Please consider the WSJ editorial Trump’s Challenge Is Over

Mr. Trump’s last legal gasp came Friday evening when the Supreme Court declined to hear the Texas lawsuit seeking to overturn the election results in Georgia, Wisconsin, Michigan and Pennsylvania. As we predicted, the Court cited Texas’s lack of legal standing to challenge how another state manages its elections.

Some on the right claim that Justices Samuel Alito and Clarence Thomas dissented, but this is wrong. The Justices said they would have taken the Texas case as a “bill of complaint” when states sue other states.

The Supreme Court was thus unanimous. Let’s discuss the key points the Journal made.

Key Points

  1. The Court made the right call, and it would be refreshing if the political left that has relentlessly attacked Mr. Trump’s judicial appointees as partisans admitted how wrong they’ve been.
  2. If anyone can sue without a cognizable injury and the possibility of remedy, the courts would be overwhelmed with frivolous claims.
  3. The spectacle of so many House Republicans endorsing the Texas suit is depressing, and they aren’t profiles in courage. But their critics would have more credibility if they hadn’t promoted the Russia “collusion” lies for four years and indulged Hillary Clinton’s claims to this day that the Russians elected Mr. Trump in 2016. This is one reason that tens of millions of Americans are inclined to believe Mr. Trump’s election claims despite the losses in court.
  4. None of this excuses Mr. Trump’s attempts to delegitimize Mr. Biden’s victory on Nov. 3. 
  5. There is no doubt that mass mail-in balloting led to more election problems, such as varying rules for signature verification in different Pennsylvania counties. But these irregularities do not add up to a stolen election in multiple states
  6. There’s no predicting how Mr. Trump will behave. Perhaps he will continue his “stolen” election claims past Jan. 20. Perhaps he can’t admit to himself that he lost. Perhaps he hopes to nurture resentment to run again in 2024.
  7. Bitterness as a political strategy rarely wears well.  If Republicans lose the Georgia Senate runoffs on Jan. 5, Mr. Trump will deserve much of the blame. 
  8. There’s a time to fight, and a time to concede. Mr. Trump has had his innumerable days in court and lost

The above points are all direct quotes from the WSJ editorial.

While it may be difficult in general to predict what Trump might do or say, I suspect this case is different.

One Last Fleecing

Those afflicted with Trump Cult Syndrome demand that Trump never concede. And if he does concede, contributions (allegedly to fight these  court battles that even the WSJ understands are ridiculous) will stop flowing in.

The money is not for fighting election fraud, it is to raise money for Trump’s other needs including tax evasion and a myriad of civil cases once his shield of presidency is gone. 

But hey, believe what you want, even these.

Those with TCS demand Trump fight on. So he will. Contributions depend on it. 

It’s over. The electors have decided. 

However, The fleecing must continue even if it costs Republicans the Senate in Georgia.

Mish I was shocked to hear that Trump’s new PAC is fundraising in Georgia for the January 5th Senate elections, I was shocked to hear that a total of 0% of the money that Trump 2024 PAC is raising was going to the Georgia race. Simply shocked it’s so out of character for Trump!

In response to your “key points”:

  1. One good call does not make a good justice but I have actually been surprised by Gorsuch and Kavanaugh in a few decisions which means that they at least have a reasonably open mind. Thomas is actually the most hidebound.
  2. True
  3. The big difference is that a) Hillary conceded immediately, b) Russia did try to influence the election but no one in power tried to change the result, c) Obama didn’t use the power of the federal government to try to change the election result.

  5. Since money and other financial assets are transferred every day without physical presence it stands to reason that there is a relatively fool proof method of having secure “absentee” voting. Republicans do not want it because Democratic turnout would increase. They want to be able to keep the issue alive for each election they want to dispute. Your new state has 100% mail in ballots. It would be best to have a federal standard for federal elections so everyone in the US has an equal chance to vote.
  6. You can predict that Trump will behave badly. He will only do what is in his best interest. I don’t believe that he has ever said that he has lost (in anything). Everything is always “cheated” or “stolen” from him.
  7. If Republicans embraced mail in ballots in Georgia they would probably win both Senate elections.

