Gavin Newsom Dares Homan to Arrest Him, Trump Says Homan Should

Should Homan Arrest Governor Gavin Newsom?

Governor Newsom

Newsom Responds to Homan Statement

He’s a tough guy. Why doesn’t he do that? He knows where to find me. But you know what? Lay your hands off four year old girls that are trying to get educated. Ley your hands off these poor people who are just trying to live their lives, paying their taxes, been here for 10 years. The fear, the horror, who the hell is this guy?

Come and arrest me. Let’s just get it over with tough guy. I don’t give a damn. What the hell are they doing? They need to grow up. They need to stop, and we need to push back. So Tom, arrest me, let’s go.

Trump on Newsom

Reporter: “Gavin Newsom is daring Tom Homan to come and arrest him. Should he do it?”

Trump: “I would do it if I were Tom. I think it’s great. Gavin like the publicity but I think it would be a great thing.”

Criminal Record?

A “criminal record” does not mean much. A traffic ricket for going 5 miles over the speed limit is constitutes a crime.

Q: What about crossing the border illegally?
A: That is not a crime, unless repeated. It’s a civil violation. So stop calling being here a crime.

The Supreme Court has made a mess of enforcement of civil violations.

Politically Speaking

Newsom’s response was brilliant.

I see no gain for Republicans for an arrest of Newsom. I rather doubt they do it. If so, chalk up another TACO.

Grade A and Grade F

Give Trump and A for closing the border. Give him a F for working out a sensible policy in the wake of closing the border.

Instead of going after hard criminals, the Trump administration moved the other way. That is what fueled the backlash in California.

But give Newsom an F as well. He did not handle the riots well.

And by not cooperating with ICE in rounding up criminals, Newsom set the stage for the ICE actions that led to riots and Trump sending in the National Guard.

It’s easy to pick a side (Trump vs Newsom) based on politics, but I fault both.

A Deal for Dreamers

We need a Congressional deal that guarantees the rights of dreamers who have been in the US for a long time and are productive members of the US.

Consideration also applies to those whose spouses are US citizens, and those with citizen children.

It is economically stupid and morally unjust to not work out such a deal.

But here we are, instead skidding towards an arrest of a sitting governor in a confrontation aggravated by Trump and Newsom, perhaps purposely by both of them.

I was hoping cooler heads would prevail. But I did not realistically expect that.

What Could Have Been

On December 24, 2024, I noted Trump Backs Down From Strong Sweeping Deportation Promise

Both Trump and his border czar are sending strong messages that Trump’s deportation plan won’t live up to his campaign hype.

“This isn’t going to be neighborhood sweeps and military vehicles going through the city,” Homan said in an interview with Dr. Phil McGraw on Thursday after meeting with New York Mayor Eric Adams. “I told him, you know, President Trump and myself have committed that this is going to be a targeted enforcement operation.”

The president-elect’s allies also are concerned by the Trump team’s willingness to exclude some categories of migrants. Trump said in a recent interview with NBC, for example, that he wanted to work with Democrats to come up with legislation to protect Dreamers, immigrants in the U.S. illegally who were brought as children, from deportation. Backers of hard-line immigration policies view an exemption for Dreamers, who often have bipartisan support, as a slippery slope.

Trump repeated a similar message in a direct interview with the Wall Street Journal.

In response, I commented, if you want know what kind of dreamer deal to expect, please see my November 7, 2024 post The New Home for Hispanics is the Republican Party

Instead, National Guard troops are in LA, uninvited and unwanted. How unfortunate.

More people would have been deported and we would have had more business certainty if Trump had worked out a deal that he twice mentioned.

Now it’s chaos, possibly on purpose, by Trump and Newsom both.

Think carefully about the lead question, “Should Homan Arrest Governor Gavin Newsom?”

A goals-based answer may be the opposite of your opinion on Newsom or Trump. Others might not want to risk a showdown of this nature for any reason.

Finally, the question is not what Biden should have done, it’s how to deal with where we are now. It is economically stupid and morally unjust to not work out a deal.

King deal has not even tried.

As for this quote from the article: “Instead, National Guard troops are in LA, uninvited and unwanted. How unfortunate.”

