Supreme Court Rules 7-2 Against Trump on Alien Enemies Case

The Supreme Court gave Trump a much-deserved smack in the face today.

Another Case Lost, This One in the High Court

Trump is howling tonight. But those who expect laws to be followed are cheering as the Supreme Court Rule Against Trump on Alien Enemies Case.

In a 7-2 decision, the court said the Trump administration had not given the detainees enough time or adequate resources to challenge their deportations.

“Under these circumstances, notice roughly 24 hours before removal, devoid of information about how to exercise due process rights to contest that removal, surely does not pass muster,” the ruling said.

The justices barred the removal of the men, who the Trump administration alleges are members of the Venezuelan gang Tren de Aragua, pending a new decision from a lower federal appellate court.

But “the Government may remove the named plaintiffs or putative class members under other lawful authorities,” they wrote.

President Donald Trump raged against the ruling later Friday afternoon.

“THE SUPREME COURT WON’T ALLOW US TO GET CRIMINALS OUT OF OUR COUNTRY!” he wrote in a post on Truth Social.

The court in its ruling acknowledged that the Venezuelans’ interests are “particularly weighty.” It noted that the government is currently arguing that it cannot “provide for the return” of Kilmar Abrego Garcia, “an individual deported in error to a prison in El Salvador.”

The Supreme Court has just ruled that the worst murderers, drug dealers, gang members, and even those who are mentally insane, who came into our Country illegally, are not allowed to be forced out without going through a long, protracted, and expensive Legal Process, one that will take, possibly, many years for each person, and one that will allow these people to commit many crimes before they even see the inside of a Courthouse. The result of this decision will let more CRIMINALS pour into our Country, doing great harm to our cherished American public. It will also encourage other criminals to illegally enter our Country, wreaking havoc and bedlam wherever they go. The Supreme Court of the United States is not allowing me to do what I was elected to do. Sleepy Joe Biden allowed MILLIONS of Criminal Aliens to come into our Country without any “PROCESS” but, in order to get them out of our Country, we have to go through a long and extended PROCESS. In any event, thank you to Justice Alito and Justice Thomas for attempting to protect our Country. This is a bad and dangerous day for America!

Has Trump sealed the border or not?

The law allows challenges. Trump doesn’t give any. So this is a clear case, without even commenting on the merits of the case.

The idea that immigrants are an “invasion” is of course nonsensical in and of itself.

I expect Trump to lose that case on merits.

Trump has taken so many extreme positions on everything. Before I saw this ruling I had this conversation on X.

Me: John, let’s assume you are 100% correct. The remedy is pretty damn simple isn’t it? Have you ever heard of the appeals court? Q: Why was Trump so damn stupid as to fire people without giving the required 60 day notice? Why shouldn’t an order like that apply to the country? Now look at deporting the wrong person. Trump says there is nothing he can do about it. There is no remedy for the person wrongly deported. The remedy in advance is to stop such events from happening. And if Trump doesn’t like it, he has an easy remedy (appeal). Birthright Citizenship cancellation is so error prone I suspect the Supreme Court will now rule against him on these blanket judicial rulings. It is what Trump 100% deserves for taking so many extreme positions. You are a bright guy. I can’t understand how you don’t understand the view I just stated.

Synopsis

The reason two-thirds of all universal judicial injunctions in U.S. history have been used against President Trump is Trump has flouted broken the rules and flouted the constitution more than any president in history.

For those who may not know, Biden is number two. Republicans also took advantage of the court system by case shopping, and Biden lost.

The remedy if for Republicans and Democrats to stop making absurd laws by executive order.

Congress, not the president has the power of the purse. And Trump cannot change the Constitution at will as he tried to do with Birthright Citizenship.

This case is not about keeping criminals here, it is about stupid executive orders that led to a sensible ruling.

The Court gave Trump a smack in the face. Trump deserved it. And more slaps are coming.

My Suggestion Months Ago

I made a suggestion several times after Trump was elected: Work out a deal with Democrats to remove the 1 million criminals with existing criminal warrants. In return, grant amnesty to the so-called “Dreamers”.

I believe Democrats would have gone along with this. We would have had cooperation instead of resistance.

