ICE Tells New Recruits to Violate the Constitution. Time to Impeach Noem

I’ve seen enough. Impeach Homeland Secretary Kristi Noem.

In very damning testimony, former ICE attorney Ryan Schwank Told Congress why he resigned. “I swore an oath to uphold the Constitution when I joined ICE…I followed it when I resigned…The legally required training program at the ICE academy is deficient, defective, and broken.

“On my first day, I received secretive orders to teach new cadets to violate the Constitution, by entering homes without a judicial warrant. For the last 5 months, I watched I dismantle the training program, cutting 240 hours of vital classes, classes that teach the Constitution, our legal system, firearms training, use of force, lawful arrests, proper detention, and the limits of officer authority . “

Calm down, Mish. It takes a two-thirds majority vote to impeach someone in your Congress, doesn’t it? I don’t think you would be able to get it.

I never thought I would find myself defending policemen, but is all this anywhere near as bad as what your government routinely did under the Democrats, stealing elections, raiding Trump’s house, concocting stories like Russiagate? For that matter, is it as bad as taking five-year-old children from their mothers and putting them into government institutions to be lied to and corrupted by public servants?

Rough-and-ready (or is that an Australian expression?) policemen may not be the best thing in the world, but they aren’t nearly as bad as corrupt teachers, corrupt judges, corrupt journalists. And how many journalists are there in the English-speaking world who don’t work for corruption? The teachers and judges are required by the terms of their employment to forward corruption. So are the policemen.

This can be somewhat easily proven or disproven. Single source information like this is a sure fire way to get bamboozled.

Don’t let your bias close you off to conflicting info. What have other ICE trainers said both current and former? Did you ask?

I think this is just a confirmation of the policy that we have witnessed in real life over the last several months.

This isn’t some weird mysterious conspiracy theory. This is documented fact that the Constitution is no longer operating, not just ICE

I’m more concerned whether it’s true or not. We need evidence, not stories feeding confirmation biases leading us around by our noses.

If we learned nothing else from covid, it should have been that.

Who is not gonna run from these guys. Especially if you are brown. Whether you are guilty or not you are probably going to spend 6 fun filled weeks in a Texas holding centre while things get sorted out meanwhile your job is likely gone and you are likely homeless because your rent won’t get paid.

Speaking of ICE, if you go to the US “Occupational Employment and Wage Statistics” page found here:

And look at the Sanctuary States, such as California, New York, Washington, Minnesota, you’ll notice that the biggest “employer” is the hard to verify “Home Health and Personal Care Aide”. On the other hand, go to Florida, Alabama, or the majority of states, and this category of worker doesn’t even show up in the top eight. Subtracting all Sanctuary states, even more lopsided. Federal dollars funneled to fraud, courtesy of Democrats.

For those of you who don’t know, Tammany Hall was the most corrupt political institution in US history, widely acknowledged by historians.

“Founded in 1789, it functioned as a “boss-driven” organization that gained immense influence by providing social services and jobs to immigrants and the poor in exchange for consistent voting loyalty.”

The immigrants used to be vetted legal immigrants back then, but they have dropped that pretense.

The stats you quote just show these blue states actually count their workers and make them pay payroll taxes. The red states you choose pay illegal immigrants under the table so there is no one officially employed for which to list these occupations LOL

In California, people who provide home healthcare for their own family members in their home are paid and are counted as home care aides. Not the case in Florida, which takes advantage of the great people who take care of family members who require care.

I agree in principle, but these SOTU stunts are ridiculous. I pay no mind to Democrats remaining seated as much as those on the other side of the aisle who are standing. Judge them by what they do, not what they say. Few are putting Americans first.

4th Amendment:

“The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”

If DHS thinks they have a solid argument that an administrative warrant is sufficient, they should expedite it to SCOTUS. I don’t exclude the possibility that the court could say the 4th amendment doesn’t specifically require a judicial warrant – just that there be probable cause supported by oath or affirmation. I’m no lawyer and don’t know all the case law, but from the plain language, DHS’ stance isn’t facially invalid.

Strange, I wasn’t aware the 4th applied to illegal aliens, nor do you need a warrant endorsed for night service to detain and arrest an illegal alien in public or while chasing the fleeing identified/suspected illegal alien into a “home” or barn under exigent circumstances while seizing his or her papers an effects. .

I agree with you, they need to arrest and deport the illegals. However unless they are actually chasing an illegal then the requirement that they obtain a judicial warrant to enter private premises that they believe or know has an illegal should still apply. Otherwise the slippery slope will erode the 4th amendment. And you know the Dems will use that same slippery slope to evade the 4th when looking not for illegal aliens but illegal guns.
So instructing ICE to intentionally ignore the 4th or other parts of your constitutions is grounds for impeachment.
The irony is Biden and company should have been impeached for ignoring the constitutional requirement for a secure border so now ICE is ignoring the constitution to fix a mess caused by ignoring the constitution

The assertion that Noem and DHS have been “instructing ICE to ignore the 4th” depends upon whether the 4th even applies to illegal aliens and whether it mandates judicial warrants. Those things aren’t clear to me. If the court rules that the 4th doesn’t apply to illegal aliens or doesn’t mandate judicial warrants, then Noem hasn’t done anything worth of impeachment.

With an administrative warrant, the resident must consent to the agents entering the premises. If the resident lets them in, then I would assume the agents are free to make an arrest.

I don’t know whether the 4th Amendment applies to illegal aliens. It would be interesting to have the Supreme Court rule on that. They could also then address the purported necessity of a judicial warrant.

The 4th applies to “the people” here legally, by birth to citizen parents, not illegal aliens or their children born here or not. Nor is the dancing with Miranda rights requirement required before interviewing a “suspected ” illegal alien over their identification and immigration status.