The thing you have to keep in mind is the difference between “liberal” and “conservative” justices is not what most expect. “Conservative” justices may well be conservatives politically, and “liberals” may be liberal politically, but that is not the core difference. “Conservative” justices are more focused on history and precedent, while “liberal” justices are more open to new flexible interpretations, constantly updating the law to fit their idea of where we should be. Thus, “Conservative” justices will stick to the law, and not imagine causes of action where there are none, ergo this was a hopeless case from the start, and the result was the expected 9-0 decision against Trump.

More is being made of the comments by Alito and Thomas than should be made. They both believe that the Supreme Court has no discretion, and must hear all cases brought by one state against another. Thus, they would have taken it. On the other hand, they agreed that there was no remedy they could grant. Thus, it was 9-0 that Texas didn’t present a cause of action where a remedy was possible, and 2 justices thought they should take the case and then dismiss it, while 7 thought they should not take it in the first place.

What Trump wanted was justices whom he could control, and who would do his bidding. What he got was Conservative justices who believe that the judiciary is an independent branch which owes no allegiance to either party, and whose job is to remain above the political fray, and exercise judicial restraint, and to interpret the Constitution.

It is not a lie that there was Russian interference. Both the Muller report and the Senate intelligence committee confirmed it.

“Collusion” was never proven. Given the meetings between Russians and Trump people, including the one Flynn lied about, it seems probable to me. But then again given their incompetence, maybe they couldn’t have kept it secret. Do you really believe they met to talk about adoptions? It’s clear The Russians hacked Podesta and Democratic emails, and dropped them through Wikileaks to help Trump.

The Committee finds the Intelligence Community Assessment (ICA) presents a coherent and well-constructed intelligence basis for the case that Russia engaged in an attempt to interfere with the 2016 U.S. presidential election.

Not a single thing you mention is a fact in public evidence nor in a court of law. It’s just opining by so-called authorities. You have badly skipped doing any homework on the hacks. Sworn testimony to the effect that there was no evidence of exfiltration by the only (poorly executed) security audit that was undertaken.

No factual evidence produced, only assessments and narratives, backed by nothing they are willing to show.
As for the hacks, no evidence of any hacks (congressional testimony), only assumed. There is a lot of technical evidence though that the information was leaked from the inside.

You see, the Russians hacked the Democrats’ emails and exposed them for the crooks they are – and that’s not fair!

Meanwhile, Barr helps throw the election to the Democrats by not coming forth and confirming the Biden investigation; the MSM bury the Biden laptop scandal; the vaccine isn’t confirmed a success until one day after the election; China compromised a Democrat on the Intelligence Committee back in 2014, was tipped off by the FBI (gosh, why didn’t they do that with Trump if they were so concerned about Russia?), but we didn’t learn about that until now, the MSM routinely lied in the coverage the last four years, but we have to watch out for the Russians!

Yes, you are correct. Illegally hacking into emails isn’t fair. Such “bombshells” as Hillary knew some debate questions ahead of time and that Hillary said politicians sometimes need a public and a private position. They cherry picked the most embarrassing things, like discussion of the role of the Catholic church in the election. Glad to see you finally got it. Sure would love to have the emails from the Trump campaign! It was also the start of the whole “Pizzagate” absurdity, as there are numerous references to ordering pizza.

Legal remedies have not concluded, why not let the process play out? The Director of National Intelligence is compelled to file a report with respect to alleged foreign interference with an election by December 18th. If the report is mere speculation then the process will end accordingly in due course. However, there is already smoke which needs further investigation. For example, the $400 million dollar transfer to Staple Street Partners (the parent entity to Dominion) in October. The SEC Form D is publicly available.

Hard to pin an exact date on it, but I think some time in May or June Trump fired off the fatal shot (self inflicted, of course) and he was just on life support until November. Now they’ve pulled him off all the machines.

If I could pin a single moment on Trump’s done-ness, it would be when the park was tear-gassed in the middle of a pandemic so that he could go hold a Bible upside-down in front of a church that didn’t like him.

I labeled him as “done” back in February when he switched from taking Covid seriously, to treating it in crazy ways, and put himself at the center of the debate, with statements like “We have it completely under control” and “Anyone that wants a test can get a test”. It was obvious that he didn’t take it seriously, and that he didn’t know what he was talking about (or was lying). Yes, he could have made those into non-significant statements by how he handled it later, but instead he just kept going down that path of denial and kept the issue politicized, with himself at the center.