Businesses could breathe a sigh of relief, especially construction, agriculture, hotel cleaning, and fast food services.

Trump’s interview on Meet the Press sounds exactly like the deportation strategy I proposed.

Partial Interview Transcript (Emphasis Mine)

What about dreamers, sir? Dreamers, who were brought to this country illegally as children. You said once back in 2017 they, quote, “Shouldn’t be very worried about being deported.” Should they be worried now?

President-Elect Trump:
The dreamers are going to come later, and we have to do something about the dreamers because these are people that have been brought here at a very young age. And many of these are middle-aged people now. They don’t even speak the language of their country. And yes, we’re going to do something about the dreamers. And — 

Kristen Welker:
What does that mean? What are you going to do?               

President-Elect Trump:
I will work with the Democrats on a plan. And if we can come up with a plan, but the Democrats have made it very, very difficult to do anything. Republicans are very open to the dreamers. The dreamers, we’re talking many years ago they were brought into this country. Many years ago. Some of them are no longer young people. And in many cases, they’ve become successful. They have great jobs. In some cases they have small businesses. Some cases they might have large businesses. And we’re going to have to do something with them.

You want them to be able to stay, that’s what you’re saying?

President-Elect Trump:
I do. I want to be able to work something out, and it should’ve been able to be worked out over the last three or four years and it never got worked out. You know, Biden could’ve done it because he controlled, you know, Congress to a certain extent, right? He could’ve done something, but they didn’t do it. I never understood why because they always seemed to want to do it, but then when it comes down to it, they don’t. I think we can work with the Democrats and work something out.

What Happened?

Trump did not opt for a deal. He deported people by mistake. He claims he cannot remedy his mistake.

Had Trump opted for a deal, we would be on our way for deporting millions. Instead, Trump opted to throw read meat to the hyenas screaming to deport them all even though that would have led to an economic collapse.

The smart thing to do was go for two bills, not one big monstrosity.

A dreamers bill coupled with ending the silliness and fraud DOGE discovered would have gotten the administration off on the right foot.

Instead, Trump is losing case after case in the courts and now Trump’s Big, Beautiful Tax Bill Dies in Committee

Trump blames the courts, he blames Senator Rand Paul, and he blames GRANDSTANDERS’ in the Republican Party” for all his woes.

Trump needs to look in the mirror to see his biggest problem, himself.

A reader commented “You must be happy. The fifteen+ million illegals will get to stay since it will doubtless prove procedurally impossible to deport them.”

No! I am happy about the ruling but unhappy with where we are.

There are 1 million or so criminals with warrants that should be deported. There are also 12 million or so people hard-working who should not be living in fear of being deported.

So, the whole damn thing stinks.

And yes, Biden created this mess. But Trump has to deal with the hand he is dealt, not try to turn the clock back 4 years.

The economy will not collapse. Just another scare tactic. We as Americans will have to adjust, we may not like not having what is basically an indentured service class, but we’ll have to get after it again. We didn’t collapse after the civil war, so I’m sure we can weather this. BTW – once everyone illegal is gone, we can bring some or many of them back legally and pay them a living wage (imagine that).

That’s an interesting view given that so many people here were whining under Biden about just that happening. But please explain why MAGA business owners keep hiring illegals if there is plenty of legal labor in this country? Why is Trump promoting “taking care” of illegals in farms and hotels?

Back in 1865, we didn’t have 80 million socialists collecting social security and medicare either. In order to get rid of all the illegals you need to get rid of all the social programs, no one wants to do that especially the receivers of those benefits.

Trumps first election win was based on him stopping illegal immigration.

Trump promised all of us that he would build a wall and Mexico would pay for it.

Instead of executing his promise to the American people, trumps tariffs on Mexico did nothing but drop the stock market by 20% and put the first match to the inflation fire.
To be clear, Illegal immigration was rampant during trumps first term and he failed to keep his campaign promises.

Does he take responsibility? Of course not.

Trump now wants to ignore his failures and disregard the law and the constitution he promised to defend. Get rid of trump. He is dangerous to the rule of law.

