Supreme Court Rejects Religion Challenge to New York’s Vaccine Mandate

In a case that shows where the court stands on state’s rights related to Covid, the Supreme Court Rejects Bid to Block NY’s Covid Vaccine Mandate.

  • The U.S. Supreme Court on Monday denied an emergency bid to block enforcement of New York’s coronavirus vaccine mandate for health care workers.
  • The legal challenge was filed by a group of 20 doctors and nurses who argued that the state’s vaccine mandate violates the First Amendment to the Constitution because it fails to include a religious exemption.

Where the Supreme Court Stands

Whereas Biden’s OSHA mandate has failed at every turn in district and appeal’s courts, New York succeeded.

Why?

To understand why, let’s review a court ruling against Biden.

Key Judicial Points of the 5th Circuit

  • On the dubious assumption that the Mandate does pass constitutional muster—which we need not decide today—it is nonetheless fatally flawed on its own terms
  • Rather than a delicately handled scalpel, the Mandate is a one-size-fits-all sledgehammer that makes hardly any attempt to account for differences in workplaces (and workers) that have more than a little bearing on workers’ varying degrees of susceptibility to the supposedly “grave danger” the Mandate purports to address.
  • The Mandate is staggeringly overbroad. Applying to 2 out of 3 private-sector employees in America, in workplaces as diverse as the country itself, the Mandate fails to consider what is perhaps the most salient fact of all: the ongoing threat of COVID-19 is more dangerous to some employees than to other employees. All else equal, a 28 year-old trucker spending the bulk of his workday in the solitude of his cab is simply less vulnerable to COVID-19 than a 62 year-old prison janitor.
  • In light of this immense complexity, one might naturally ask the Agency—is this situation truly amenable to a one-size-fits-all Mandate?
  • At the same time, the Mandate is also underinclusive. The most vulnerable worker in America draws no protection from the Mandate if his company employs 99 workers or fewer. The underinclusive nature of the Mandate implies that the Mandate’s true purpose is not to enhance workplace safety, but instead to ramp up vaccine uptake by any means necessary.
  • If the deficiencies we’ve already covered aren’t enough, other miscellaneous considerations seal the Mandate’s fate. For one, “[t]he Agency cannot use its ETS powers as a stop-gap measure,” Asbestos Info., 727 F.2d at 422, but concedes that that is precisely what the Mandate is intended to do here.
  • It lastly bears noting that the Mandate raises serious constitutional concerns that either make it more likely that the petitioners will succeed on the merits, or at least counsel against adopting OSHA’s broad reading of § 655(c) as a matter of statutory interpretation.
  • The Mandate likely exceeds the federal government’s authority under the Commerce Clause because it regulates noneconomic inactivity that falls squarely within the States’ police power. A person’s choice to remain unvaccinated and forgo regular testing is noneconomic inactivity.

Because of numerous court challenges, the case was moved to the 6th Circuit Court.

Biden could have and should have dropped his mandate but he presses on. 

I expect the 6th Appellate Court to rule similarly to the 5th Court and if so, the Supreme Court may not even take the case.

Wise Move?

The Supreme Court ruled properly. But whether New York made a wise move is of course subject to debate. 

What About New York City’s Vaccine Mandate?

Mayor Bill de Blasio announces a new ‘first in the nation’ requirement that goes into effect later this month.

The mayor’s mandate applies to all New York City workers including private sector workers.

For now, the NY State Supreme Court blocked enforcement. 

How Many People in NYC Are At Risk of Losing Their Job Over the Mayor’s Vaccine Mandate?

On December 8, I addressed the question How Many People in NYC Are At Risk of Losing Their Job Over the Mayor’s Vaccine Mandate?

My conclusion, based on employee counts and vaccination percentages: 

Some number of people will refuse vaccinations. I suspect between 150,000 and 450,000 people will lose their job over the mandate. To pick a number, call it 250,000

That’s 5.9% of the entire city’s workforce. The mandate also impacts restaurants and public facilities.

  • Vaccine proof for indoor dining, fitness, and entertainment required for children aged 5-11
  • Program now requires two vaccine doses for New Yorkers over age 12

My additional comments from December 8 come into play.

Is This Even Legal?

As an aside, it’s likely the governor could make such a ruling for the state. It is highly questionable a mayor can do the same.

Even if a mayor could, it is beyond idiotic for a mayor with just a few days left in his term to do so. 

