A Properly Worded Bill
A properly worded bill would require those with penises to use the men’s bathrooms and locker rooms and those with vaginas to use women’s bathrooms and lockers.
Fathers, do you really want biological women, now with penises in your daughter’s locker room.
Sports a Different Issue
Sports is a totally different issue.
Biological men do not belong in women’s sports no matter what parts they currently have.
How Many Sexes Are There?
The answer to that is two, male and female. However, there are cases where genetic combinations are ambiguous.
Typically, females have two of the same kind of sex chromosome (XX), and are called the homogametic sex. Males typically have two different kinds of sex chromosomes (XY), and are called the heterogametic sex. In humans, the presence of the Y chromosome is responsible for triggering male development; in the absence of the Y chromosome, the fetus will undergo female development, except with various exceptions such as individuals with Swyer syndrome, that have XY chromosomes and a female phenotype, and de la Chapelle Syndrome, that have XX chromosomes and a male phenotype, however these exceptions are rare. In some instances, a seemingly normal female with a vagina, cervix, and ovaries has XY chromosomes, but the SRY gene has been shut down. In most species with XY sex determination, an organism must have at least one X chromosome in order to survive.
Ambiguity, not a third sex.
So let’s resolve the sports issue this way. Only those with distinct female XX chromosomes should play in women’s sports.

Nonbinary things can happen but they are rare. In addition to XX and XY there is also XYY and other ambiguities. That statement does not imply more than two sexes.

I am what I think of as a recreational crossdresser, I like to go out in public dressed as a woman. Just for the fun of it, not to gain access to women’s spaces. But I try as much as possible to avoid ever going into a woman’s restroom. Family restrooms are ideal for this situation. But if there is not a family restroom available I have used the ladies room a number of times. it seems that if a person fully dressed as a woman enters a mens’ room it will create a significant disturbance if there are men inside.
I know several of my grade school pals being SEXUAL predators without even knowing it!

If a woman goes to a mans bathroom and has the pleasure of being in a stall between two men taking a dump with all the wonderfull smell and sounds she will never go in one again. The crux of the so called issue is that sick men want to use the womens bathroom but women have no desire to use the mens bathroom . That tells you all you need to know about this non problem .

The sex determining region of the Y chromosome (SRY) produces a number of effects including the production of male sexual organs. As importantly, it produces chemicals which cause the mother to bathe the fetus in testosterone which both enhance the production of male sex organs and cause the growing brain to produce typical male thought patterns. On occasion, the mother’s body does not respond correctly in this process and does not produce male hormones like testosterone, or not enough of them. When this happens, the baby can be born with anything from less robust male characteristics to same sex attraction all the way to gender dysphoria. Meaning, there are actually humans with with male genitalia whose brain is wired exactly as females are wired (and vice versa as the lack of a Y chromosome has the opposite effect). As an actual father of an actual daughter, I wouldn’t have the least concern of having a male with this situation use my daughter’s bathroom as long as the male was properly assessed by a qualified medical professional. We look back with sadness on the time when white people wouldn’t let black people use their bathrooms. They weren’t bad people, it’s just how they were raised, but we know better now. Our children will look at us this way. I’ve always found you to be a bright, decent guy, and like most, have never been exposed to the right information. Men possess the Y chromosome and women do not have that chromosome so genetically speaking men are closer to male chimpanzees than they are to women. Currently the people who determine these things are the sport’s administrators who often make policies not supported by the players. There was a recent example of woman’s volleyball teams who prefered to default matches in preference to playing a team with a biological male who had seriously injured a female opponent with a spike to the face….
If you’re born with a penis you use the men’s bathroom. If you’re born with a vagina you use the women’s bathroom. No exceptions.
For the rare genetic aberrations such as boys born with no penis then how hard is it to have them use say a the disabled facilities or have some facilities with individual cubicles?
And Mishs objection to having a girl with a fake penis in the girls change room raises the issue that the girl will need a change area not in the boys locker as the boys will know she is a girl and her fake penis can be mentally assumed by many of the boys as being equal to an enlarged clit. I’d be OK with dividing sports into “open” and “female” divisions strictly on XY vs XX.
I’d also be OK with a more specific, “has an SRY gene that expresses and body’s cells are sensitive to that” conditional. XYs with Swyers have no advantage over females in sports. XXs with de la Chapelle do have an advantage.
Either of the above is better than what we have currently, where 5 ARDs like Castor Semenya or Imane Khalif are born XY but their genitalia are hidden internally until puberty (or through their entire life) compete with a huge advantage over women.
If you missed it, in the 2016 Olympics, for the “women’s” 800m race, all three medalists were biological males (all with 5 ARD). Not a single woman was on the podium for that woman’s event in the Olympics. The female Canadian sprinter (4th) and her coach were told they’d be persona non grata in the sport if they complained.
That BS has to end… end it with a strict XX / XY binary or end it with the SRY functionality acid test… doesn’t matter which (somebody will be screwed either way but it’s better than what we’re doing)… but the status quo is no better than eliminating women’s sports altogether.
