Expect a Supreme Court Ruling 9-0 or 8-1 in Favor of Trump, Then What?

I expect good news for Trump next week, likely a unanimous ruling, on narrow grounds. Then what? That’s a very different subject. Trump has huge legal problems as I explain.

Narrow Grounds Q&A

Q: Will the Supreme Court allow a mess in which states get to decide to knock a president from the ballot? If they did Texas would find an excuse to block Biden.
A: No

Q: Does the Supreme Court want to get entangled in whether or not Trump was involved in an insurrection?
A: No

Q: Does the Supreme Court want to stop all this state nonsense in a unanimous or near-unanimous ruling?
A: Yes

Q: What is the easiest way?
A: Confirm the 14th amendment is not self-executing.

The court will not touch the question of whether there was an insurrection. The Supreme Court will not want to go on a fact finding mission. It will shy away from will stay away from that argument like it had an extremely contagious, deadly disease.

Nor will it touch the question of whether the president is a “officer“ as defined in the 14th amendment. There is no need to.

For Colorado to prevail, Trump needs to be guilty of an insurrection, be an officer, and the 14th amendment needs to be self-executing.

But the court will rule the 14th amendment is not “self-executing.“ It requires an act of Congress before any state can do anything. So, unless there is an act of federal Congress, and there won’t be, no state can keep anyone off a ballot on the basis of the insurrection clause.

That’s the easy way out to get everyone on board.

Justice Elena Kagan

In the arguments, Kagan asked Jason Murray, the Colorado attorney, “I think that the question that you have to confront is why a single state should decide who gets to be president of the United States. Why should a single state have the ability to make this determination not only for their own citizens, but for the rest of the nation?

Kagan gets laughs on her questioning of Jonathan Mitchell, representing Trump. The clip culminates with Kagan announcing “Then I must be right,” also with a bunch of laughs from the watchers.

To get everyone on board, without opening up a can of other issues, the court is going to rule either 9-0 or 8-1 in favor of Trump.

The only possible holdout is Justice Sonia Sotomayor.

Chief Justice John Roberts has the right to assign the opinion and he often takes controversial ones himself. The only other candidate is Justice Elena Kagan. She is extremely smart, capable, and funny.

Roberts may assign Kagan the opinion in an effort to draw her back into the middle on other testy issues.

Then What?

Anyone who expected the court to get entangled in the definition of insurrection or other grounds of states disallowing candidates was mistaken from the beginning.

This one was a cake walk.

Trump will win this easily, likely unanimously, but that is not the end of Trump’s problems.

Trump’s Real Problems

The big problem for Trump is that the D.C. Circuit has cleared away his immunity defense.

On February 6, a federal appeals court ruled that Donald Trump is not immune from prosecution for alleged crimes he committed during his presidency.

In a 57-page unanimous opinion, the panel of three DC Circuit judges wrote that that the justice system allowed for a former president to face charges for actions he took while in office, and that the public interest in holding a potentially criminal president accountable outweighed any potential “chilling effect” on the presidency.

“It would be a striking paradox if the President, who alone is vested with the constitutional duty to ‘take Care that the Laws be faithfully executed,’ were the sole officer capable of defying those laws with impunity,” the appeals court wrote on Tuesday.

Trump’s stances in court, the judges wrote, stand in contrast to the principle that all Americans – including former presidents – are subject to the same laws.

Childs and Pan were appointed by President Joe Biden. Henderson was appointed by former President George H.W. Bush.

The judges were clear that the charges against Trump are serious and left no question they believe they can be prosecuted. The panel repeatedly eviscerated Trump’s alleged behavior after the 2020 presidential election as unpresidential and constituting an assault on American institutions.

“We cannot accept former President Trump’s claim that a President has unbounded authority to commit crimes that would neutralize the most fundamental check on executive power — the recognition and implementation of election results,” the judges wrote. “Nor can we sanction his apparent contention that the Executive has carte blanche to violate the rights of individual citizens to vote and to have their votes count.”

“Former President Trump’s alleged efforts to remain in power despite losing the 2020 election were, if proven, an unprecedented assault on the structure of our government,” the panel wrote.

Is Trump Guilty?

Here’s the problem: The issue is not whether you think Trump is guilty. Rather, the issue is whether the prosecution can convince a D.C. jury that Trump is guilty.

D.C. is not the friendliest of places for Trump to face trial.

Can the prosecution convince a D.C. jury that Trump tried to remain in power despite losing the election?

Like it or not, it’s possible, if not likely, Trump gets convicted in D.C.

What About Georgia?