We now know the state can make such a ruling, even over religious objections. Can New York City? 

I doubt it, but we need a definitive answer soon. 

Formal guidelines are due the 15th and the rules are supposed to kick in on December 27.

A hearing by the state supreme court is tomorrow. My guess is the court will toss the case and NYC will foolishly appeal.

The justification for vaccines that Uncle Joe is giving us is that they prevent the spread of covid (untrue), the apparent logic being that no one wants ICUs to be overwhelmed by unvaccinated covid patients. Of course, obesity is the highest risk factor for covid. Ergo, they contribute to ICUs being overwhelmed and represent a danger to others. If you can’t have a religious exemption because you’re a danger then the government should be able to force people to lose weight.

In November 2020, the Supreme Court sided with religious groups to stop state bans on large religious gatherings in New York State. It was a decision against public health. This time the Court went the other way. Perhaps it had something to do with the fact that the earlier case was related to religious gatherings and the second case was filed by employees and had nothing to do with their ability to pray.

If you will note, all SCOTUS decisions to not issue injunctions have applied to State or private businesses, whereas Federal Appeals court injunctions have involved Federal mandates.  What this is telling me is that the courts have all deemed this a States’ rights issue when it comes to vaccines, despite their not saying so yet.
So, when the 6th Circuit decides the OSHA case, this will all become quite evident, and will further enjoin any other Biden Federal mandates from being applied, with the possible exception of the military.  If Biden appeals the 6th Circuit’s decision to the SCOTUS, they will either refuse to hear the case or uphold the ruling if they do take it.

If people are willing to get fired over not a getting a vaccine for a job requirement, then they probably should not have been in that field in the first place. There are people I know that lost their pension and were due to retire in 2022 but stood firm and lost their job for cause. Getting fired is grounds for losing your pension. I’m sure the pension fund managers are a little happier because of fools making the dumbest financial decisions anywhere ever.

Outside of the medical field, what possible reason should I reasonably expect to be required by my employer ANYTHING vacc-related after I’ve been an employee for how many decades?
The extent that employers have into your personal life certainly has limits. For perspective, I had COVID alpha, and Delta along with all my 5 others in my family with much a-do about nothing. Mandatory vacc that I don’t need? I have zero risk to my co-workers and clients. Or risk my career if I don’t? Really?

Employers can change the rules on the fly and do whatever they please. This Supreme Court favors employer mandates more than government mandates and ruled so multiple times. What do you think is the reason employers started with mandates BEFORE the OSHA mandate ? The extent that employers have onto your personal life has limits is  a farce. It always was. Just because you didn’t realize it doesn’t mean anything.

Why? There shouldn’t be a Covax mandate in the first place. These Covaxxines are non sterilizing. They don’t prevent people from contracting or spreading Covid. They also aren’t proven safe. A Covax mandate leaves the employer open for liability for vaccine injury. 
Covax is largely treatable with early treatment therapies. Blocking early treatment is what has caused so many hospitalizations and deaths.

I wonder what will happen with this and whether they will dare cut pensions.
For example imagine a father decides not to vax and gets fired and they decide to cancel his pension. His wife and kids had no say in this and yet they are dependent on his pension. I’d imagine they’d sue claiming they need the pension money and I’d expect public optics (ie it looks bad to starve a wife and kids) would cause the pension plan to back down.
Even if some do lose their pension you know who ultimately pays? You, me and everyone else because suddenly instead of their pension, they are going to be living on our dime via welfare and other government handout plans. It’s better for me personally if none of these people lose their pensions. It sounds like you will be happy to pay for such people’s welfare/handout plans.

LOL. Funny I’ve never worked for the government or even on a private sector project that was funded by the government. These people that think they somehow have all these rights in the private sector are kidding themselves. It comes down to who is productive and who is not. If you don’t want to work you can’t be productive.

One isn’t breaking the law if they have a religious exemption. For what reason should it be illegal to have one? The Covax either protects YOU or it doesn’t, if YOU take it. 
What should be illegal, is for the public health agencies to block life saving therapies because they have a vaccine agenda.
A lot of people wound up in the hospital or died because of that.

Agreed. Vax will keep me from dying, and I don’t need medical services hardly ever, so I don’t personally care if you want to roll the dice for an agonizing death. If I needed chemo or something, and stupids on ventilators kept me from getting it, I would feel anger instead of amused contempt. Am I an elitist? Can’t help but be when you kooks set the bar so low.