Lots of angry comments in this post but I think it’s important to recognize why illegal immigration “issue” is never fixed. I am re-posting this link to this article below. The owner of the chain of restaurants in the article below is a big MAGA cult fan. He owns the restaurants and employs a ton of “illegals.” He employs so many “illegals” that the restaurants had no cooks in any of his restaurants when ICE showed up.

Let that sink in very deeply. Multiply that MAGA clown owner x 1 million restaurants, hotels, construction sites, etc.

At the instruction of managers, restaurant employees without legal citizenship status left the premises at The Diner, Honky Tonk Central and Kid Rock’s Big Ass Honky Tonk Rock N’ Roll Steakhouse during a primetime rush on Saturday night to avoid detention by ICE agents. Locations, already struggling to provide full service, suffered through at least Sunday due to fears from employees who did not want to risk arrest by returning to work.

Lastly, if you want to be pragmatic about the whole situation, the best thing to do if someone is “invading” your country, it is to “invade” their country and leverage their environment.

Eisenhower had a mass deportation. The economy survived. Obama deported some 3 million. The economy survived. We survived before Biden’s influx of illegals. Sanctuary City Los Angeles has sky high rents. MediCal is billions in the hole, with illegal aliens on the rolls. As far as angry, black Democrats in Chicago were not happy with illegal alien influx affecting their access to city services. Democrats didn’t want them at all in swanky Martha’s Vineyard. Democrats sure can be bigots, can’t they, when it affects them negatively.

Mish, Really grant immunity to how many? Ellis Island had 13.2 million “legal immigrants” over 62 years. Biden allowed 13+/- million enter over 4 years. Ellis Island immigrants changed the face of our Nation at a time when we needed workers to fuel the industrial revolution. What will these new arrivals do for work in an economy where jobs are already being lost to AI?

Mike, Who did these jobs 5 years ago? We used the have Dry-Waller’s from South Central Los Angeles, no longer. We used to have sewing factories in Los Angeles, no longer. So our economy is functioning at such a high level as of late that we need 13 million additional laborers to support it?

Mike, I love your insights and have been reading your post for like 10 years or more. You call people who want to see deportations “Bigots”. You like economics right? Did you know the Mexican Cartels were charging $10,000 per person to cross into the United States? The Cartels has control of their boarders and reaped big economic rewards. I don’t know how many of these illegals are skilled labor and are currently working in the construction industry, but as I said 1 day ago – have we really created that many new jobs in the last 4 years? You know the labor pool numbers and employment probably better than anyone. Would really like to understand your thoughts better on this one.

I could not disagree with Mish more about illegal immigration. It’s one of the few issues that Trump has broad popular support. The democrat strategists threw the doors wide open for illegal immigrants in order to skew the electorate left long term. It is cynical and unamerican and it needs to be rectified.

And there is no comparison to the illegals, migrants whatever the hell they should be called, no comparison between them and most that came into Ellis Island way back………The people today are coming in saying gimme gimme my free shit, and then do not seem to want to assimiliate . Mish – I’m of Hispanic heritage, first generation American and fully supportive of Trump administration actions on deportations. With all the arguing going on with “procedures and legal maneuvering “,the fundamental point is lost. Illegal aliens are here Illegally! They should be egressed in the same manner they ingressed – swift and without notice. If they wish to come back at some point in the future, they can do it Legally as my parents did 80 years ago. As for arguments they are hardworking, I agree but that point is moot, based on fundamental illegality of the individual.

However, now that the supreme court has foolishly ruled the way it did, I suggest you and your liberal cohorts around the country allow these individuals and families into your homes and host them until their due process is exhausted. If you care that much about them, let’s see you act on it. Show the rest of us “heartless bastards” what salt of the earth people you are.

Many of these construction and service jobs are going to disappear -maybe very soon. Subsidies and payments to immigrants are already disappearing. Are you among the very few who lived behind a very large wall in a gated community who will be protected from 20 million, angry, hungry, entitled illegals who will no longer have job when the American Ponzi scheme bubbles all burst. We will have to pay the price for the great American reset– it will be a reset of our own making or the Great Reset as envisioned by Klauss Schwab and the WEF. The party is over for America and the West. We are becoming less and less relevant both financially and military. Empires fall. Our empire is being taken down both by the rest of the World and especially from within. Hopefully we have a few more years to get ready for the inevitable changes and adjust. America and Europe need to start that adjustment process now. It will be painful, but it must be done. I believe removing at least half of the illegal aliens is a necessary part of that adjustment.

