All these problems will lose him a lot of votes in the Senate. …. The Senate is trying to stay open because President Obama tried to do this too, and appoint a lot of officials when the Senate was not in session. So now Trump is looking at this new provision that’s never been used before which is if the House and Senate disagree about adjourning, the president can adjourn, and that would create a recess. This has never been used before.
Fox: So in your opinion, he should not be confirmed.
Yoo: If I was a Senator, I wouldn’t vote to confirm him. President Trump would be making an unforced error to recess appoint because it would actually slow the kind of reforms he wants to execute at the justice department.
Fox: Has the judiciary been damaged because of all these charges against Trump?
Yoo: I think that the state court judiciaries in New York and Georgia have taken a big hit to their reputation, especially the courts in New York City. People have to ask is the rule of law effective in New York City. The Federal courts, I think the outcome was better because the Supreme Court of the United States accelerated the case, took review, granted the president immunity, and essentially tried to shut down the lawfare that was being conducted by the Biden justice department and the special counsel. The New York courts, their reputation has taken a serious hit because of Judge Merchan, letting this case go forward by Alvin Bragg on tissue thin accusations and serious problems that will lead to the conviction being overturned on appeal.

Compare the above thought process and understanding of the department with the pathetic qualifications of Gaetz.
Gaetz is woefully unqualified for the job. He only practiced for two years in a small law firm in tiny Fort Walton, Florida. He went into politics two years after law school, getting elected to vacant seat in the Florida state senate.
There’s no indication he ever practiced law after that. And he has no sense of what can be done.
And Gaetz has never run anything. Look at House infighting making a farce of their budget demands.

A House Power Grab is underway.
In naming a set of unconventional nominees to run federal departments, Donald Trump this week also took steps to push for a broader goal: realigning the balance of power among Washington’s major institutions so that more authority flows from the White House.
Senate Republicans signaled that Matt Gaetz, the president-elect’s pick to lead the Justice Department—one of the most sensitive jobs in Washington—would likely fail to win confirmation because of sexual-misconduct allegations and his antagonistic tactics that alienated colleagues.
The Constitution says that if the House and Senate disagree on when to go into recess, the president has the power to force them to adjourn. Under one scenario, House Speaker Mike Johnson (R., La.) could speed to the floor a measure to adjourn both the House and the Senate. If the Senate disagreed out of fear of the president making appointments in its absence, Trump could adjourn both chambers anyway and proceed with placing his choices in office.
It is unclear whether such a maneuver would be legally sound. But in a federal government with total Republican control, the only barrier could be resistance from enough Republicans like Rep. Mike Simpson (R., Idaho), who said he wouldn’t go along. “The Senate has a job to do,” Simpson said in an interview Thursday. “The recess-appointment procedure was not meant to avoid that process in the Senate, at least to intentionally avoid it.”
Legality of the Idea
The above paragraphs were the subject of an email discussion between a few of my friends.

The Constitution gives the Senate the power advise and consent, consistent with the system of checks and balances which is the foundation of the entire constitutional system That great responsibility was not put in place, just so that it can be subverted at will.
Recess appointments were written into the Constitution at a time when communication was slow, travel was by horseback, and Congress did not meet virtually continually as it does today.
I think that any attempt like this would be taken up quickly by the Supreme Court.
The Constitution is clear that the Senate has the power to advise and consent and that cannot be taken away by a willful act by the very person relative to whom this Senatorial power was intended to balance.
The last sentence above is critical, and it shows very clear thinking. However, we do not know how the Supreme Court would rule.
The intelligent person hopes we don’t find out or Trump is smashed if we do.
Trump is unwisely out for revenge, picking an inexperienced clown for the job. To address lawfare, Trump wants more of it.

Trump’s instincts, honed by years of media infighting in the biggest market in the country, New York, are essentially good. He recognizes that the names you want on your marquee are not necessarily the biggest stars, but those who best serve the screenplay and the message you want transmitted. In Trump’s case, his message is Be Loyal To Me and his screenplay is the take-no-prisoners approach of Apocalypse Now.
His two most important choices for his cabinet will be AG and Def Sec. The Attorney General looks iffy on paper, but it is crucial for Trump that he have the solid backing of his own legal team. He knows how important lawyers are in the scheme of things. His Defense Secretary is slightly less iffy, but a Fox news host? Really? How intriguing! Perhaps Trump was staying up late nights, munching donuts, watching current and rerun Fox episodes to get a feel for where the hosts stand on issues. Perhaps he wants entertainment value in his cabinet. You can’t blame him for that.
Ultimately, what serves the American people is what quells the nervous vibes of their president. President Trump will be calmed by being surrounded by loyalists who are entertaining at what they do. Unable to stand the mediocrity of the written word, Trump will be ever-more a visual President during his second term in office and dedicated more to PowerPoint presentations than dense treatises of text. Good luck, Trump. You’re gonna need it.

And as an attorney who also only practiced for a couple years I can tell you you dont need to be a practiced attorney to fill the slot of the AG. Would it be better if he had some more gravitas? Yes. Compared to John Yoo, Gaetz is more than qualified and Yoo is a beneficiary of a corrupt DOJ system that has gone unreformed for more than 40 years. Would Yoo fixed the DOJ, or perpetuate the problems?
Perhaps Mish forgets that Yoo is the one who wrote the memo authorizing torture of prisoners during the Bush era? Perhaps he forgot that Yoo was indicted in Spain for war crimes? Perhaps he forgot that when OPR recommended that Yoo be referred to the bar association for disciplinary action, Margolis quashed the referral even though he found Yoo’s opinions were wrong and flawed, and that Yoo exercised poor judgment. Yet Yoo was never once punished for his actions. Everything was quashed, which is par for the course in the DOJ. If one is part of the club, any wrongdoings are whitewashed. If outside the club you end up prosecuted like Trump was because federal statutes are so overbroad and vague everyone can be prosecuted if someone in the DOJ decides they don’t like you.
I might not like Gaetz, but I am certain he would shake things up at the DOJ and that is long overdue. Name someone else who would shake things up?