For what it’s worth, better things to have have said at that time would have been “It is under control for now, but it will be difficult to keep it under control” and “We are working on rolling out our new test and as time goes, we will be able to test more and more people”. Even better would have been to have made the Covid team headed by Pence non-partisan, and to have included Democrats as well as Republicans, and to have let them make the announcements and answer the questions, and to have stayed out of the limelight most of the time.

As a comparison, in Nebraska, where I live, the Governor (Republican) worked closely the the Mayors (mostly Democrats). They all agreed on what the best way to address it was, and it was handled in a non-partisan way. They eventually had some breaks over the issue of mask mandates, but for the most part we avoided all the conflict that occurred elsewhere. Our results? Not that great, but not terrible. We are #4 in cases per million, but only #31 in deaths/million, and our hospitals have never exceeded 80% of capacity. The key, though, is that people aren’t blaming local politicians. They blame the virus, and many blame Trump.

PA, GA, MI, WI, AZ, NV, and NM have alternate electors. The Texas suit was just that, The Texas suit. Other suits were initiated by the President’s team, they remain unresolved. I’m not saying either way, not sure why anyone else would, either, unless wishing it were over.

Nov 3rd, democratic traditions were thrown out when observers were forced from the counting rooms of a few key precincts.. I noticed very few tears shed, in a move that would have made Stalin proud. Refer to the affidavits in the court filings. Voting machine misbehavior was observer abuse on steroids.
Today, we are watching is an attempt to restore the democratic features of our Republic. Very few politicians are mentioning voting reform, I suspect they are happy with the system that landed them their seat.
Yes, I oppose what I see coming. I don’t get to choose my army, but I fight with the army I have, and for now, that is Trump.

No just a reminder that Hong Kong is nowhere near democracy, whatever that means, not even having elections. There have been plenty of uprisings and demands for more rights in the past, but against the British imposed authority instead of the CCP. The whole Protest movement was largely funded and organized with the help of foreign NGO’s and American influence, and did not have all that much popular support.
The extradition thing started with something really problematical, a guy literally getting away with murder.
Don’t have the solution to Hong Kong’s problems, but the situation has far more aspects than the standard color revolution of the people heroically rising up for their freedom, leading to a better society (in the end, this is never the result).

I think there’s only 1 new outstanding case, other than appeals. Trump’s team has 1 win and 59 losses in cases, not counting all of the appeals they’ve lost.

I think the 1 case they did win was to shorten the cure time for some ballots in PA from 9 days to 6 days, which affected a few dozen ballots.

There really aren’t a bunch of cases out there that are yet to be decided, other than appeals on cases that they’ve already lost.

We need to come to terms with the fact that a substantial portion of the Republican party is hostile to Democracy. 17 Republican attorney generals signed on to Trump’s Texas challenge. They knew better and were joined by over 130 Republican legislators. Today Republicans in Michigan attempted to submit a false slate if electors.

Trump knows he can’t win but he will attempt another coup on January 6th. Just because its likely to fail doesn’t mean we shouldn’t take it seriously.

I’ve thought about this too. I’m not sure what he can do on Jan 6 to change the outcome, since he needs a 50% majority in both houses of Congress to throw out EC votes in multiple States.

After his SCOTUS defeat, I was really worried he would do something really drastic (and overtly illegal) to stage his coup, but it looks like he’s just going to keep whining on Twitter instead.

A year from now, with DOW 40k, GDP Print in double digits, National home price average at $500k, 10 year yield at 5%, unemployment around 3%, all this election silliness will be forgotten. MMT will be the new normal.

TIPS, Energy and Commodities should dovetail nicely into the above scenario. This next 4 years could very well be the last hurrah.

Treasury Department, and Dominion voting system to manipulate the results.
The news now reported how it was hacked, and even Fire Eyes had trouble to defend the hacks.
When you are ignorant, and lack of knowledge, you exposed your flaws, biased judgements, please read all the news and called Fire Eye technical experts to explain the security hacks.

No chance, it is not final until Jan 06,2021.
There are half dozen more lawsuits for SPUS to go through, Sydney’s Powell
law suit passed the smoke test, and SPUS is reviewing evidences.
The later law suits will correct all the flaws as the final ones will be perfect
that no lawyer in the country can deny the perfection from Constitutional basis to factual evidences.

Mr. Trump is very concerned about the Georgia Senate races…..NOT!

When will they figure out that Trump cares about Trump….and absolutely NOBODY else. (I’m guessing a fair percentage of the Trump base will never see reality).

But the WSJ got it right finally. Spot on.