Trump and 18 co-defendants were charged in Fulton County with trying to steal the 2020 presidential election in Georgia. Four have pleaded guilty in the case. Trump and the 14 remaining co-defendants have pleaded not guilty.

Despite the obvious errors of the Atlanta District Attorney Fani Willis, and the downright foolishness of her appointing a boyfriend as prosecutor, the case will be decided on legal merits, not inappropriate relationships of the DA.

As in D.C., the jury pool is not the best for Trump. Second, the evidence was strong enough that four pleaded guilty.

Third, and perhaps most important, Trump has turned into an impossible client. It’s hard enough to beat a charged-up prosecution team when you do everything your lawyer tells you to do.

If Trump continues his contemptuous attitude in court, he’s just dead in at least one of these trials.

My legal contacts suggest the DC verdict hits in June or July. The Georgia verdict hits in September.

Yes, there are appeals. But those appeals will be in process, not yet argued.

Assume the worst and Trump is found guilty in both cases. Or assume the second worst. Trump is found guilty once.

The Real Question

Would a majority of Americans look past two criminal convictions in early November? One?

That’s the real question, for Trump.

Insider trading is illegal, yet congress does it. Congress exempts themselves from certain laws. Soon after Pelosi bought bought a large sum of NVDA, the stock jumped up. She obviously knew something the average person didn’t.

Biden is not being prosecuted for breaking the law, nor was Hillary. Bankers were not prosecuted for crimes committed during the housing bubble. William Black, who prosecuted a thousand people in the Saving and Loan scam, said the banking fraud was 70 times bigger. Yet no prosecutions at all.

Trump is being subjected to political prosecution. For one, free speech is not a crime. Trump did not lead an insurrection nor did he promote violence by anyone on J6.
Insurrection is a Democrat Party political fiction. No J6 protester at the Capitol has been charged with it.

No, we are not all subject to the same laws. Some people are being held above the law. Lawfare is politically based, as well, directed at one political party. We don’t have equal justice under the law as the justice system is corrupt.

The hypocrisy of the DC circuit judges’ opinion is it prohibits voters from electing Trump who is ahead in the polls, yet concludes Trumps actions infringed on voter’s checks and balances. Furthermore, while voting is a check and balance of the people against the President, the opinion neglected to mention impeachment is another. Congress DID impeach Trump TWICE on other charges. Congress decided not to impeach Trump for election interference or insurrection.

The DC circuit case was on whether Trump can be charged for the Capitol riot, not whether he can be on the ballot (that is the Colorado Supreme Court decision). Also, Trump was impeached for the insurrection (in his second impeachment), just never convicted by the senate.

I agree. I think the ‘any one except Trump’ votes are still out there in a strong way. Each day Biden is showing that his mental acuity is further diminished. I expect a major shake up in candidates this summer. I think that Biden will bow out and that the Dems will insert Newsome or some other candidate. Not sure how the rules are written to disavow primary votes.

Whenever Trump faces a jury and only facts and legal logic count, Trump loses. That has nothing to do with court location. A BS artist like Trump has an uphill battle in any court room because BS is not supposed to work in court rooms. And now Trump also faces a $48 million tax question on top of his already hefty indictment book. It was always an interesting question why a (self-proclaimed) $10 billion net worth person doesn’t pay any income tax for a decade. Maybe the answer has been found.

Somebody finally explaining the income tax code to us proles (we all start paying income tax starting at around $75,000). Last time I checked Berkshire’s corporate tax bill, it had paid $32 billion over the last decade. That’s where Uncle Buffy pays his taxes. Trump’s income situation is a bit different. In any case, the idea of taking a $48 million loan from one’s holding company and then claiming the dog ate the loan contract is an innovative scheme that my congressman will probably not recommend.

The Fischer decision may be dispositive, but always remember that federal statutes are so vague that anyone can be convicted of something from their past. If the government wants to get you, they usually can.

So if Presidents are not immune from prosecution for act committed in office then let’s start lining them up. Obama for murder of a US citizen (16 yo boy) killed inadvertently by a drone strike on his father (no statute of limitations on that crime, go ahead bring him down to the station). George W Bush for civil rights abuses in the GWOT. If they strike the presidential immunity, any president will be hauled into court every year. There is a process for this in the Constitution, if they are not removed from office by the Congress via impeachment they are in the clear. The any other path leads to chaos.

Presidents have immunity for official acts. Nixon was aware that break ins and covering them up were not official acts. Similarly, an insurrection and big election lies are not official acts (at least outside MAGA circles).