If every time we get a democrat administration and 20 million illegals are allowed to rush the borders, become entrenched here, use the medical system, food stamps, drive w/o insurance, commit gang criminality and generally destroy our 1st world society and then when we attempt to deport them, they have to be adjudicated one-by-one in a court system with an 8 year backlog of immigration cases, this country is OVER.
Trump should deport them and let SCROTUM/SCOTUS cry like babies.
Save the country and defy the court.

You can’t simply defy the Courts, or what you do, will be quickly reversed in many cases, if not most. You need to fight against it in the Courts, but with “Properly Written “ legislation to reverse it. It takes time, oh well, it’s the way to do so…

mish you have a real sense of bias and pontificating without a full deck of cards for example, The scotus did not say the AEC could not be used. it ruled on providing time for accused to defend themselves and obtain resources to provide one’s defence. Good luck on that as you have seen with immigrants claiming amnesty or has you forgotten ?
Trump does not flaunt the constitution he uses the legal process to determine its constitutionality. A big difference to rational individuals. Birthright has 3 exceptions and the administration is arguing for fourth. the precident allready exists.

The Court system needs to be put in it’s place. They don’t follow the Constitution anyway. I’ve been lawyer for over 30 years. Too many Judges laugh at you, roll their eyes and look at you like you’re crazy when you try to make constitutional arguments. They call it stare decisis– precedent. Affirming decisions that for 40 years ignored or marginalized the Constitution. I tell people all the time that we live in a post-Constitutional society. You are allowed freedom of speech when the government says so. The First Amendment is for all practical purposes, a relic of the past. The last 4 years of censorship and cancel culture demonstrates this. I could make a good case for this for most of the other amendments in the Bill of Rights. So let’s all follow the Constitution to the letter of the law when it comes to the immigration invasion, but ignore it in all other areas that are important to most basically conservative Americans. I don’t buy that anymore.

There is something missing from this. ICE has always rounded up and deported illegals throughout all administrations. Is it now bad because Trump is doing it? I am with him on this one. Does this ruling mean no one can now be deported without a trial?? This makes no sense. There must be some more clarity on how the process is carried out. Perhaps this applies only to illegals in the process of waiting for a court hearing already. No way can this apply to all, no other country does this. Also why the F aren’t the supremes making a ruling on the patriot act where the govt nazi’s can detain a US citizen indefinitely without due process or even giving their families an explanation. This is when they deem you en enemy of that state. Unbelievable.

BTW I have heard that in the metro detroit are where I am there have been numerous roundups of illegals working. That really makes no sense either. I thought it was primarily the riff raff being jettisoned. They need to fix this with legislation. Those coming here and working should be given an expedient process for citizenship if they want. As long as they are working and contributing by paying taxes they should be left alone. If they commit crimes they need to go to jail or deported.

Problem with SC overly political. No one disputes they are not citizens and weren’t in the country legally. So does SC focus on those simple facts which has much broader national implications since our court system isn’t designed to and cannot deal with millions of case involving illegal immigration case challenges. No.

In a 7-2 decision, the court said the Trump administration had not given the detainees enough time or adequate resources to challenge their deportations…

Mike, for the most part I do agree with you. But can you comment on why Trump was not trying to send illegals back to the country they came from? Is that because they were accepted under the definition of a refugee and granted refugee status? That seems to be the most abused area here. And yeah I guess that has to be adjudicated too but I have a hard time believing illegal mexicans or guatamalans are being persecuted in their own country.
It should be simple, you want to come here to make a better life for yourself and family, issue them a temporary visa for 1 year and let them prove it. And oh BTW you have to learn english. The EU has this language mandate in place and so does Russia of all people.
And the American government is going to have to grow in order to handle this disaster properly. Just what we need, more lawyers

