What are the charges against Kilmar Abrego Garcia?
Abrego Garcia is charged with involvement in a conspiracy to unlawfully transport unauthorized immigrants. The indictment alleges he was a middleman in an international gang-affiliated ring that smuggled guns and people, moving thousands of migrants through the country for nearly a decade.
The government has said he faces a sentence of up to 10 years in prison per person he transported if convicted. “This is a very, very, very serious allegation,” said David Raybin, a longtime Nashville defense attorney.
What evidence has the government cited against him?
The indictment relies heavily on information from six unnamed co-conspirators to underpin its claims that Abrego Garcia regularly transported men, women and children in unsafe conditions for profit and that he was abusing women he was transporting. Prosecutors also cite traffic-camera images, cellphone data and financial records.
The indictment alleges only one specific instance of involvement in the conspiracy—a traffic stop in Tennessee in 2020 that didn’t result in an arrest—although the government might continue to build out its case.
Prosecutors also allege Abrego Garcia solicited nude photographs from a minor beginning in 2020, although they haven’t brought charges related to this accusation, according to a motion seeking his pretrial detention.
Former prosecutors said the conspiracy charge he faces is rarely brought and usually reserved for the most prolific human smuggling kingpins. Lower-level cases are typically dispensed with through civil enforcement, such as deportation.
What are his defenses?
Defense attorneys will likely argue that Abrego Garcia was targeted for political reasons after the Trump administration accidentally deported him and then refused to bring him back, despite judicial orders including from the Supreme Court. His lawyers could point to statements by senior officials—including President Trump and Attorney General Pam Bondi—demonizing Abrego Garcia, to argue that has tainted any potential jury pool.
“Every time Bondi speaks, she does give ammunition to the defense,” said Laurie Levenson, a Loyola Law School professor and former federal prosecutor.
The evidence prosecutors have presented thus far is heavily reliant on the testimony of co-conspirators whose credibility the defense will undoubtedly try to challenge. At least one of the co-conspirators was incarcerated for smuggling and deported, only to return to the U.S. at a later date.
Another factor that could work in his favor: At least one veteran career prosecutor, who had been head of the criminal division of the U.S. attorney’s office in Nashville, resigned over the indictment. Defense attorneys could highlight his resignation to cast doubt about the Trump administration’s motives for bringing it, former prosecutors said.
What happens next in the case?
Abrego Garcia appeared in court in Nashville on Friday evening. A judge determined that he will be held in custody until late next week, when there will be a hearing about whether to keep him in detention, according to the Associated Press.
Prosecutors are trying to paint Abrego Garcia as a violent gang member with a history of domestic abuse, but a judge could still decide to release him on bond if persuaded that he wouldn’t be a flight risk or a danger to other people. Abrego Garcia has no known convictions in the U.S., held a full-time job as a sheet metal apprentice and has a wife and children in the U.S.
“DOJ is obviously going to push hard to keep him locked up. It would be an embarrassment to them if he gets bond,” said John Fishwick, a former U.S. attorney.
Will he stay in the U.S. if acquitted?
Abrego Garcia entered the U.S. illegally as a teenager, but a judge has since ruled he can’t be deported to his home country, citing the threat of gang violence to his family. If he is acquitted, the government could seek to remove him to a third country but would need to find one willing to take him.
Does his return moot the other court proceedings over his erroneous deportation?
Not necessarily. A Maryland federal judge in April ordered the Trump administration to facilitate Abrego Garcia’s return. Deputy Attorney General Todd Blanche told reporters Friday he believed the government is now in compliance but added, “We don’t know about this.”
Last week, the judge, Paula Xinis, granted a motion by Abrego Garcia’s lawyers to seek sanctions against the government. On Friday, the government said it would seek to have the case dismissed because of his return.
No Reason to Believe the Charges
Last night a friend asked “Did you see the charges against Garcia?”
I replied, no, but I have no reason to believe them. I have now seen them, and as presented by the WSJ are mostly a joke.
No reason to believe them does not mean false, it means just what it says, no reasone to believe them.
And after reading the above article there’s even less reason to believe them, or that he will be convicted even if they are true.

Executive Order 14246 violates settled First Amendment law and its operation must be enjoined in full. Jenner’s motion for summary judgment is granted; the defendants’ motion is denied. A separate order will issue.

There are no reasons to believe the charges against Garcia. But there are plenty of reasons to not believe them.
Trump is petty, vindictive, won’t admit mistakes, targets political enemies, and lied about not being able to bring Garcia back to the US.
Trump has taken many clearly unconstitutional actions on birthright citizenship and targeting law firms.
All of these “deep state” proponents do not believe any charge against Trump but do believe any idiotic claim he makes, no matter how obviously political.
I’ll defer final judgement and let the court decide this. But unless there is a lot more than presented above, I expect Trump will lose.

I guess I do not understand, if he is in violation of this section of the quoted law, why can’t he be put on trial before administrative court and if found guilty by the judge, deported? He would not face prosecution for his alleged crimes other than being here illegally, but he would be appropriately judged for violating enough law to be deported.
I think because he falls under one of the exclusions, which apparently is fear of gang violence in his native El Salvador.
BUT such violence has apparently been ended under the current president, who has incarcerated all the gang bangers in his massive prisons.
So it would appear that Trump could have simply said that his exclusion due to fear of gang violence is no longer a valid reason for asylum in the USA.

I have yet to read any explanation as to what the root is for this supposed fear of Garcias? Was he a member of another gang and was therefore targeted by that other gang in return for violence that the gang HE was with caused on the other guys?
Or was he just a swell, upstanding citizen, trying to live his life in peace and raise a family who for unexplained reasons, was targeted by local gangs?

The United States are not adjacent to El Salvador. He could have petitioned for asylum in Guatemala or Mexico. The injustice of his deportation wasn’t that he was kicked out, it was that he ended up in Bukele’s prison without due process. So, follow any/all legal procedures, but then deport him again – either immediately or after he does prison time in the US. And if the courts still prohibit sending him to El Salvador (despite its now being the safest country in the Western Hemisphere) find another place that’ll take him. Maybe Millei will let him live in Tierra del Fuego.

Deportation orders are not issued by an ordinary trial. It’s just a quick hearing before an immigration judge. Mish doesn’t know the process, he’s just reading journalists.

I believe he has had at least 8 trials in the imigration system. The problem is the regonition of rights for citizens- privlegde for legal immigrants and illegal immigrants without privilege. I didn’t say deport him without a trial. Follow all legal requirements, and then deport him again. Or imprison him in the US if he’s found guilty of a crime – and then deport him.

Are you dumb?? He was forced to return him & the humiliation is driving him insane, can’t stand the fact he doesn’t have dictatorial power, he eventually will if not stopped, that’s his aim.
What does it take to get deported? I don’t want to end up housing all the world’s degenerates. The average prisoner costs the taxpayer 33k a year not to mention court costs all payed by the taxpayer. I want immigration without the 10k going to cartels in Mexico and criminal gangs ruining retail stores in the US. This is a death by 30 million cuts. To have sensible immigration you need enforcement. How many people in world would like to live here? I would say billions but then it would not be the US.
being deported back to ones home country when they illegally entered the USA is not exactly punishment or being penalized.