A lot of cold water is thrown its way given the linked article:

CNN’s Harry Enten Says Trump’s Approval Rating On Immigration Has Surged ‘Like A Rocket’ |

As for Trump’s comments about arresting Newsome, childish. As for Newsome’s brilliant response, maybe grandstanding for his misguided base, but it was not in the best interest of LA, or his state. If he really wanted to quell the riots and improve crime statistics, he would be supportive of the federal government doing its job with immigration law and not trying to subvert federal law enforcement in the court room. Seems a summer of love is being redirected from rioters to law abiding citizens.

Just a tiny fraction of illegals cross the border illegally. The vast majority come here perfectly legally and just don’t go back. I know a bunch of Cubans who fly into Miami with a Cuban passport saying they are staying for a couple of weeks to visit family. Once in, they get jobs paid under the table and are essentially impossible to find. That’s why Homan is really going after “criminals”. They’ve been found by local police. Pretty much everyone else are women and children staying in church shelters. But it makes great TV, which is what Trump really cares about.

THE UNIPARTY NDAA STATUTES I RECKON.   See something say something.  Accuse him of being a terrorist.  The Ds and Rs both love that statute.  No bother with courts or notifying family or friends.  Very much like Lincoln.  Suspend Habeas and lock anyone up without a trial or hearing.  Just declare war on terror.  Isn’t the GWOT still ongoing.  Lincoln is smiling down.  As is Washington and the big federalists and the coup of 1787.

As much as I’d like to see Newsom in cuffs, the only thing arresting Newsom will do is give that lizard more traction with the hispanic voting block that want to import all their extended family into the country. He would get to look like the hero that went to jail to ‘fight for the immigrants’ or whatever nonsensical slogan the MSM is going to come up with to boost this turd.
If I were Trump I would use troops only to defend Federal Buildings and go out on a press conference to say that “we intend to honor Governor Newsom’s wishes to enable the illegal aliens he loves so much to destroy the once great city of LA – except for federal property which we will defend with deadly force if necessary. We will not intervene in local affairs, including assaults, property crimes and the like”

The American Indians were there first. The Aztecs and various and sundry groups were in Mexico first, before Spanish. The Mexican Republic was founded in 1824. There is a border between Mexico and the United States. They are separate sovereign countries. The US flag is not easily mistaken for the Mexican flag. Is LA part of Mexico?

— During the 1967-1974 dictatorship in Greece, the communist party was illegal, but its sympathizers were about 25% of the population.
— The dictatorship fell, Karamanlis came from Paris as the center-right prime minister. First action: he legalized the communist party. As a result, their percentage fell to 11%. But they held strongly in the universities and the overall culture.
— Then the socialists came to power with Mr. “Harvard” Papandreou. He was sympathetic to communists, and their percentage went down to 3%.
— In the 1990s they became kind of a museum item.
— After the crisis of 2008, all political parties got humiliated, but everybody started respecting the communists and their 3%, kind of like the Romanians still respect Count Dracula.
I see the American youth is now discovering the wonders of the Stone Age Marxism. Maybe they ought to know that Marx was fiercely against immigrants (because they reduce the working class negotiating power).

I get what trumps plan is. Fear make an example of a few the rest will leave. Same thing hes done in congress law firms tech companies etc etc.
solve the problem. Solid fines for hiring illegals. Inc day labor at home depo etc Set up a system via zoom to hire online. Id waiting at border explain rules and consciences etc.
this is a dry run for when the takeover occurs. All the one line non budget related items in the bbb is the take over move. Ive been watching vids. I’m in LA and it’s truly bizarre to see the way the protests and the response to them are being portrayed by national media.

The thing to understand about the protests–violent and nonviolent, lawful and unlawful–is that they are small! Compared to the 2020 George Floyd protests and riots, they are *tiny*. I was here for those too, and it was all anybody in the whole (very large) LA metro area could think or talk about. Thousands rioted and tens of thousands poured into the streets nonviolently for days on end. You really had the feeling that history was being made.

