Trump Admits It’s Hard to Get the Supreme Court to Hear a Case

“The problem is it’s hard to get into the Supreme Court,” he told Fox News presenter Maria Bartiromo. “I’ve got the best Supreme Court advocates … lawyers that want to argue the case if it gets there. But they said it’s very hard to get a case up there.” 

“Can you imagine? Donald Trump, president of the United States, files a case and I probably can’t get a case … and we have tremendous proof … we have hundreds of hundreds of affidavits, sworn affidavits. And it’s very hard to get a case to the Supreme Court,” he said.

Dear President Trump

  1. Allegations of fraud and sworn affidavits do not constitute proof.
  2. Your lawyers dropped all claims of fraud. 
  3. If your lawyers refuse to claim fraud and refuse to provided evidence, what precisely do you want the Supreme Court to review? 
  4. The notion that you have the best lawyers is laughable. You are 0-35 in cases. 
  5. Your lawyers were effectively and unanimously rebuked by Appeals Court judges nominated by Republicans, one by you. 

Reasons Why the Supreme Court Won’t Decide for Trump

  1. Election law is a state issue. Giuliani tried multiple times in multiple states to make federal law an issue. He failed in every attempt.
  2. Pennsylvania, Michigan, Georgia, and Nevada have all certified the election for Biden.
  3. Trump needs to succeed in not one case in one state, but in multiple cases in multiple states. The Supreme Court is likely to reject hearing cases on grounds they are moot.

Supreme Court Reality “Partially” Sets In 

Perhaps the Court should take these absurd cases just to send Trump a unanimous message.

But even Trump admits it’s unlikely for the court to take the case. 

This is where “partially” comes into play.

I highly doubt Trump’s admission will stop delusional supporters afflicted with Trump Cult Syndrome (TCS) from thinking Trump will ultimately prevail in the Supreme Court or the state legislatures.

It’s pretty crazy how many folks refuse to aknowledge the fact that while Trump and his lawyers keep incessantly shouting fraud from every rooftop, they expressly disavow fraud claims when it comes to actual court proceedings. It’s a shame that reporters aren’t really pressing them very hard on this apparant paradox when confronting them at press confrences or in interviews.

Given the lack of evidence, coupled with the requirements of FRCP 9(b) which require a higer standard of pleading (i.e., “fact pleading”) when it comes to fraud allegations (this is different from any other type of lawsuit), it is absoultely impossible for Trump’s “elite legal stike force” to ever even file a case in Federal court alleging voter fraud, much less get to the stage of arguing one, regardless of how “big and beitiful” a case Trump wants to file as he told Maria Bartiromo on Fox News.

To Trump its an ultimate high stakes poker strategy of bluffing, doubling down, and so on. Never admit you have a loosing hand. Trouble is Trump is playing with other peoples money, so as long as he has support, there is no reason to fold, and plenty are willing to continue to back him. Its a strategy he has succeeded at his whole life, so why would he back down now? He is also willing to pursue any angle necessary to succeed, and has plenty of people willing to do dirty work for him, and is in a position to do a lot of harm in the process.

No wonder he was complaining on toilets that needed to be flushed a dozen times..The President claimed Americans are flushing their toilets “10 times, 15 times, as opposed to once” and argued that they are having difficulty with washing their hands in what appeared to be a tangent about low-flow sinks and toilets.
“We have a situation where we’re looking very strongly at sinks and showers and other elements of bathrooms where you turn the faucet on — and in areas where there’s tremendous amounts of water, where the water rushes out to sea because you could never handle it, and you don’t get any water,” the President said during a roundtable with small business leaders about deregulatory actions.

Listened to a clip of Mark Geragos’s take on Trump’s efforts. This is all being done to avoid criminal prosecution in New York but it’s way more than a long shot.

Besides failing on fact and evidence Trump is failing on law. He is and was seriously handicapped on laches and purcell. The time to have made all these arguments was way before the election. The courts will not disenfranchise voters and the courts believe voters have a right to know what the rules are. What Trump effectively did was sit back let the election happen and complain afterwards. No court is going to want to get involved.

my take-away as usual is that Trump believes as President his rights are absolute. He seems to be flabbergasted when that’s not the case. Not so ironically he’s the among the first to deny rights to others.

Trump got an hour on Maria Bartiromo to spew unchecked mendacity. Bartiromo didn’t even fact check or challenge Trump on a single claim. Then on a later show Eric Shawn gets about 10 minutes to debunk it all. Shawn did a great job but I doubt many FOX viewers saw it compared to the coverage Trump got on Bartiromo