There are Hundreds in Jail because of the last “Chaos” at the Capital in 2021.

absolutely correct. In 1963, I had two guys who were Klan members chase me up the street and around a police car with two cops inside while they had knifes drawn. Because I was very active in the civil rights movement in my town and the cops wanted to get me out of the movement they took me to the police station and let the two guys who were trying to kill me go. They sent a request to the state institute of government to find somethingdfs, anything to charge me with…it took them three weeks to charge me carrying a concealed weapon…pepper spray. I was a broke student with no money for a lawyer and had to plea to a carrying a concealed weapon. By the way, the police retold me straight up that I had better not place a charge against the klan guys as they would probably get me. They did to me what they did to general Flynn. They will break anyone financially for anything they want.

A retired CIA guy told me there is only one thing the D.C.upper echelon of Jews hate more than Trump; staunch nationalism. If Trump is convicted they are getting a full dose of uncommon nationalism. I believe they get this to the edge as far as they can and hit the brakes. Not worth it. Besides, it would be better to let him win and use their platoons of NGO’s, lawyers and corrupt politicians to constantly badger him. Much easier than going against the far left pro Palestine guild that’s for sure. Biden’s team can’t seem to get a handle on them.

The trials will be VERY long (likely weeks) with a lot of witnesses and rebuttals etc. It’s going to be all but impossible for the average person to follow in any detail because who has time to follow 6-8 hrs of testimony a day.

Trump has been a crook / liar his entire business career. Anyone that followed him BEFORE he got involved in politics knows that. If he had just walked away and asked for a Pardon to do so…JUST Like Nixon did…he would be playing golf and probably already have another ridiculous Fake-Reality TV show.
Instead, many of the things he’s done…and been doing for a long time…and now STILL doing are coming to bite him in the arse.
I don’t give two craps about Dems or Reps…I’m an Independent but anyone can watch him CONTINUE to make up NEW crap every time he speaks…or act up…when he should Shut Up.
Clean the slate…get rid of him. Get a REAL Republican Leader, who ACTUALLY has a platform and can learn to actually negotiate with others and compromise to Get Shite Done.
If they did that, the Republicans could win easily…nearly ALL Independents are sick of this Circus and Independents outnumber both Reps and Dems. It’s why 70%+ of the country DOES NOT want a Trump v Biden rematch.
It’s amazing that there hasn’t been a REAL Republican leader since Reagan. C’mon Reps…Be Better!

Trump has ALWAYS been overly self important…and YES, we’ve met him previously.
He made up BS back then and almost broke his arm patting himself on the back…while watching many of his companies go BK…and he’s completely off his rocker now.
He was NEVER the better choice. But is was kind of hilarious in the beginning. It got REAL serious when he didn’t want to give up “the throne”.
And if he were ever to get power back…he would NEVER let it go.
I used to be a Republican a long time ago…but they haven’t fielded a REALLY good candidate since Reagan. Which is REALLY sad.
The Dems aren’t much better…they could easily have transitioned from Biden to almost ANYONE that wasn’t 80 years Old and with family issues and would have given the Reps nothing to whine about and won in a landslide.
Unfortunately, we’ve got an Old Loser that just keep making up crazier and crazier shite (it’s getting downright embarrassing). And an EVEN OLDER sitting President that should have anointed his successor and just retired.
The rest of the world is mocking us…

Ironically, if he were both Younger (he’s 76) and if he had been born in the US, I would say Arnold Schwarzenegger.

Yes, I know he’s NOT eligible to run for President, because he was born in Austria. But if a Republican can get elected in California…AND get laws passed and GET STUFF DONE…then he could probably be a successful President for at least one term.
Unfortunately as I said, he’s not eligible…and probably too old to get started at this point, even if he were eligible.
Tell me he wouldn’t win 80% of the vote, if he could get on the ballot???

I doubt most of the current Repubs in Congress would be strong enough to be a great President. Certainly most of the ones that ran this time weren’t, they were mostly suck-ups to Trump.
Probably need to get someone who IS NOT a Career Politician and definitely hasn’t been nor wants to be on “Non-Reality TV shows” and it needs to be someone who isn’t interested in being in politics for more than the two terms. Fix as much stuff as he (she) can and then GO BACK HOME and run a business…or whatever they were doing before.

Independents most definitely DO NOT outnumber Reps and Dems. Independents make up maybe 10% of the population. The other 90 is roughly split evenly between Reps and Dems.

If you think what I said isn’t true then just look at the raw vote totals for any election. It’s always within a few million votes either way which means the country is pretty close to 50/50 and if Independents were really a majority we’d see instances where the popular vote went 75-25 but we NEVER see anything close to that.