By contrast, today and yesterday if you weren’t in a very specific part of Downtown LA (or, more to the point, glued to a screen watching the news), you wouldn’t even know this stuff was going on. I just left a pretty typical coffee place and not only was no one discussing the protests, I didn’t even hear any outrage about the National Guard being here…likely because they were basically invisible unless you were downtown! (Ironically, depending on whether Trump doubles down on his overreaction, these may be the days that history is actually made…)

If I had to estimate I’d say there are, at any given time, between 50 and 200 people actually rioting, and maybe 2000 at most protesting nonviolently. The Guardsmen this morning were, based on photos I’ve seen, mostly standing around near the Federal Building or the Metro Detention Center just…waiting for something to happen.

exactly. there is ZERO justification for bringing in the national guard. the locals can handle it. none of this justifies the violence but the point is the national guard should only be brought in if the situation is too big for the locals to handle, as was the case in 1992.

About 500 Marines being mobilized in response to LA protests, sources tell CNN | CNN Politics

The deployment of the full Marine battalion marks a significant escalation in Trump’s use of the military as a show of force against protesters, but it is still unclear what their task will be once in LA, the sources said. Like the National Guard troops, they are prohibited from conducting law enforcement activity like making arrests unless Trump invokes the Insurrection Act.”

“Over 2,000 members of the California National Guard have been activated by the president, but only about 300 have been deployed to the streets of LA so far. Those initial 300 people were on a routine National Guard drill weekend when they were mobilized, which is why they were able to arrive so quickly.”

I am not accepting this statement as true: “Instead, National Guard troops are in LA, uninvited and unwanted. I also suspect a plurality in LA and possibly California in total is starting to get fed up with their situation, given the fires, and the ridiculous response to include little things like permits to rebuild, electric power reliability, and current budget problems to name a few.

Each were directing their blabbering to the crowds that support them and, I assume, were hoping for an arrest so that they could become a martyr for the leftists. With Ukraine showing the world how easy it is to blow up bombers and the ease of obtaining drones and incendiary devices here in America, there is zero good in having undocumented immigrants from all over the world living here. Democrats had no ammo to impeach Trump in 2020. The phone call with Zelensky was perfectly legal. Both impeachments, the corrupt Democrats were not able get a conviction in the Senate. Patel said recently he had found a secret room at the FBI. Comey wasn’t pardoned by Biden. Also that missing texts and phone records of Dr. Fauci were located. Democrat officials may well be held accountable for breaking the law.

Do you understand the difference between election politics and governing? Even in the White House, there are two distinct teams: a political team and a policy and governing team. An elected legislator, and even the President, cannot ethically and, in most cases, legally mix governing with election politics. That is what Trump did in the call with Zelensky. The President conditioned foreign policy action on the leader of another sovereign nation investigating a U.S. citizen who happens to be the President’s primary political rival.

Read 8 U.S. Code § 1325 – Improper entry by alien. Crime.

Jojo
Jojo
Reply to  Mike Shedlock

Here are the actual details.

## Is Crossing the U.S. Border Illegally a Federal Crime?

**Summary:**
Yes, crossing the U.S. border illegally is a federal crime, but the specific offense and its severity depend on the circumstances of the entry.

**Illegal Entry (First Offense): Misdemeanor**
– Entering the United States without being inspected and admitted at a designated port of entry is a federal misdemeanor under 8 U.S.C. § 1325[5][6][8].
– A first offense is punishable by a fine, up to six months in prison, or both[5][6].
– This applies to people who cross between ports of entry, avoid inspection, or use false documents to enter[5][6].

**Illegal Re-Entry (After Deportation): Felony**
– If a person reenters the U.S. after being formally deported or removed, this act becomes a felony under 8 U.S.C. § 1326[1][5][6][8].
– Penalties for illegal re-entry can include up to two years in prison, and up to 20 years if the person was previously removed after conviction for certain serious crimes[1][5][6][8].

**Civil vs. Criminal Violations**
– Simply being present in the U.S. without legal status (for example, overstaying a visa) is a civil violation, not a criminal one[5][8].
– Only unauthorized entry (crossing the border without inspection) or re-entry after removal are criminal offenses[5][8].

**Key Points:**
– **First-time illegal entry:** Misdemeanor (criminal offense, up to six months in jail)[5][6][8].
– **Illegal re-entry after removal:** Felony (criminal offense, up to two years or more in prison)[1][5][6][8].
– **Unlawful presence (overstaying a visa):** Civil violation, not a crime[5][8].