Wouldn’t surprise me. Like 2016, Trump is all hot air and little in results. I have low expectations for him. Still far better than Biden, but maybe not, because if he doesn’t get things done that need to be done, we will have a Biden clone back in 2028. If he keeps us out of war and more debt regarding Russia and Iran, then he will have accomplished something very significant. I don’t think he will deliver on immigration. I asked Grok a few days ago how many illegals he had deported so far, and the figure was like 130,000, and still 6-7000 can come in every month. If you give citizenship to dreamers, their parents move to the front of the citizenship line because family reunification is the number 1 criteria for citizenship. Once those parents get their citizenship, the rest of their family moves to the front of the line, This results in mass amnesty for millions of illegals. A better approach is a deal where dreamers get citizenship but their parents do not, I have read the Democrats reject this.

Until recently it was frowned upon socially to receive welfare. Think what you want about that but on the whole I think it better that way for society. So taking a handout of any kind was a mark against personal pride. That motivated people to work hard at not being in that position. The level if handouts back then us nothing like now.

You have to examine the statistic of “deportation”. Does that include deporting those who are apprehended in a “border encounter”.

So in the case of Birdbrain Biden administration, there were 11 million “border encounters”, and how many of the 4 million that Biden “deported” were from those 11 million ?

Did Biden administration engage in raids or arrests of illegal or undocumented immigrants in America towns and cities such as Chicago or Los Angeles ?

Seems like Trump is doing that, as they just made a major bust of immigrants at a night club in Colorado Springs.

Agree with Mish that “one giant bill” was a dumb idea. Establishment GOP hack Hugh Hewitt wanted one bill because he didn’t want to risk not getting the 2017 tax cuts extended. Nothing is ever more important than tax cuts to these people. Regarding deporting criminals, we now know that 24 hours to challenge their expulsion isn’t enough. Hopefully the administration can come up with an expedited process. SCOTUS didn’t decide whether invoking the Alien Enemies Act was/is valid. In his concurrence, Kavanaugh said they should have.

When the courts can not distinguish between rights, privledges and those that have stolen priviledge to be in the country the system is dead. ‘We don’t want to detain them – we want to send them back to where they came from’ Luckily, now Trump can communicate with the Supeme Court with the middle finger and tell the court that they don’t have the house and they lost any respect the PRESIDENT(executive) had for the courts. It was over for the USA (and Europe and the Anglo nations) when Marxists allowed tens of millions of illegal aliens with cultures that not only conflict but which are hostile to the values of our former republic and on a larger scale-Western Civilization. This of course was done intentionally and with full knowledge of what the consequences would be by our beloved oligarchs who have carefully planned and executed their strategy.

The Constitution has been selectively applied only in cases where the results are detrimental and in fact destructive to Western nations. So now with 30-50 million illegals in America, we will now be bogged down in the courts and administrative processes to perhaps remove maybe 1% of the illegals over the next 4 years, while probably multiples of that amount continue to filter in. Talk about national and cultural suicide. It’s happening. Nothing can stop it.

Russia, China , Iran-in fact almost any other non-Western country– do not have this problem. They address such immigration problems like any sane nation would do-prior to the problem becoming a terminal affliction. They protect their citizens and their country and culture. Such countries will continue to prosper and grow, while the West slips into irrelevance and economic and cultural decay. As Americans and the West go forth boldly into their self-imposed DeFacto civil war of hatred, conflict and war between and amongst ourselves, our “enemies” will reap the benefits of the final decline and eventual fall of Western Civilization.

At least the Trump haters (and I am no Trump lover) can take satisfaction with the victories their Team will enjoy in putting 47 in his place.

Your suggestion is interesting, but between quickly deporting one million criminals (it’s a much lower number probably) and granting amnesty to Dreamers are twenty+ million illegal aliens. Since he cannot deport the hardened criminals, they will all remain so medical, municipal, educational and criminal services will suffer greatly since so many are unskilled and dependent on handouts.
Congress is dysfunctional; the Courts are mainly good for blocking Executive actions; So Trump 2.0 is blocked like Trump 1.0.

US has been a post-constitutional republic for some time, but few have the wit to grok it.
