If so many countries and world leaders feel that the Israelis settlements are illegal, then someone should have taken them to court and gotten a valid judgement by now.

But of course, even were that to happen, the next question would be how to effect enforcement.

There isn’t a world police force or army capable of enforcing ICC rulings. If there were, then surely it would have been deployed against Russia when they annexed Crimea in 2014 and then invaded Ukraine in 2022, both of which are illegal.

If it was actually true it would have been adjudicated thusly long ago. Instead these settlements are illegal under international opinion, and opinion is not law. The security council is not a court of international law. The resolution you refer to has no action attached it which means it’s just another expression of international opinion.
Please show me any binding ruling in any adjudicating body such as the ICJ and I will concede my error.

Israel’s rights are set in stone by the San Remo resolution of the League of Nations, which like all League of Nations resolutions, are binding without the possibility of revocation, on its successor organization, the United Nations.
Israel can choose to cede land for a Palestinian Arab state but is not bound to do so. It is bound to let people live in their homes, own property, and practice their religion – not to give them citizenship or a vote. That’s what “civil and religious rights” means as per said San Remo resolution and the Balfour Declaration which was its impetus and which was the sole purpose of the British Mandate for Palestine.
Even in 1949, the UN made no mention of any additional Arab state west of the Jordan River.
And these are the facts which deter anyone from actually bringing Israel to court over their sovereign rights west of the Jordan. A ruling based on law would kill any possibility of the international community bringing its opinion to bear against Israel.

As far as international law goes…it seems to only be relevant when the world superpowers want to use it as leverage. International law as a concept is great for “rule of the seas” and perhaps international transport standards….but for everything else, its useless. The whole settlers in the west bank thing seems pretty synonymous with third world central/south americans invading the US border to settle here. And that’s exactly what Iran is doing, with those billions that Obama and Biden have dropped in its lap. If some arms shipments from the US delay the Islamopaths for a bit, it’s money well-spent. Too bad Biden doesn’t have the guts to take out the Iranian regime. Obama had the chance and ignored the Iranian people.

So Israel is the only thing keeping Islamic terrorists at bay? That’s a truly laughable statement. If Israel disappeared tomorrow it would have zero effect on the rest of the world in terms of terrorists or Islam conquering countries. Next thing you’ll be saying Ukraine is the only thing keeping Russia from conquering the rest of the world.

The bible tells Christians to do the same thing. Until very recently (last hundred or so years) the favored Christian method was by the sword too.

Only a very small minority in both religions favor ‘forced conversion’. In fact there are plenty of Jews living in Iran today who aren’t being forced to convert to Islam.

8300 Jews out of a population of 81 million live in Iran. Nearly 250,000 Jews with Iranian ancestry live in Israel, and 60,000 live in the US. Khomeini was a big supporter and adherent of the Mufti of Jerusalem, Hajj Amin Al-Husseini, who collaborated with the Nazis during a stay in Germany 1941-44. Your ignorance is profound.

She was the architect of the Ukraine war and thus is either getting out of Dodge before the whole thing collapses or was fired and will be blamed for this catastrophe. May nasty Victoria get all she deserves and more.

Biden is not just giving the presidency to Trump, he is gift-wrapping it also. The democratic base is abandoning their party because Biden, with powerful democrats, is supporting and protecting the crime of crimes, genocide.

It will not matter to voters in November that Trump will be portrayed by pundits as incrementally ‘worse.’ US arms-running to bloodthirsty Israeli fascist totalitarians is bottom-of-the-barrel already.

Trump will only be perceived as just as bad as Biden’s ilk, democratic voters will stay home or vote for Cornel West. It won’t even matter if WW III is raging by September, Trump will win in a cake-walk.

Israel may be winning the war on the civilian population of Gaza, but, it is losing the war against Hamas. Hamas is growing stronger everyday with the Israeli attrocities. When your child or family is butcher by the IDF, Israel has just recruited more soldiers for Hamas.