**Clarification on Common Misconceptions:**
– Not all undocumented immigrants have committed a criminal offense. Many are present due to visa overstays, which is not a crime but a civil infraction[8].
– The term “illegal alien” can be misleading, as not all unauthorized presence is criminal[8].

**Conclusion:**
Crossing the U.S. border illegally is a federal crime—usually a misdemeanor for first-time offenders and a felony for those reentering after deportation. Merely being in the U.S. without authorization (such as overstaying a visa) is not itself a criminal act, but can lead to civil penalties and removal proceedings[5][6][8].

Yes, AI lawyers are surely the best answer.

Also, listing a bunch of footnotes without providing access to them is …
genius reserach.

You can use the Google Machine on the interwebs and find all sorts of US Code which makes illegal aliens actually illegal. Yeah I know, what a concept.

You can tell those who are brainwashed. It is obvious that illegal immigration is a crime as stated by multiple searches on the topic. We are in serious trouble as a nation with people who can’t accept simple facts but are lost in the fog of empathetic suicide.

These seem fairly supportive that it is a crime although there may be some nuance..

  • “Illegal Entry”/8 U.S.C. § 1325 makes it a crime to unlawfully enter the United States. It applies to people who do not enter with proper inspection at a port of entry, such as those who enter between ports of entry, avoid examination or inspection, or who make false statements while entering or attempting to enter. A first offense is a misdemeanor punishable by a fine, up to six months in prison, or both.
  • “Illegal Re-Entry”/8 U.S.C. § 1326 makes it a crime to unlawfully reenter, attempt to unlawfully reenter, or to be found in the United States after having been deported, ordered removed, or denied admission. This crime is punishable as a felony with a maximum sentence of two years in prison. Higher penalties apply if the person was previously removed after having been convicted of certain crimes: up to 10 years for a single felony conviction (other than an aggravated felony conviction) or three misdemeanor convictions involving drugs or crimes against a person, and up to 20 years for an aggravated felony conviction.

Civil vs. Criminal Offense: The Supreme Court has not directly ruled that illegal immigration as a whole is not a crime, but it has addressed aspects of immigration law. In Arizona v. United States (2012), the Court struck down parts of an Arizona law, noting that immigration violations like unlawful presence are generally treated as civil offenses under federal law, not criminal ones. For example, being unlawfully present in the U.S. is not a criminal offense under federal law, though illegal entry (under 8 U.S.C. § 1325) or re-entry after deportation (8 U.S.C. § 1326) can be criminal. Deportation itself is considered a civil consequence, not a criminal penalty.

Now watch Trump take this bait like the narcissist he is, arrest Newsome, and then have the bond market implode. Bonds are already tanking right now, let’s see how many foreign investors we can send packing before this is over.

Trump hates foreigners a lot for a guy who’s nation relies on their money.

Bond market implode? Because of the Hair? Yeah, no. Interestingly enough, bond investors prefer law and order, it signals return of principal and interest.

Milton Friedman put it best

“There is no doubt that free and open immigration is the right policy in a libertarian state, but in a welfare state it is a different story: the supply of immigrants will become infinite.”

Trump is 100% right to get rid of illegal immigrants. The United States does not need low skilled labor that is a net drain on the system. Newsom and others are posturing and pretending as if it’s a moral issue. They don’t care about these people, its just about votes.

this isn’t the issue. the issue is ordering the national guard to a small-scale civil disturbance that is being handled by the locals properly.

Summer of love, Antifa attacked federal buildings and actually put some under siege. Same narrative by MSM now, mostly peaceful, guys just enjoy watching cars burn, sending in law enforcement just inflames the flaming situation, therefore law enforcement is bad, Trump is a Nazi, etc. ad nauseum. Antifa and BLM violent protests were not only allowed but openly encouraged by certain pols, and the Feds supported this. Bystanders at J6 were insurrectionists. Hmmm. As the Dem / Uniparty / New World Order goes, “words matter.” In the world, actions do too.

I recently read a book that described the 6 stages in the ‘life cycle’ of an empire, the 6th stage being when the empire collapses and revolution or civil war takes hold. We are deep into the 5th stage.

probably referring to the guy at peterturchin.com

I remember reading about his predictions several years ago that the 2020s would be a period of social upheaval. At the time it was hard to imagine coming true, but it did.
